Dear Mr. Ijai.es:
Weld County is in the process of up-dating and formalizing the
maintenance agreements on County roads adjacent to towns where
we have joint jurisdiction. If we have pre-agreed zones of
responsibility, I think it will make maintenance and minor repairs
to these roads much more efficient and safer for the travelling
public.
I have enclosed a draft copy of an agreement between the County
and the Town of Evans for your consideration and approval . If
this is agreeable to the Town of Evans, it is requested that you
sign it and return it to our office and we will take it before
the Board of Commissioners for approval and signature. We would
then forward a copy to you for your files.

' CITY/COUNTY ,ROAD MAINTENANCE AGREEMENT
WHEREAS, there are cany roads throughout the County of Weld that •
traverse County and municipal boundary lines, and
WHEREAS, for those roads within the jurisdiction of the County,
the County -of Weld is responsible for maintenance thereof, and
WHEREAS, for roads within the jurisdiction boundaries of the
municipalities in the County, those municipalities are responsible for the
maintenance thereof, and
WHEREAS, it is the desire of both parties to this Agreement to
provide for a more efficient rethod of maintaining those roads that traverse
municipal and County boundary lines, and
WHEREAS, Section 29-1-201, et seq. , CRS 1973, as amended, provides
that governments may contract with one another for any function, service or
facility lawfully authorized to each of the contracting units.
NOW, THEREFORE, the City/Town of Evans
hereinafter called the "City" and County of Weld, hereinafter called "County"
agree as follows:
RECITALS
1. Term
The term of this Agreement shall run from
, and shall run from year to year unless sooner
terminated by thirty (30) days prior written notice from one
party to the other party.
2. Maintenance
The "maintenance" performed under this contract shall consist of
snow removal , pavement maintenance, culvert maintenance, cindering,
grading of gravel roads and minor bridge repairs. Major repair
items shall not be included within this Agreement, but each party
• , shall be responsible for major repair on roads within its own
}
jurisdiction. For tn:e purposes of this Agreement, major repair
shall include items such as replacement of a bridge, or the replace-
ment or overlay of p_ver.ent. Any single item estimated to cost in
excess of 5500.07 : i;l be considered, per se, a major repair item.
3. Cost Sharing - •

Where a bridce cr other major repair item is located in both
jurisdictions of the City and the County, the cost of repair
shall be shared in proportion to the portion of the item in each
party's respective jurisdiction. •

4. Maintenance Rescorsibilities of the City
The City shall :e responsible for maintenance of the following
segments of roads:
South 23rd Avenue from Greeley City Limits to 37th Street, 37th
Street from south 23rd Avenue to 17th Avenue. Larson Avenue
south of 37th Street, 42nd Street east of 17th Avenue (maintenance
only).
5. County Mainterar._e Responsiblities
The County shall be responsible for maintenance of the following
segments of road:
First Avenue between 37th Street and 31st Street. Snow removal •
on 42nd Street from U.S. 85 eastward to south 23rd Avenue
(dead end).

RE: VACATING A PORTION OF COUNTY ROAD NO, 54 BY QUITCLAIM
DEED TO THE CITY OF EVANS, A COLORADO MUNICIPAL
CORPORATION,
BE IT RESOLVED, that the Board of County Commissioners, Weld
County, Colorado, does hereby sign a quitclaim deed as requested by the
City of Evans, a Colorado Municipal Corporation, thereby vacating a portion
of County Road No. 54 and more particularly described as follows:
Description of Parcels:
Beginning at the Northwest corner of Section 30, Township
5 North, Range 65 West; thence Easterly along the North
line of Section 30 a distance of 484. 73 feet; thence due South
a distance of 30. 00 feet to the southerly R. O. W. line of
County Road 54; thence westerly along the southerly R.O. W.
line of County Road 54 a distance of 484. 73 feet; thence due
North a distance of 30. 00 feet to the point of beginning.
Also:
Beginning at the Northwest corner of Section 30; thence
easterly along the North line of Section 30 a distance of
1140. 89 feet to the true point of beginning; thence continuing
Easterly along the North line of Section 30 a distance of
1484. 53 feet to the North Quarter corner of Section 30;
thence due South a distance of 30. 00 feet to the Southerly

Enclosed herewith are two Quit Claim Deeds. One
is for the signatures of County officials and one for
your signature.
This will enable the City to take care of the
traffic problems that are being created by two entities
owning one street which is in fron of the new school
building that was erected by School District 6. Secondly,
this will enable the City of Evans to complete its
drainage project which is to run from 11th Avenue in
the City of Evans east to the river, crossing the high-
way and railroad.
We appreciate very much your cooperation, both as
an individual and as a county official. When you have
obtaining the signatures , please return the deeds to
