WHEREAS, the Board of County Commissioners of Weld County, c•Q Colorado, pursuant to Colorado statute and the Weld County Home z_ Rule Charter, is vested with the authority of administering the rn r- `'{ affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, o Colorado has reviewed the request of Benny and Eleanor Chavez H for an exemption from the definitions of "subdivision" and "sub- divided land" in Section 30-28-101 (10) , CRS 1973, as amended, 'h Mand Section 2-1 of the Weld County Subdivision Regulations, and 24 WHEREAS, the Board of County Commissioners finds that Benny and Eleanor Chavez are the owners of certain parcels of land located in Part of the Northwest Quarter of Section 24 , Town- ship 1 North, Range 68 West of the 6th P.M. , Weld County, Colo- rado, being more particulary described as follows: Parcel 1 West 250' of the North 650 ' of the North- west Quarter of Section 24, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado. Parcel 2 West 250' of the South 225' of the North 875 ' of the Northwest Quarter, Section 24, Township 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado. Prior to the adoption of the current Subdivision Regulations, Parcel 1 was created which is considered to be a legal lot. Subsequent to the adoption of the current Subdivision Regulations, Parcel 2 was created making the parcel an illegal lot. The two parcels were conveyed to the Chavez ' as one parcel, inadvertently circumventing the subdivision exemption process. This request will formalize what has already occurred combining the two par- cels together into one legal parcel. No new parcels are being created, and WHEREAS, the legal description of the resulting parcel of land is as follows: 790865 • g 896°°K 179">a The West 250' of the North 875 ' of the Northwest Quarter of Section 24 , Town- ship 1 North, Range 68 West of the 6th P.M. , Weld County, Colorado. The above described parcel shall be considered as a single lot. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the abovedescribed par- cel be, and hereby is, declared to be exempt from the definitions of "subdivision" and "subdivided land" as set forth in Section 30-28-101 (10) , CRS 1973, as amended, and Section 2-1 of the Weld County Subdivision Regulations, and BE IT FURTHER RESOLVED by the Board that the resulting par- cel of land as described above be, and hereby is, considered to be a single lot.
