RE: APPROVE REQUEST TO ACKNOWLEDGE RECEIPT OF 30-DAY MINERAL OWNER
NOTIFICATION FOR PROPOSED HORIZONTAL DRILLING, AND AUTHORIZE
CHAIR TO SIGN - HINER 36C-24W, NE1/4 NE1/4, S36, T6N, R66W
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Petroleum Field Services, 1145 Bannock Street, Denver, CO 80204, has
requested an acknowledgement of receipt of 30-Day Mineral Owner Notification regarding
Colorado Oil and Gas Conservation Commission (COGCC) Rule 318A.a(4)D for the following
described mineral acres:
Hiner 36C-24W Well, NE1/4 NE1/4 of Section 36,
Township 6 North, Range 66 West of the 6th P.M.,
Weld County, Colorado:
WHEREAS, the Board received a 30-Day Mineral Owner Notification regarding COGCC
Rule 318A.a(4)D for acknowledgement, and
WHEREAS, the Board has concerns the company does not have a Small Tract Oil and
Gas Lease with the County for said parcel and request the company to enter into a Small Tract
Oil Lease.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Petroleum Field Services for acknowledgement of
receipt of the 30-Day Mineral Owner Notification regarding COGCC Rule 318A.a(4)D for the
Hiner 36C-24W Well, be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that Petroleum Field Services is requested
to enter into a Small Tract Oil and Gas Lease on said parcel.
BE IT FURTHER RESOLVED by the Board that the Chair, be, and hereby is, authorized
to sign said acknowledgement of receipt of COGCC Rule 318A.a(4)D.

Ladies and Gentlemen:
Extraction Oil &Gas (Extraction) is planning to drill and operate the above referenced east-west
trending horizontal well in accordance with the provisions set forth in COGCC Rule 318A.a(4)D. Enclosed
for your reference is a Well Location Certificate plat representing this proposal.
o Wellbore Spacing Unit:The wellbore spacing unit will be comprised of the S/2 N/2 and the N/2 S/2
Section 36,Township 6 North, Range 66 West, as depicted on the enclosed Proposed Wellbore
Spacing Unit plat.The proposed spacing unit creates a 320-acre wellbore spacing unit and it appears
you are a mineral interest owner in the proposed spacing unit for this well.
o Target Formation(s).:The Codell is the proposed target formation.
o Surface Hole Location (SHL)and Bottom Hole Location (BHL):
SHL= 1044' FNL, 901' FEL, BHL=2677' FNL,460' FWL,Section 36-T6N-R66W.
o Anticipated Spud Date:Approximately May 1, 2014, depending on rig availability.
o Description of Wellbore Orientation: Extraction's proposed Hiner 36C-24W horizontal wellbore
path originates at 2648' FNL,460' FEL and ends at 2677' FNL,460' FWL,Section 36-T6N-R66W.

It is now my turn to apologize for my delayed response. We have been reviewing the requirements or the small
tract lease and noticed that Weld County's leasing policy has changed. When we obtained a lease from Weld
County last February, the royalty was at 20%. The new leasing policy has the royalty as 25%. Is this the case for
all leases now? With the amount of net acreage at stake, we are not prepared to pay a 25%royalty.

and the acreage for the tract in Section 36 is 2.093664 net and gross. Please see the legal descriptions and
