HomeMy WebLinkAbout20141147.tiff RESOLUTION RE: AUTHORIZE FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST ANDREW JAY HOP AND THE PAULA LEE HOP EXEMPTION TRUST WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County is in need of acquiring additional right-of-way for the extension of County Road 49, in a portion of Sections 13 and 18, Township 5 North, Range 65 West of the 6th P.M., Weld County, Colorado, including a temporary construction easement, and WHEREAS, said right-of-way is described and shown in the attached Exhibit "A" and consists of 7.18 acres, more or less, and WHEREAS, said temporary construction easement is described in the attached Exhibit "B" and shown in the attached Exhibit Map "B," and consists of 2.78 acres, more or less, and WHEREAS, in an appraisal with a date of valuation being July 30, 2013, prepared by Sue Anne Foster of Foster Valuation Company, LLC, a Certified Appraiser, the value of the right-of-way to be acquired is established at $57,300.00, and the value of the temporary construction easement is $2,780.00, and the costs of damages is $31,110.00, for a total of $91,190.00 and WHEREAS, said property for the right-of-way and temporary construction easement are owned by Andrew Jay Hop and the Paula Lee Hop Exemption Trust (hereinafter referred collectively as "Hop Farms"), and WHEREAS, negotiations with Hop Farms have included several verbal communications (in person and by phone) between Leon Sievers of the Weld County Department of Public Works and Andrew Jay Hop and attorney Kenneth Lind, and several written communications, including the following: "Notice of Interest to Acquire" Letters dated February 22, 2013, March 5, 2013, and May 9, 2013; "Offer Letter" dated August 19, 2013; "Counteroffer Letter" dated December 11, 2013; and "Final Offer Letter" dated March 18, 2014, and WHEREAS,to date, the parties have been unable to reach an agreement for the purchase of said right-of-way and temporary construction easement, and CC : C#rl6C) ,Ti2-0-F) Pw(O..s,Jrn) 4 /6.4 2014-1147 BC0046 FILING OF PROCEEDINGS IN EMINENT DOMAIN, PURSUANT TO SECTION 38-1-101, C.R.S., AGAINST ANDREW JAY HOP AND THE PAULA LEE HOP EXEMPTION TRUST PAGE 2 WHEREAS, the acquisition of said right-of-way and temporary construction easement, is necessary because of the pending extension of County Road 49. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Weld County Attorney be, and hereby is, authorized to file a proceeding in eminent domain, pursuant to Section 38-1-101 et. seq., C.R.S., against Andrew Jay Hop and the Paula Lee Hop Exemption Trust, in the Weld District Court to acquire the right-of-way described and shown in the attached Exhibit "A" and the temporary construction easement as described and shown in the attached Exhibit "B". BE IT FURTHER RESOLVED by the Board that the acquisition of such right-of-way and temporary construction easement is deemed necessary for the health, safety and welfare of the citizens of Weld County, Colorado. BE IT FURTHER RESOLVED by the Board that the Controller shall cause to be paid $91,190.00 into the Registry of the Court for the purpose of acquiring the aforementioned property, as required by law, or if in conjunction with a joint and stipulated motion for immediate possession, payment may be made to Andrew Jay Hop (50%) and the Paula Lee Hop Exemption Trust (50%) as an alternative to depositing such sums into the Registry of the Court. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 9th day of April, A.D., 2014.
