This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all inclusive; as other issues may arise during the remaining application process. COMMENTS: CR 89 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Section Line: CR 118 (30' right-of-way in Section 17) REQUIREMENTS: Site Plan: Standard tracking control for access onto gravel roads includes double cattle guards across both lanes at the access point. Access Permit Application Form: The applicant has supplied this form identifying that a 15" pipe (CMP), if needed, shall be placed at the entrance as a part of the tracking pad with double cattle guards across both lanes of the entrance. Pictures at the proposed entrance have been supplied as a part of the application. Our Traffic Engineer Division will evaluate the Access Permit Application and accompanying documents. The fee is $75.00 (small commercial) for your new access permit. Show the approved access on the plat and label it with the approved access permit number (AP#). Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code. Traffic Narrative: The water transport trucks will visit the site for up to 30 round trips per day. Initially, traffic to and from the site is expected to go south along CR 89 to CR 110. No residences exist between the access and CR 110. Trucks are expected to turn east 95% of the time, and west 5% of the time. The Planning /Engineering Division will review and comment regarding the water load-out site. Improvements and Road Maintenance Agreement: This document is required for this site. Road maintenance including dust control, damage repair, and triggers for improvement will be included. The application included a well permit which will provide water to the water depot. Well permit 77821-F is permitted for industrial, commercial, dust abatement purposes and several other uses. The application states up to 30 trucks per day could utilize the site. The following section is from Environmental Health Services, Weld County Department of Public Health & Environment, Septic Policies. 2.2.K Use of portable toilets and bottled water (revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Portable toilets and bottled water from a commercial source are allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Note: Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. As indicated above, it is the policy of this Department that portable toilets are allowed when employees or contractors are on site for less than 2 consecutive hours a day. As personnel will be on site for a short duration, in accordance with Environmental Health Services policy the use of portable toilets is allowed. Dust abatement will consist of tracking pads at the entrance, drives will be constructed of road base and if necessary water will be utilized to control dust. The application states that no waste containers will be supplied and drivers will be expected to take trash with them. A sign should be posted indicating no trash shall be left on the site. We have no objections to the proposal; however, we do recommend that the following condition be part of any approval: We recommend that the following requirement be met prior to operation: 1. A sign shall be posted stating: No disposal of wastes is allowed. We recommend the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 2 6. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As employees or contractors are on site for less than 2 consecutive hours a day portable toilets are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7. The fresh water storage and loading system shall be operated in a manner to minimize spills. Fresh water spills should be captured in above-ground containment areas for reuse or allowed to infiltrate. There shall be no discharge from this process to surface waters or through the facility's stormwater management system, in accordance with the Rules and Regulations of the Colorado Water Quality Control Commission, and the Environmental Protection Agency. 8. Adding another large facility adds to those concerns. The other major factor is the the amount of traffic we have through Grover and the stress it is puts on our roads, which are already failing, and with the loss of revenue from water sales we have no means to repair them. Water Division 8, Water District 1 Lost Creek Designated Basin Dear Mr. Gathman: This referral does not appear to qualify as a "subdivision" as defined in Section 30- 28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The applicant's proposed use is a water load-out facility on a 10-acre Lot. According to the application, the water will be used by the local oil and gas industry and will be piped to the load-out facility from wells drilled on the Bashor properties.
