HomeMy WebLinkAbout20143495.tiff RESOLUTION RE: ACCEPT REQUEST OF GERALD AND LUCILLE REID TO WITHDRAW APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0047, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (AN OFFICE/SHOP, EMPLOYEE PARKING, AND STORAGE AND PARKING OF TRUCKS AND RELATED EQUIPMENT) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICUTURAL)ZONE DISTRICT-GERALD AND LUCILLE REID WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of November, 2014, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of hearing the application of Gerald and Lucille Reid, 7605 W. 19th Street Road, Greeley, CO 80634, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0047, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (an office/shop, employee parking, and storage and parking of trucks and related equipment) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, on the following described real estate, to-wit, and: Lot A of Recorded Exemption, RE-1575; being part of the E1/2 NE1/4 of Section 22, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing, the Board was presented with a letter, dated October 28, 2014, from the applicant requesting the withdrawal of the application, stating they may pursue the matter at a later date, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this withdrawal request shall be accepted. 7I 2014-3495 CC', CA,PL,(�ppl:cv tt' 141 PL2304 ACCEPT WITHDRAW REQUEST (USR14-0047)- GERALD AND LUCILLE REID PAGE 2 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request to withdraw the application of Gerald and Lucille Reid, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0047, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (an office/shop, employee parking, and storage and parking of trucks and related equipment) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, on the parcel of land described above be, and hereby is, accepted. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 19th day of November, A.D., 2014.
