HomeMy WebLinkAbout20142462.tiff HEARING CERTIFICATION DOCKET NO. 2014-56 RE: CHANGE OF ZONE, COZ14-0003, FROM THE A (AGRICULTURAL) ZONE DISTRICT TO THE 1-3 (INDUSTRIAL) ZONE DISTRICT - BIG THOMPSON INVESTMENTS HOLDINGS, LLC A public hearing was conducted on August 13, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Jennifer Petrik Health Department representative, Lauren Light The following business was transacted: Ei I hereby certify that pursuant to a notice dated June 27, 2014, and duly published July 2, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Big Thompson Investments Holdings, LLC, for a Change of Zone, COZ14-0003, from the A (Agricultural) Zone District to the 1-3 (Industrial) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Gathman showed the site, which is surrounded on three sides by the Union Colony Industrial Park Planned Unit Development and the property to the south is in the process of annexing to the City of Greeley, also for Industrial Use. The lot is 4.32 acres, and there is an existing family residence and outbuildings on the parcel. The property would be annexed to the City of Greeley by no later than March 1, 2016, and is part of the Airport Overlay District. The residence will be converted to an industrial use or removed. He showed images of the site. E Jennifer Petrik, Department of Public Works, provided a brief overview of the transportation plans and requirements. No access permit is required at this time, this site is adjacent to County Road (CR) 62, and an improvements agreement may be required in the future, as well as other items. She also has a suggestion from the Planning Commission for alteration to Condition of Approval #3.G. The City of Greeley will provide water when the business is located on the site. She noted that some items weren't carried over from the Planning Commission into the Resolution, and those are in the minutes. Condition of Approval #3.L was deleted and #3.M was modified to delete the following: "creates more than a 25-acre contiguous disturbance or". 'ii Tim Naylor, AGPROfessionals, LLC, representing the applicant, discussed the annexation process. This property would be a donut in that zone, so it makes sense to have it changed at this time. There is an existing pre-annexation agreement, and that will be addressed September 2, 2014, at the Greeley City Council Hearing. IE Chair Rademacher opened the floor for public comment. Gary Cyr, Director of the Greeley-Weld County Airport, stated concern pertaining to the vertical height of buildings on the properties to the east of the airport. He stated the applicants have indicated their willingness to acquiesce to necessary limits, therefore, there would be no impact to aviation activities. El Mr. Naylor addressed Condition of Approval #1.B, pertaining to the concerns of the airport, that the height of buildings in that area will not exceed 50 feet. He would like that Condition of Approval to be a Development Standard on the plat that this is a requirement. The Board assented to that request. El In response to Chair Rademacher, the terminology of Condition of Approval #3.G was changed from "shall" to "may." Condition of Approval #3.L was deleted, and #3.M was changed, by assent of the Board. Mr. Naylor requested #3.C be changed to "may be required to", as it was changed at the Planning Commission Hearing. He also requested that Condition of Approval #3.1, regarding a Master Drainage Report, be modified with the word "if". These were done by assent of the Board. In response to Chair Rademacher, Mr. Naylor indicated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. Ei Mr. Gathman stated that the new Condition of Approval #3.S should read, "Any future structures built on the site shall not exceed 50 feet above ground level." Ei Commissioner Conway moved to approve the request of Big Thompson Investments Holdings, LLC, for a Change of Zone, COZ14-0003, from the A (Agricultural) Zone District to the 1-3 (Industrial) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval as amended and entered into the record. The motion was seconded by Commissioner Garcia, and it carried unanimously.
