RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
USR13-0068, FOR ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT, OTHER
THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (TWO (2) DWELLING UNITS
ON A SINGLE PARCEL) IN THE A (AGRICULTURAL) ZONE DISTRICT — GERALD
CALVIN AND KAREN HERMAN-CALVIN
A public hearing was conducted on April 16, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
IR I hereby certify that pursuant to a notice dated February 28, 2014, and duly published
March 5, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request
of Gerald Calvin and Karen Herman-Calvin, for a Site Specific Development Plan and Use by
Special Review Permit, USR13-0068, for One (1) Single-Family Dwelling Unit per lot, other than
those permitted under Section 23-3-20.A (two (2) dwelling units on a single parcel) in the
A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record.
Chair Rademacher advised Dr. Gerald Calvin, representing the applicant, that, since
Commissioner Kirkmeyer was not able to be present, he had the option of continuing this matter
to a date with the full Board present. However, if he decides to proceed today, it will require
three affirmative votes, or in the case of a tie vote, Commissioner Kirkmeyer will listen to the
record and make the determining vote. Dr. Calvin indicated he would like to proceed.
El Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written. He said this would allow two residences on a single partial exemption. This
case comes before the Board due to a zoning violation; the existing home at the time the
exemption was granted for a new dwelling was to be converted to a shed; however, the
residence is currently occupied by a non-related family. Mr. Gathman reviewed surrounding
land use and residences, said staff has received no comments regarding this case, and noted
the City of Fort Lupton would like to discuss annexation with the applicant and showed images
of the site.

El Don Carroll, Department of Public Works, provided a brief overview of the transportation
plans and requirements. In response to Chair Rademacher, Mr. Carroll confirmed there are two
existing accesses, one is for a Quonset hut and is access to another parcel or well site, and the
other is for the residences.
19 Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions and recommended deletion of Development Standards #3 and #4 as
non-applicable to residential property. She reported there are no issues.
II Dr. Calvin explained that this began due to a violation; however, the houses have been
there for more than 20 years. In response to Chair Rademacher, Mr. Gathman said the zoning
permit allows a second dwelling on one parcel - for family members or caregivers only; a
Recorded Exemption or a Use by Special Review, were other options discussed.
19 No public testimony was offered concerning this matter.
Mr. Calvin stated he had no objections to the resolution. In response to Chair
Rademacher, he indicated he has reviewed, and agrees to abide by, the Conditions of Approval
and Development Standards, as amended. Mr. Calvin thanked Mr. Gathman and the planning
department. Chair Rademacher stated the Board was fine with striking Development Standards
#3 and #4.
Commissioner Conway moved to approve the request of Gerald Calvin and Karen
Herman-Calvin for a Site Specific Development Plan and Use by Special Review Permit,
USR13-0068, for One (1) Single-Family Dwelling Unit per lot, other than those permitted under
Section 23-3-20.A (two (2) dwelling units on a single parcel) in the A (Agricultural) Zone District,
based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards as amended. The motion was seconded
by Commissioner Garcia, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:20 a.m.
