This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 19 is an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The applicant shall delineate or dedicate an additional 40-foot of right-of-way parallel to the CR 19 right-of-way for full build-out. REQUIREMENTS: Site Plan: Show CR 19 as an arterial road, which requires a 140-foot right-of-way at full build-out. Show 30 feet existing and 40 feet future right-of-way from center line (section line) on plat drawing. Show asphalt area and recycle base locations and label. Show WQCV, cubic feet volume on plat. Show 45'-60'adequate turning radius and tie into CR 19 at the same grade. Weld County Road Access Permit Form: Show the approved access on the plat and label it with the approved access permit number (AP14-00278). Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code Traffic: 1-3 people will be using the site daily with 10-15 people once a month for a safety meeting. Three (3) semi trucks, 2-3 pickups, and up to 5 excavating equipment vehicles will be on site at any given time. No number of vehicles was given on future RV/Storage site. There is no staging or parking of vehicles on CR 19. Utilize on- site parking. There will be up to 3 employees at the site daily and up to 15 people once a month for meetings. No information was provided regarding the number of people associated with the RV storage. The property will be served by a commercial well. The submittal included an application for a new residential well. This well shall be repermitted to allow for commercial uses if the applicant is planning to use it for the business. A commercial septic system will be designed for the site. No information was provided regarding if a dump station would be installed for the RV storage. The dust abatement plan indicates recycled asphalt road base and native vegetation will be utilized. The waste handling plan indicates that Republic Services will provide trash removal. Used oil and other vehicle fluids generated from vehicle maintenance are recycled but the name of the recycler was not provided. The recycling/disposal of tires, batteries and other scrap parts were not addressed. If vehicle and equipment washing occurs onsite, the wash water discharge must also be contained for proper offsite disposal. If there will be fuel tanks onsite they must have secondary containment in case of a spill. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: Prior to recording the plat: 1. The applicant shall submit written evidence of a commercial well to the Department of Planning Services and the Department of Public Health and Environment. 2. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1. A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2. A list of the type and volume of chemicals expected to be stored on site. 3.The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 2 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Sewage disposal shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. The facility shall utilize the private water supply. (private well) 9. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 10. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 11.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 3 WELD COUNTY Planning Department Concerning USR14-0045 and the New Brantner Extension Ditch Easement The New Brantner Extension ditch has a prescriptive easement,40 feet wide either direction from the centerline of the ditch (total of 80 feet),to run water and maintain the ditch for the stockholders of the company.This ditch borders or may be partially inside the property in question. The company requires that no above or below ground structures or improvements of any kind be placed on our easement that may restrict our right to maintain either side of the ditch without prior board approval. In addition,the company does not permit any non-historic storm flows anywhere along the length of the ditch.The application indicates that the normal drainage on the property sheet flows into the ditch.This statement is inaccurate. The ditch has a berm along its western side the entire length of this property and no historical storm flows have entered the ditch. Even in last September's historic storm event, no storm water went into the ditch at this location, but rather formed a pond above the ditch berm and radiated out into the field. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The application is for a Site Specific Development Plan and Use by Special Review Permit for a trucking and truck repair company, Kneebone Excavating and Trucking Company. The Applicant is proposing to use the site to build a shop, stage business vehicles and equipment, store RVs and other recreational vehicles and potentially build a residence. Application materials indicate that potential water uses include sanitary facilities in the shop,the irrigation of vegetation, temporary dust control, and residential uses. The application materials include a well permit application to construct a new well for use inside a residence dated March 28, 2014. The proposed depth of the well was not provided. This office has no record of receiving an application for Randy Kneebone nor does this office have record of issuing any well permit for this property. It appears that the property may be eligible for an exempt well permit to construct a well for drinking and sanitary purposes inside a commercial building into either the Lower Arapahoe or Laramie-Fox Hills aquifer. However, such permits do not allow for the use of water for any outdoor purposes, including irrigation and dust control, and have limited potential to provide residential water supply. Since exempt commercial well permits are issued as the only well on a parcel, the property would need to be divided prior to this office being able to consider issuing an exempt well permit to construct a second well on the site for the residential uses. If the Applicant desires to use a single well for the commercial business, landscaping at the commercial business and a residence and dust control, a non-exempt permit would be required. An initial review indicates there may be enough water in the Laramie-Fox Hills aquifer to provide all of the requested uses through a non-exempt permit. The Applicant should be aware that any water used for dust-suppression purposes needs to be acquired from a legally available source.
