The uses which would be permitted can be compatible with the existing surrounding land uses which include residential, irrigated farm production, and pasture land. The property is located in the Airport Overlay District. The Development Standards address this concern. No other overlay districts affect this site. e. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application for a Site Specific Development Plan and Special Review Permit for oil and gas production facilities (four oil and gas wells and associated equipment) in the R-1 (Low Density Residential) Zone District on the hereinabove described parcel of land be, and hereby is, granted subject to the following conditions: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review plat prior to recording the plat. The plat shall be delivered to the Department of Planning Services and be ready for recording in the Weld County Clerk and Recorder's Office within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. The applicant shall agree, in writing, to develop the Use by Special Review as a high-density area as defined by Section 127 of the Colorado Code of Regulations, Rules and Regulations of the Colorado Oil and Gas Conservation Commission. 4. Road damage caused by drilling or support equipment shall be repaired within 30 days of completion of the four wells. 5. The Site Specific Development Plan and Special Review Permit is for oil and gas production facilities (four oil and gas wells and associated equipment) in the R-1 (Low Density Residential) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The property shall be maintained in compliance with the Colorado Code of Regulations, Rules and Regulations of the Colorado Oil and Gas Conservation Commission, including rules that pertain to oil and gas production in a high density residential areas. 4. The property shall be maintained in compliance with the Weld County Airport Overlay District requirements. 5. All traffic during the drilling operation shall use Weld County Road 66 and enter and exit the property to or from the east on Weld County Road 66. 6. Wellheads shall be located at least 250 feet from the nearest property line in Sonny View Estates and no less than 350 feet from the nearest dwelling. 7. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. Exploration and production waste shall be disposed of at an approved facility. 8. No permanent disposal of wastes shall be permitted at this site. 9. Fugitive dust shall be controlled on this site. 10. The maximum permissible noise level shall not exceed the residential limit of 55 dB(A), as measured according to 25-12-102, Colorado Revised Statutes, except during any operation involving the use of a drilling rig, workover rig, or fracing, as established according to Rule 803.a, State of Colorado Rules and Regulations, Rules of Practice and Procedure and Oil and Gas Conservation Act, as amended. 11. A spillage retention berm shall be installed and maintained around the tank battery. The volume retained by the spillage berm should be greater than the volume of the largest tank located inside the berm. 12. A stormwater discharge permit from the Colorado Department of Health, Water Quality Control Division, shall be obtained for all construction activities that disturb more than five (5) acres. 921175 DEVELOPMENT STANDARDS - CACHE EXPLORATION, INC. PAGE 2 13. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 14. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance. 15. The property owner or operator shall be responsible for complying with the Operation Standards of Section 24.6 of the Weld County Zoning Ordinance. 16. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated herein and all applicable Weld County Regulations. 17. The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 18. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. 921175 Hello
