The Weld County Health Department has reviewed this final plat application for a 9 lot PUD
on 135.43 acres. The minimum lot size of 2.93 acres coupled with an overall density of one
septic system per 15 acres does meet current Department policy. The application was
previously reviewed under case number Z-567 in 2001.
Water
The application has partially satisfied Chapter 27 of the Weld County Code in regard to
water service. Water will be provided by North Weld County Water District. An agreement
from North Weld County Water District was provided in the application materials for the 5 lot
change of zone which was submitted in 2001 . An updated agreement which includes the 4
proposed lots is required.
Septic
Sewer will be provided by individual sewage disposal systems. Percolation data was
submitted for lots 5 and 6. Those test results indicate that engineered designed systems will
be required for those lots. The remaining lots will require individual percolation tests when
an individual sewage disposal system is applied for. An area located in the northeast corner
of lot 1 is located in the floodplain. As this is a large lot, locating an individual sewage
disposal system outside the floodplain should not be an issue.
This Department recommends that language for the preservation and/or protection of the
absorption field shall be placed as a note on the final plat. The note should state that
activities such as landscaping (i.e. planting of trees and shrubs) and construction (i.e.
auxiliary structures, dirt mounds, etc.) activities are expressly prohibited in the designated
absorption field site.
The initial impact plan submitted in the application materials appears to address all the
environmental impacts of Section 27-6-40.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
The following requirement is recommended to be met prior to allowing the plat to be
recorded:
1. Submit documentation from North Weld County Water District indicating that water
service is available for the four proposed lots.
We recommend that the following conditions appear as notes on the final plat:
1. Water service shall be obtained from the North Weld County Water District.
2. This subdivision is in rural Weld County and is not served by a municipal
sanitary sewer system. Sewage disposal shall be by septic systems designed in
accordance with the regulations of the Colorado Department of Public Health
and Environment, Water Quality Control Division and the Weld County Code in
effect at the time of construction, repair, replacement, or modification of the
system.
3. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area.

for more information.
4. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance
conditions, at the request of the Weld County Health Department, a fugitive
dust control plan must be submitted.
5. In accordance with the Regulations of the Colorado Air Quality Control
Commission any development that disturbs more than 5 acres of land must
incorporate all available and practical methods that are technologically feasible
and economically reasonable in order to minimize dust emissions.
6. If land development creates more than a 25-acre contiguous disturbance, or
exceeds 6 months in duration, the responsible party shall prepare a fugitive
dust control plan, submit an air pollution emissions notice, and apply for a
permit from the Colorado Department of Public Health and Environment.
7. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld
County Code shall be placed on any recorded plat.

After reviewing the application and documents submitted Building Department has the following
comments:
A building permit will be required for any new construction, alteration, or addition to any building
on the property. A building permit application must be completed and two complete sets of plans
including engineered foundation plans bearing the wet stamp of a Colorado registered architect or
engineer must be submitted for review. A geotechnical engineering report performed by a registered
State of Colorado engineer or a open hole inspection shall be required.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International
Residential Building Code; 2006 International Energy Code; 2006 International 2011 National Electrical
Code; and Chapter 29 of the Weld County Code. A plan review shall be approved and a permit must
be issued prior to the start of construction (Department of Building Inspection)
