HomeMy WebLinkAbout20141339.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING CONCERNING EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on April 30, 2014, the Board was presented with a Memorandum of Understanding concerning the Edward Byrne Memorial Justice Assistance Grant (JAG) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and the City of Greeley, commencing upon full execution, with further terms and conditions being as stated in said memorandum, and whereas, the Board deemed it advisable to continue the matter to allow time for the Sheriff to submit written communication explaining his intentions for spending the funds, and WHEREAS, after review, on May 5, 2014, the Board deems it advisable to approve said memorandum, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding concerning the Edward Byrne Memorial Justice Assistance Grant (JAG) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and the City of Greeley be, and hereby is, approved. WHEREAS, the Bureau of Justice Assistance has provided joint funding that is available to both the City of Greeley and Weld County; and WHEREAS, the funding that is being provided by the Bureau of Justice Assistance is in the total amount of$64,417; and WHEREAS, the City of Greeley Police Department will be the Fiscal Agent for the grant and will initially receive the total grant award of $64,417; will remit the amount of $17,070 to Weld County as the Sheriffs Office portion of the grant award; and, will retain the amount of $47,347 as the City of Greeley Police Department's portion of the award. WHEREAS, as with previous funding, both agencies have determined that they have different needs and uses for the funds being made available; and WHEREAS, this Memorandum of Understanding provides for the division of funds being made available; and WHEREAS, the parties wish to reduce their understanding to writing. THE PARTIES HEREBY AGREE AS FOLLOWS: I) Upon receipt of the total funding amount of$64,417, the Greeley Police Department (Fiscal Agent) will pay the sum of $17,070 to the Weld County Sheriff's Office as and for the Weld County's portion of the Edward Byrne Memorial Justice Assistance Grant (JAG) formula program. 2)The remaining sum in the amount of$47,347 will be retained by the City of Greeley as and for the Greeley Police Department's portion Edward Byrne Memorial Justice Assistance Grant (JAG) formula program. 3) The financial reporting to the Bureau of Justice Assistance will be maintained by the Greeley Police Department (Fiscal Agent) with each party maintaining a financial and operational record of their respective portions of the program and in compliance with the Federal Financial Guide, the parameters of the grant and any special conditions as noted in the SOGA 2014-1339 award. The Weld County Sheriffs Office shall transmit said records to the Greeley Police Department upon request by the Department. To.= . : Board of County Commissioners via Chair of the Board ;�',, , --; �-'" � From: Sheriff John Cooke c Date: April 30, 2014 Subject: JAG Grant It came to my attention today that the Board of County Commissions refused to sign the MOU between the Greeley Police Department and the Weld County Sheriff's Office regarding the 2014 Justice Assistance Grant. The reason cited was that the board wanted to know how the Sheriff's Office was going to spend its share of the $17,000 grant before signing the MOU. I was advised that I would have to send the board an email informing the board how the grant funds will be utilized. Please consider this memo as my response to the board. I am an independent elected official; therefore the Sheriff's Office does not work for the board nor answers to it, therefore, it is none of the board's business how the Sheriff's Office would spend the $17,000 grant money. I would think the board has more important issues to concern themselves with other than attempting to micromanage the Sheriff's Office. Please don't try and use the excuse that it's a matter of accountability. As an independent elected official I'm am accountable to the citizens of Weld County for my budget, not the board. Additionally, the Federal Government has limitations and requirements regarding what an agency can purchase with the grant money. The only thing the board needs to know is that the Sheriff's Office would follow all the regulations and requirements put into place by the federal government before any of the grant funds were spent and the grant money would be spent on law enforcement equipment that is relevant to the Office. As Sheriff, I am the chief law enforcement officer of the county and as such I know how best to appropriate the federal grant money for the needs of the Sheriff's Office. The board's actions are nothing more than an attempt at controlling the Sheriff's Office, meddling into an independent elected official's business, and interfering with the normal operations of the Sheriffs Office which I will not allow to happen. I am advising the Greeley Police Chief and the City of Greeley that there is no need for an MOU and that they can apply for and keep Weld County's portion of the grant.
