This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: Two access permits for industrial use have been approved for the site (AP10-00138 and AP13-0297). The traffic information with the application materials indicate the site will be unmanned however there will be 5-6 individuals on site at one time for loading trucks and the maximum number of employees on site at one time is expected to be no more than 12 individuals at one time. The application materials also indicate there will be 20-30 semi trucks per day loading and unloading. Access improvements are required and shall include 60ft radii to accommodate turning trucks and standard tracking control including 100' of paving with back to back double cattle guards across the accesses or 200' of paving to prevent the tracking of mud onto the publically maintained paved roadway. With no additional buildings being proposed, no Drainage Report and detention pond is required. If the applicant proposes in a separate application, additional buildings as clarified in the email correspondence with Tiffane Johnson, the increased imperviousness may require a drainage report and detention pond to mitigate the increased runoff. This would be discussed at that pre-application meeting for that if appropriate. With the current application no additional buildings are proposed and the drainage narrative indicates there will be no significant water drainage from the proposed project. A drainage narrative and water quality feature are proposed with this project. Please update the water quality feature calculations and design to provide treatment between storage areas. The applicants will be required to maintain historic drainage flows and run-off amounts on the property. Please provide a design to pass historic offsite flows through the berm. An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), any onsite and offsite requirements, and a maintenance agreement for the haul routes. CONDITIONS OF APPROVAL: Prior to recording the map: A. An Improvements Agreement and Road Maintenance Agreement is required for this site. Road maintenance including dust control, damage repair, and triggers for improvements will be included. B. Provide a maintenance plan for the berm to ensure structural stabilization and control erosion. The map shall be amended to delineate the following: A. County Road 46 is designated on the Weld County Road Classification Plan as a paved Collector road, which requires 80 feet of right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of future right-of-way. If the right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. B. Show the approved access(es) on the map and label with the approved access permit number(AP13-00297 and AP10-00138) C. Show and label the water quality features/depressions on the map. D. Show and label standard tracking control onto publically maintained roadways on the map. Prior to Construction: A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to the start of construction. DEVELOPMENT STANDARDS 1. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. `>"86 "1 MEMORANDUM IX = a ,EL TO: TIFFANE JOHNSON, PLANNING SERVICES V COUNTY FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH SUBJECT: USR14-0029 DATE: JULY 2, 2014 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for Mineral Resource Development facilities including Oil and Gas Support and Service Facilities (commercial trucking and regional supply yard including equipment storage, a future office, shop, employee parking and a manufacture structure for a temporary office during construction of office building) in the A (Agricultural) Zone District. The maximum number of people accessing the site is 20. The application indicates that no personnel will be onsite for more than two consecutive hours. Portable toilets can be utilized as it is the policy of this department that portable toilets are allowed when employees or contractors are on site for less than 2 consecutive hours a day. As employees will be on site for a short duration, in accordance with Environmental Health Services policy, the use of portable toilets is allowed. The property has a tap from Central Weld County Water District which is not currently utilized. Bottled water will be available in the Quonset hut storage building, which is acceptable according to EH policy. The dust abatement plan states that the road through the property and the entrance is concrete. Gravel has been applied to other areas and vehicle speeds will be reduced. The waste handling plan indicates that Waste Management will provide trash removal. Maintenance and repair of vehicles or equipment will not occur on site and there will be no washing, fuel storage or chemical storage. The application does contain the addition of a future shop and office. If there will be full time personnel located on the property adequate water and sewer in accordance with EH policy shall be adhered to. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirement be met prior to the issuance of the Certificate of Occupancy for the permanent office building: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County On-Site Wastewater Treatment System Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. For employees or contractors on site for less than 2 consecutive hours a day, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable 2 toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 7.
