RE: APPROVAL OF RECORDED EXEMPTION NO. 402 - DENVER METRO-
POLITAN TRAP AND SKEET CLUB.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 9th day of July, 1979 in the Chambers of the Board of County
Commissioners of Weld County, Colorado, that the division into
two parcels of land, as shown on the plat known as Recorded
Exemption No. 402 , being the property of Denver Metropolitan
Trap and Skeet Club, described as Part of the South Half of the
Southeast Quarter of Section 32 , Township 1 North, Range 68
West of the 6th P.M. , Weld County, Colorado, being more parti-
cularly described as follows :
A part of the South Half of the Southeast
Quarter of Section 32 , Township 1 North,
Range 68 West of the 6th P.M. , Weld County,
Colorado, more particularly described as
follows :
Beginning at a point on the East line of
said Section 32 , from whence the Southeast
corner of said Section 32 bears South
00°35 ' East, 75. 00 feet; Thence North
90°00 ' West, parallel to (and 75 feet North
of) the South line of the said South Half
of the Southeast Quarter, 2642 .67 feet to
a point on the West line of the said North
Half of the Southeast Quarter from whence
the South Quarter corner of said Section 32

does not come within the purview of the definition of the
terms, "subdivision" and "subdivided land" , pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and

WHEREAS , the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of
land from the definitions of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and Section 2-lA(3) of the Weld County Subdi-
vision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Denver Metropolitan Trap and Skeet Club
be, and hereby is, exempt from the definition of the terms "sub-
division" and "subdivided land" pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973 , as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 9th day of
July, A.D. , 1979.

Dear Commissioners :
The attached letter and related materials are in reference to a request
for a recorded exemption from Denver Metropolitan Trap and Skeet Club.
The property on which this request has been made is described as Pt .
3; SE4, Section 32 , TIN, R68W of the 6th p.m. , Weld County, Colorado.
This property is located one mile east of Erie Air Park (Town of Erie) .
The property contains approximately 75 . 21 acres of Class IV and VI non-
irrigated soils. The request is to split the property into parcels of
approximately 8 . 55 acres and 66 .66 acres. The Denver Metropolitan Trap and
Skeet Club wish to sell the 8. 55 acres to American Sportsman Enterprises
who will continue to operate the rifle range on the property.
On June 11 , 1979 the Board of County Commissioners approved a request
from the Denver Metropolitan Trap and Skeet Club for a lot size variance
so that they could make application for this recorded exemption. At the
time they made the decision on that request, the Department of Planning
Services submitted a letter of recommendation for approval to the Board.
A copy of that letter of recommendation is included in the attached
materials . Nothing has been received by our office that would change our
recommendation for approval of this request as outlined in the letter to
the Board of County Commissioners dated June 11, 1979.

Dear Commissioners:
The attached letter and related materials are in reference to a re-
quest for a lot size variance from Denver Metropolitan Trap and
Skeet Club. The property on which this request has been made is
described as Pt . SISE* Section 32, T1N, R68W of the 6th P. M. , Weld
County, Colorado. This property is located one mile east of Erie
Air Park (Town of Erie) . The property contains approximately 75. 21
acres of Class IV and VI non-irrigated soils. The request is to
obtain a variance from the minimum lot size requirement, Section
9-4A. (6) of the Weld County Subdivision Regulations, so that they
may make application for a recorded exemption.
If this lot size variance is granted, the Denver Metropolitan Trap
and Skeet Club will proceed with their application for a recorded
exemption to divide the parcel into two parcels of approximately
8. 55 acres and 66. 66 acres. The Denver Metropolitan Trap and Skeet
Club wish to sell the 8. 55 acres to American Sportsman Enterprises
who will continue to operate the rifle range on the property.
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1. The proposed split conforms with Section 9. 2 of the Weld County
Subdivision Regulations (intent clause of the recorded exemption
procedure) , Section 3. 3 A. of the Weld County Zoning Resolution
(intent clause of the Agricultural Zone District) , and the Weld
County Comprehensive Plan in that the use will be compatible
with surrounding agricultural uses. There will be no reduction
in the amount of land currently being used for agricultural
production.

2. The Town of Erie has no objections to this request .
3. The request complies with Section 9-4 A. (6) of the Weld County
Subdivision Regulations because in the opinion of the Department
of Planning Services Staff the applicant has shown good cause
for the variance.

Gentlemen:
Enclosed with this letter are the following:
1 ) Application for Recorded Exemption
2) Plat (on mylar in ink) prepared by William J. Stengel , a registered
land surveyor, plus two photocopies of same
3) Legal description of the total ownership prepared and certified by
William J. Stengel , plus two copies of same
4) A copy of a current commitment for title insurance showing the
property to be in the name of The Denver Metropolitan Trap and Skeet
Club
The following is an explanation of the reason for the request for a recorded
exemption.
The Denver Metropolitan Trap and Skeet Club has owned the subject property
since moving from the Sloans Lake area of Denver in the late 1960's. Prior
to that time the subject property was operated as a franchised Winchester
Shooting Range. The Club has continued to operate a trap, skeet and outdoor
rifle shooting facility on the property and the property is zoned accordingly.
A parcel of land of approximately 8. 55 acres is under contract for sale to
American Sportsman Enterprises who will continue to operate the rifle range
on the property. The request for a recorded exemption is in order to effect
that sale.
The Club has a large club house located on the parcel to be retained by the
Club (Parcel A). There are not now or have there ever been any improvements
on the rifle range (Parcel B) and none are anticipated in the immediate
future. Because of the proximity of the rifle range to clubhouse it is not
likely that any improvements will ever be needed on the rifle range. In the

unlikely event that permanent improvements were built on the rifle range
and further that these improvements would have need for water and a well
permit were not available, then it has been agreed that American
Sportsman Enterprises would have the right to use water from the existing
well at the Clubhouse facility.
At present the Club has a municipal well under permit R10675F registered
with the State Ground Water Commission with the right to withdraw
approximately 25 em. Prior to submitting this application the matter was
reviewed with George Van Slyke of the State Ground Water Commission.
To summarize the water situation it does not appear likely that water will
ever be needed on the rifle range property, however if it is and no other
source is available, the existing well on the Club property would be
used.

favorable approval on this application.
