RE: APPROVAL OF RECORDED EXEMPTION NO. 374 - HENRY AND SUSAN WAGNER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado at a public hearing held on
the 5th day of February, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 374, being the property of
Henry and Susan Wagner, described as the Southeast Quarter of
Section 30 and the Northeast Quarter of Section 31, Township 5
North, Range 66 West of the 6th P.M. , Weld County, Colorado, being
more particularly described as follows:
The Northeast Quarter of Section 31, and the Southeast
Quarter of Section 30 all in Township 5 North, Range 66
West of the 6th P.M. , County of Weld, State of Colorado,
except that parcel of land Wore particularly described
as follaqs:

does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the

Board desires to exempt this particular division of land from the
definition of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973, as amended,
and Section 2-lA (3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Henry and Susan Wagner be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 5th day of
February, A.D. , 1979.

RE: Subdivision Exemption #75 and
Recorded Exemption #374
Dear Commissioners :
The attached applications, plats and related items are in reference to
a request for a subdivision exemption and recorded exemption by Henry
and Susan Wagner. The property is described as the SE* Section 30 and
the NE Section 31 , T5N, R66W of the 6th P. M. , Weld County, Colorado.
This property is located 3-1/2 miles southwest of Greeley and 1-1/2
miles northeast of Milliken . The property contains approximately 316
acres of Class II , III and IV irrigated soils.
The first request is to obtain a subdivision exemption for a 5. 75 acre
parcel which contains the residence of Mr. and Mrs. Wagner ' s son and
several outbuildings and corrals. The second request is to obtain a
recorded exemption to split the property into two parcels of 14. 05
acres and 316 acres more or less. The 14. 05 acres is now in agricul-
tural production. The Wagners desire to sell the 316 acres which con-
tains their present residence and build a new house on the 14. 05 acres.
The Wagners will then retire from their farming operation.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quests be denied for the following reasons:
1 . The proposed requests do not comply with the Weld County Comprehen-
sive Plan in that it would promote non-agricultural use of agri-
cultural land and it would encourage urban encroachment on rural
land use.

2. These requests are not in conformance with the intent clause of
the Agricultural Zone District (Section 3 . 3 A. of the Weld County
Zoning Resolution) which states:
"Intent - The intent in establishing the A-Agricultural
Zone District is to allow all agricultural related use
in those areas in which agriculture is and should con-
tinue to be the predominant land use. This district is
intended to discourage encroachment of incompatible uses
upon the agricultural land in a district , to encourage
agricultural uses as the highest and best use of the
land in the district as compared with other uses in con-
flict therewith, and to provide for the orderly expansion
of urban growth in conformance with the Weld County Com-
prehensive Plan. "
These requests would not be encouraging agricultural uses as the
highest and best uses, it would not be providing for the orderly
expansion of urban growth, and it would be promoting the division
of agricultural land into smaller, less economic parcel sizes.
3. These requests are not in compliance with the intent clause of the
recorded exemption procedure (Section 9-2 of the Weld County Sub-
division Regulations) . Said clause states:
"The intent in establishing the recorded exemption pro-
cedure is to provide, in accordance with the Weld County
Comprehensive Plan, a means whereby nonproductive agri-
cultural lands may be developed for higher and more
productive uses insofar as such uses are compatible with
surrounding agricultural uses in areas where such land
divisions are proposed. (Revised 4-17-74) . "
The 14 acre parcel is productive agricultural land. By allowing
the Wagners to build their home on that parcel , the land would
essentially be removed from future agricultural production. Ad-
ditionally, there is great potential for future development of the
14 acre parcel by additional exemptions.
The Department of Planning Services Staff does not feel that the ap-
plication for a subdivision exemption and recorded exemption, in their
present form, are acceptable regarding the Weld County Comprehensive
Plan , intent clause of the Agricultural Zone District or the intent
clause of the recorded exemption procedure. The Department of Planning
Services Staff recommends that the Wagners consider other alternatives
which would not remove or present the possibility of removal of signi-
ficant amounts of agricultural land from future production. The staff
recommends that the Wagners consider a smaller parcel size and consoli-
dation of existing residences.

Should the Board approve the staff ' s recommendation, the staff feels
that an alternative course of action would be to table the recorded
exemption and subdivision exemption to allow the Wagners time to pre-
sent alternative requests to the Planning Department . This step would
save the Wagners the costs and time involved in a second set of ap-
plications.

Dear Sirs:
I have an opportunity to sell my farm. My wife and I
looked at our situation and felt that because of health
reasons and age this would be a good opportunity to be a
big boost to us and our family. It will enable us to enjoy
a better living in the days ahead. We have lived in the
neighborhood and on this farm for 24 years.

Dear County Commissioners:
This is a request for a building permit so that we may build our dream
home on part of a farm which has been in the family since the 1940's.
We are giving up farming due to our ages and health reasons. Our health
does not warrant our working at the capacity of the past years. Therefore,
production of the farm should increase with the new owners.
Our present home where we have lived for years was originally a two room
building with additions of a lean-to and then later another addition.
This building will remain with the farm so we need other living quarters.
We desire to build a custom home that will be an asset to the community and
add to the tax roll of Weld County. We have a City of Greeley water tap
for this home. We also are stockholders in the Greeley-Loveland Irrigation
Co.
As native born citizens of Weld County,this is where we desire to retire.
To wait for five years to build this home would seem like an eternity at
our ages. Perhaps , we would not live to see our goal fulfilled because of
health problems.
Another reason for our desire to build this home at this time--instead of
waiting five years--is that our daughter, Laurel , a senior in high school
plans to attend University of Northern Colorado and would like to live at
home. This would be a home that she would be proud to entertain her school
and church friends in. It would also enable her to have a place to study.
We like the location we have lived in for many years. We have desirable
neighbors who have concern for each other. We need to feel that as senior
citizens , we are still a part of the neighborhood and community even though
in a smaller manner. We would like to keep some of the land to support our
retirement. We would like to remain in the area to take advantage of
employment where we are known. We may do some custom work if health permits
and would need a place to keep machinery.
We feel to live else where in the Greeley area would be inconvenient and un-
desirable since we do have the land. Respiratory problems are less in the
country.
Our married son, Kenneth Wagner, and his family have lived on our property
since 1970. First in a mobile home, then in 1975 it was replaced with a
modular home. He farms the Knister's property across the road on 83rd Ave. Since
there are no living quarters on Knister' s property and due to the energy
crisis this arrangement is convenient for him.

The land we would like to build on is dry land and less desirable for
farming. Even if it were under a pivot sprinkler; the sprinkler would
not reach the building site.
It is our desire that you give this request your thought and consideration.

occupied by the Kenneth Wagner's was purchased in 1975
to replace a mobile home purchased and placed on my property
in 1970. The Kenneth Wagner's have used this as their
principle residence for the last eight years.
The double-wide modular home purchased in 1975 is A FACTORY BUILT
FB-3539-S Serial Numbers 9648A for one side and 96488 for the
other side, built by Girden Industries of Gehring Nebraska, and
approved by the State of Colorado Division of Housing.
