HomeMy WebLinkAbout20140996.tiff HEARING CERTIFICATION DOCKET NO. 2014-24 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0017, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES, INCLUDING AN OIL AND GAS SUPPORT FACILITY (CLASS II OILFIELD WASTE DISPOSAL FACILITY - SALTWATER INJECTION FACILITY) IN THE A (AGRICULTURAL) ZONE DISTRICT- KONIG LAND AND CATTLE, LLC, AND LOYD FARMS A public hearing was conducted on April 2, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated February 14, 2014, and duly published February 19, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Konig Land and Cattle, LLC, and Loyd Farms, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0017, for Mineral Resource Development Facilities, including an Oil and Gas Support Facility (Class II Oilfield Waste Disposal Facility - saltwater injection facility) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He reviewed the site location, surrounding land uses (there are no residences in the general area), and said no expressions of concern were received by the Department of Planning Services. He reviewed the access/easement, and internal roads. This site will store EOG produced water only, from locations in Weld and Laramie County, WY. One employee will visit the site daily with 24/7 operations. Q Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. He reviewed the access off of CR137, west of CR 77, noting they estimate between 1-30 trucks, which is rather vague. There will be an Offsite Road Improvements Agreement for the haul route. She said an approved groundwater monitoring plan has been submitted, but is not yet approved. An air emissions permit is required. Secondary containment and leak containments systems are indicated, and the Colorado Oil and Gas Conservation Commission (COGCC) and EPA have requirements also indicated. El Paul Donavan, EOG Resources, Inc., said he had no additional information and offered to answer any questions. F No public testimony was offered concerning this matter. In response to Chair Rademacher, Mr. Donavan indicated he has no issues with the Conditions of Approval and Development Standards as they are. Commissioner Rademacher requested the deletion of the reference in Development Standard #18 to "will be 18-wheelers". Commissioner Kirkmeyer added this is just a statement as opposed to a Development Standard and should be deleted, which was done by assent of the Board. In response to Commissioner Conway, Mr. Carroll indicated he would like to retain the reference to site access being limited to non-commercial water haulers; he said he was agreeable to deletion, but was worried about the proportional sharing pertaining to the number of trucks. Commissioner Kirkmeyer reiterated her opinion that is not an actual Development Standard, but it has been stated on the record. In response to Commissioner Kirkmeyer, Ms. Barbare explained injection wells are under the purview of the COGCC for drilling applications. F Mr. Yatabe made a correction to the legal description to also include SUBX12-0023.. In response to Chair Rademacher, Mr. Donavan indicated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. El Commissioner Freeman moved to approve the request of Konig Land and Cattle, LLC, and Loyd Farms, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0017, for Mineral Resource Development Facilities, including an Oil and Gas Support Facility (Class II Oilfield Waste Disposal Facility - saltwater injection facility) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
