HomeMy WebLinkAbout20143496.tiff HEARING CERTIFICATION DOCKET NO. 2014-87 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0047, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (AN OFFICE/SHOP, EMPLOYEE PARKING, AND STORAGE AND PARKING OF TRUCKS AND RELATED EQUIPMENT) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICUTURAL) ZONE DISTRICT—GERALD AND LUCILLE REID A public hearing was conducted on November 19, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem - EXCUSED Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Diana Aungst The following business was transacted: Fi I hereby certify that pursuant to a notice dated October 3, 2014, and duly published October 8, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Gerald and Lucille Reid, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0047, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (an office/shop, employee parking, and storage and parking of trucks and related equipment) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Diana Aungst, Department of Planning Services, stated the applicant submitted a letter, dated October 28, 2014, to withdraw the application. She stated her understanding is they did not want to risk denial from the Board of County Commissioners, resulting in a Substantial Change, following a recommendation of denial from the Planning Commission. 2014-3496 C• CA,?L‘24Z4 PL2304 HEARING CERTIFICATION -GERALD AND LUCILLE REID (USR14-0047) PAGE 2 I] Commissioner Garcia moved to accept the request of Gerald and Lucille Reid, to withdraw the application for a Site Specific Development Plan and Use by Special Review Permit, USR14-0047, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (an office/shop, employee parking, and storage and parking of trucks and related equipment) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. The motion was seconded by Commissioner Conway. Commissioner Conway noted, for the record, that the Board of County Commissioners does not always concur with the recommendation of denial from the Planning Commission. Chair Rademacher noted that the cost for a new application would be $2,500.00, and Commissioner Conway replied that fee could, potentially, be waived by the Board. The motion carried unanimously. There being no further discussion, the hearing was completed at 10:41a.m. This Certification was approved on the 24th day of November, 2014.
