A RESOLUTION AUTHORIZING THE TRANSFER OF EQUITABLE SHARING FUNDS
IN THE AMOUNT OF $2,143.36 TO THE CITY OF GREELEY POLICE DEPARTMENT TO
BE USED FOR LAW ENFORCEMENT PURPOSES.
WHEREAS,the Weld County Task Force Control Board is established to oversee the
operations of the Weld County Task Force; and
WHEREAS,the Weld County Task Force Control Board has the authority to purchase or
lease equipment,machinery, and property to achieve the purposes of the Task Force; and
WHEREAS,the Weld County Task Force Control Board has the authority to enter into
contracts; and
WHEREAS, all assets forfeitures or property accumulated by the Weld County Task Force
remains under the authority of the WCTF Control Board for disbursement in accordance with
grant provisions and state statutes; and
WHEREAS,the Weld County Task Force Control Board bylaws state under the Powers of
the Board,the Control Board shall act as the Control Board for any participating agency that is
the recipient of forfeiture funds through their participation as the initiating agency in a drug
enforcement activity with the Weld County Drug Task Force, and the Control Board shall
disburse such forfeiture funds or property to the involved participating agency once compliance
with U.S. Department of Justice guidelines is met; and
WHEREAS, in the best interest of the citizens of Weld County and the City of Greeley,the
WCTF Control Board at the regularly scheduled meeting of / /2013, authorized
the transfer of equitable sharing funds in the amount of$2,143.36; and
WHEREAS, such funds may not be used to supplant existing budgeted funds in the
receiving agency's current fiscal year budget/s as per the Equitable Sharing Agreement, the
receiving entity must use the additional funding for law enforcement expenditures;
Now,therefore, be it resolved that the Weld County Task Force Control Board approves and
recommends to the Weld County Task Force Committee the transfer of$2,143.36 to the City of
Greeley Police Department:

SUBJECT: Resolution for Equitable Sharing
Consistent with the long term policy of the weld County Drug Task Force Control Board concerning
monies seized by local jurisdictions without the aid of WCDTF and the returning of these forfeited
monies to the seizing local agencies,the Greeley Police Department is requesting the approval of the
attached resolution requesting that$2,143.36 be approved and recommended to the weld County Task
Force Committee.The amount of$2,143.36 represents the local agency share of a seizure conducted by
the Greeley Police Gang Unit. The facts of the seizure are as follows:
Greeley Police Department case#10-13454: During the summer months of 2010, the Gang Unit in
conjunction with ATF Raid Unit were working a complex investigation involving the South Side Hood
Gang and narcotics distribution. During this investigation Gang Unit investigators conducted traffic stop
on tracked gang member. During the stop one of the vehicle occupants was arrested on a pending fraud
case. The driver attempted to dispose of 6.4 grams of crystal methamphetamine which was observed by
officers. During the driver's pat down $2,798.00 was located on the drier. Subsequently a Greeley
police Department K-9 alerted on the cash taken from the driver.These monies were processed as a
federal seizure and the local agency share is$2,143.36. The preceding amount has been submitted to
the WCDTF equitable sharing fund. It is requested that these forfeited monies be returned to the
Greeley Police Department to support law enforcement operations.
