I RE: SUBDIVISION EXEMPTION NO. 46 - EXEMPTION OF LAND FROM THE
to DEFINITION OF "SUBDIVISION" AND "SUBDIVIDED LAND" .
,43 WHEREAS, the Board of County Commissioners of Weld County,

ri Rule Charter, is vested with the authority of administering the
• affairs of Weld County, Colorado, and
`i WHEREAS, the Board of County Commissioners of Weld County,

on► Colorado, has reviewed the request of Richard J. Smith, for an

exemption of land from the definition of "subdivision" and
t "subdivided land" in Section 30-28-101 (10) , CRS 1973, as amended,
fill' and Section 2-1 of the Weld County Subdivision Regulations, and

WHEREAS, the Board of County Commissioners finds that
Richard J. Smith is the owner of the following described real
estate, to-wit:
A tract of land located in the Northwest Quarter
(NW') of Section 32, Township 7 North, Range 65 West
of the Sixth Principal Meridian, Weld County,
Colorado and being more particularly described as
follows: Commencing at the Northwest Corner (NW Cor)
of said Section 32 and considering the North line of
said Section 32 to bear South 87°57 ' 00" East and with
all bearing herein being relative thereto;
Thence South 87°57 ' 00" East along the North line of
said Section 32 , 919. 17 feet; Thence along the
easterly Right-of-Way line of a 30 foot wide access
road by the following three (3) bearings and distances;
South 11°35 ' 00 ' East, 141. 61 feet;
South 30°01' 00" East 297. 71 feet;
South 46°47' 00" East, 17. 61 feet to the True Point
of Beginning;
Thence North 59°59 ' 00" East, 239. 92 feet;
Thence South 52°01' 30" East, 141. 92 feet; Thence
South 37°58 ' 30" West, 234. 38 feet;
Thence North 52°01 ' 30" West, 101. 68 feet;
Thence North 46°47 ' 00" West, 130. 70 feet to the
True Point of Beginning. Together with an easement
for access to said tract approximately 30 feet in
width and as appears on a plat of a survey made
November 18, 1971 and as extends northwesterly to
the County Road, and
desires to add to the above described tract of land, an additional
1. 32 acres of land which will result in a single lot bearing the
following legal description, to-wit:

Said tract of land contains 2.32 acres, more or
less, and is subject to any rights-of-way or other
easements as granted or reserved by instruments of
record or as nag existing on said tract of land.
WHEREAS, the Board of County Commissioners finds that the
expansion of the original lot owned by the applicant, Richard
J. Smith, does not conflict with the intent of the Weld County
Comprehensive Plan, and will not have an adverse impact on the
existing use of the land, and
WHEREAS, the Board of County Commissioners has considered
the recommendations of the Department of Planning Services on
this matter and has reviewed information submitted by the
applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the 2. 32 acre tract
of land owned by the applicant, Richard J. Smith, as described
above, be and hereby is declared to be exempt from the defi-
nition of "subdivision" and "subdivided land" as set forth
in Section 30-28-101 (10) , CRS 1973, as amended, and in Section
2-1 of the Weld County Subdivision Regulations, and further
finds that said 2. 32 acre tract shall be considered a single lot.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 1st day of
June, A.D. , 1977.
