A public hearing was conducted on March 12, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
ID I hereby certify that pursuant to a notice dated January 30, 2014, and duly published
February 4, 2014, in the Greeley Tribune, a public hearing was conducted to consider the
request of Edward and Betty Meyer, c/o Connie Mizner, for a Site Specific Development Plan
and Use by Special Review Permit, USR13-0059, for a use similar to the Uses listed in Section
23-3-40 as Uses by Special Review (three single family residences on one parcel) as long as
the Use complies with the general intent of the A (Agricultural) Zone District. Brad Yatabe,
Assistant County Attorney, made this a matter of record.
Tiffane Johnson, Department of Planning Services, presented a brief summary of the
proposal for one existing and two new single family residences on one lot (for family members)
with a shared driveway, and entered the favorable recommendation of the Planning
Commission into the record as written. She reviewed surrounding land use, and noted that one
landowner's concerns about the proximity of the new residences to her future home were
addressed during the Planning Commission hearing. In response to Chair Rademacher, Ms.
Johnson said this is Lot A of Recorded Exemption 120.
El Chair Rademacher advised Connie Mizner and Doug Meyer that, since Commissioner
Kirkmeyer was not able to be present, they have the option of continuing this matter to a date
with the full Board present. However, if they decide to proceed today, it will require three
affirmative votes, or in the case of a tie vote, Commissioner Kirkmeyer will listen to the record
and make the determining vote. They indicated they would like to proceed.

Fl Don Carroll, Department of Public Works, provided a brief overview of the transportation
plans and requirements. The existing shared access of off CR 41 will be used.
Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions.
Fl Ms. Mizner stated this has been their family farm for 57 years; Ed and Betty Meyer are
their parents, and the two new dwellings will allow family members to be nearby caretakers of
their aging parents and still maintain a small farm. She said they have applied for a USR in
order to have flexibility to rent the houses at some time in the future. She cited the County
Code Chapter 22, "encouraging multi-generational caretaker and guest and accessory
quarters..." She noted a concerned landowner to the south was placated by information
provided at the Planning Commission meeting.
No public testimony was offered concerning this matter.
El Commissioner Kirkmeyer noted Development Standards #4, #5, #6, #7, #8 and #12 are
not applicable to residences and should be deleted; this was done by assent of the Board.
Fl In response to Chair Rademacher, Connie Mizner and Doug Meyer indicated they have
reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as
amended. Ms. Mizner and Mr. Meyer thanked Planning Services.
Commissioner Garcia moved to approve the request of Edward and Betty Meyer, do
Connie Mizner, for a Site Specific Development Plan and Use by Special Review Permit,
USR13-0059, for a use similar to the Uses listed in Section 23-3-40 as Uses by Special Review
(three single family residences on one parcel) as long as the Use complies with the general
intent of the A (Agricultural) Zone District, based on the recommendations of Planning staff and
the Planning Commission, with the Conditions of Approval and Development Standards as
amended and entered into the record. The motion was seconded by Commissioner; and it
carried unanimously. There being no further discussion, the hearing was completed at
10:57 a.m.
