RE: APPROVAL OF RECORDED EXEMPTION NO. 427 - CATHERINE BENSON.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 26th day of December, 1979 in the Chambers of the Board
of County Commissioners of Weld County, Coloradd, the the divi-
sion into two parcels of land, as shown on the plat known as
Recorded Exemption No. 427 , being the property of Catherine
Benson, described as part of the Northwest Quarter of Section
8 , Township 7 North, Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows :
All that part of the Northwest Quarter
of Section 8 , Township 7 North, Range 66
West of the 6th P.M. , Weld County, Colo-
rado, lying East of that parcel described
in Book 640, Reception No. 1561646, Weld
County Records .
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not with
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from
the definitions of "subdivision" and "subdivided land" pursuant
to its authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and Section 2-1 A (3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Catherine Benson be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-
101 (10) (d) , CRS 1973, as amended.

Dear Commissioners :
The attached application, plat , and related items are in reference
to a request from Catherine Benson for a recorded exemption. The
parcel of land on which this request has been made is described as
Pt . NWl Section 8, T7N, R66W of the 6th P.M. , Weld County, Colorado.
This property is located 4 miles west and 1 mile north of Ault . The
property contains approximately 146.4 acres of Class II , III and IV
irrigated soils. The request is to split the property into parcels
of 13.4 acres and 133 acres.
Mrs. Benson wishes to convey the smaller parcel to her son for the
purpose of operating a dairy facility and building a residence . Dale
and Dee Benson have applied for a special use permit on the dairy
which will go before the Planning Commission on November 6, 1979.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the
request be approved for the following reasons:
1. The request conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations, the intent clause of the Agricultural Zone District
(Section 3 . 3 A. of the Weld County Zoning Resolution) and the
Weld County Comprehensive Plan in that the uses will be compati-
ble with the surrounding agricultural uses. The request will
allow agricultural and related uses to be the predominant land
uses. The 14 acre -tract will be used for a dairy operation.

2. This request complies with the provisions of Section 9-4 A of
the Weld County Subdivision Regulations.

Upon the death of my husband Fels this past June, I am
requesting a recorded exemption so that I may sell about 14
acres to my son. Wishing to keep the operation in the family
I would like for him to continue farming the place. At the
present time he is in the dairy business at Fort Collins.
I do not wish to be involved in the management, operation or
financing of the dairy, thus a recorded exemption will be nec-
essary for him to build facilities for that purpose.
For these reasons, a favorable decision to grant the
recorded exemption will be .gratsfully appreciated.
