HomeMy WebLinkAbout20143545.tiff RESOLUTION RE: APPROVE EASEMENT AGREEMENT FOR WATER PIPELINE AND AUTHORIZE CHAIR TO SIGN -CENTRAL WELD COUNTY WATER DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Easement Agreement for Water Pipeline between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Central Weld County Water District, commencing upon full execution, with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Easement Agreement for Water Pipeline between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Central Weld County Water District, be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. M\Fnncic\AGENDA memos\Agendanikeeedell-1.docx 2014-3545 BOARD OF COUNTY COMMISSIONERS REVIEW/WORK SESSION REQUEST RE: Bridge 42/29A Replacement—CWCWD Relocation and Easement Agreements DEPARTMENT: PUBLIC WORKS DATE: 10/23/2014 PERSON(S) REQUESTING: Don Dunker(County Engineer) and Michael Bedell (Senior Engineer) Brief description of the problem/issue: The Bridge 42/29A Replacement and intersection realignment is planned for construction this winter. Part of the work entails Central Weld County Water District (CWCWD) relocating portions of their potable waterline. CWCWD will be using their own funds to complete this work since their facilities are located within County right-of-way. To protect both parties (Weld County and CWCWD) interests, a formal Relocation Agreement has been developed by the County Attorney Office. In addition, the County has agreed to grant CWCWD a utility easement across a portion of property which was acquired for the project and will eventually become property owned by the Farmers Independent Ditch Company (FIDCO). This easement document will give CWCWD the legal rights to have their new potable water line placed across land which will be owned by FIDCO after the project is completed. What options exist for the Board: The Board can choose to approve the attached CWCWD Relocation Agreement and Easement Agreement, or choose to amend or reject the proposed Agreements. Recommendation to the Board: Public Works recommends approval of the CWCWD Agreements. If recommended, Public Works will try to get this item put on the next available BOCC meeting agenda. EASEMENT AGREEMENT FOR WATER PIPELINE THIS EASEMENT AGREEMENT,made this /2 day of/ t1 OjQnfr ,2014,between by and between the COUNTY OF WELD, a body corporate and politic of the State of Colorado, by and through its Board of County Commissioners, whose legal address is 1150"O"Street,Greeley, Colorado 80631 hereinafter referred to as"Grantor"and CENTRAL WELD COUNTY WATER DISTRICT,a statutory special district and quasi-municipal corporation formed under the laws of the State of Colorado, located at 2235 2nd Avenue,Greeley,Colorado 80631,hereinafter referred to as "Grantee": Pursuant to the"Agreement for Relocation of Potable Water Facilities between Central Weld County Water District and Weld County, Colorado," ("Agreement") dated October 1, 2014 (the "Agreement"),Grantor agreed to and does hereby grant, sell, convey and transfer unto Grantee and Grantees' successors,and assigns, a perpetual easement to construct, reconstruct, inspect, upgrade, increase line size or capacity, operate, repair, maintain, replace, remove and operate one or more lines for the transmission, distribution and service of water, and all underground and service appurtenances thereto, including metering stations, vaults, enclosures, identification signs, communication lines and other fixtures,over, across, under and upon the following described land (hereinafter referred to as the"Easement"),situate, lying,and being in the County of Weld,and State of Colorado, and described as follows: See attached"Exhibit A" and "Exhibit B" (map), both of which are attached hereto and by this reference are incorporated herein and made a part hereof. Grantee is granted the following rights and terms and conditions: A. Grantee has the right,from November I,2014 through March 1,2015,to temporarily use a twenty foot wide strip outside each boundary of the Easement for purposes of the construction of its Facilities described in the Agreement. B. Grantee will at all times maintain the Facilities and repair the Facilities at its own expense. C. If the Facilities cause any material settling in the ditch embankments, the roads thereon, or any part of the ditch, Grantee will, upon notification from Grantor, make all repairs required at Grantee's expense. D. Prior to the commencement of any non-emergency repairs on the Facilities under the FIDCO ditch,Grantee agrees to notify FIDCO,and further agrees that in the event of an emergency, if possible, Grantee shall first notify FIDCO of the need to repair the Facilities. The Easement shall inure to the benefit of Grantee's successors and assigns. F. Grantee's use of the Easement shall be exclusive to Grantee,except for that portion of the surface estate that may be needed for use by FIDCO for proper operation,maintenance and repair of the ditch. The mineral estate under said property, including oil,gas and any and all other minerals and all water rights currently attached to or associated with the Easement are hereby specifically reserved pursuant to prior reservations.
