If a question does not pertain to your use, please respond with "not applicable", with an explanation as to why the question is not applicable. 1 . Explain , in detail , the proposed use of the property. The existing building on the site is approximately 44' x 84' metal "shop" structure. The 5.6-acre property, along with the building is used for storage of agriculture equipment. The equipment travels from job site to job site during the farming and harvesting season and is stored on the subject property during the off-season . This is not unlike the equipment that is used and stored at any other agricultural site in Weld County. The only difference is that KB Custom provides custom harvesting services to a variety of agricultural customers. The subject property, along with the structure, supports the KB Custom AG Services business, which is located in the Town of Ault. The primary business, in Ault, has approximately 14-15 employees, none of which are assigned to the subject property. They have a second facility in Ault where all of the equipment is maintained , including routine oil changes, transmission flush, grease and any other maintenance practices that may require hazardous materials, solvents or specialized materials storage or disposal . Previous correspondence, including the pre-application conference suggested that the shop on the subject property is occasionally used for equipment repair and oil changes. This activity is no longer conducted at this facility. The equipment stored at this site consists of farm trucks and trailers, tractors , harvesting equipment and miscellaneous other items that pertain to an agriculture harvesting operation. There are no livestock, employees, crop storage, crop sorting, or any other activities conducted on the site besides the storage uses as described above. A commercial business suggests the property is used for retail trade, services, professional offices, etc. where customers or vendors visit the site for goods and services. This assessment of the subject property is not an accurate portrayal of the actual activities at this site. The site is used strictly for storage of farm equipment as described above. There is currently an approved SE-765 on this property for a fiber-optic facility. This was recorded 6/15/1999, Reception number 2700581 . The portion of the site within the SE includes a building that is approximately 2, 500 square feet in size. The total area of the SE is 2.2 Acres (310' x 310') in size. According to the Option Agreement, dated 3/01 /1999, Reception number 2676530, the activity of this portion of the property includes: " . . .engineering, construction, maintenance, security, operation, repair, replacement, removal and/or abandonment of communications equipment, structures, lines and related facilities, from time to time, as Grantee may require, upon, over, under and across the (said) parcel. " The applicant / owner of the subject property is not in control of this activity, nor are they knowledgeable concerning the traffic generation or ongoing use of the SE property. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 (Comprehensive Plan). Section 22-2-20 are the Agricultural goals and policies related to the Comprehensive Plan. This proposal is consistent in the following ways: a . The agricultural land use designation is not being changed or compromised with the land use proposed for the subject site. b. A third-party harvesting operation is a fairly unique and specialized business that serves the agricultural industry efficiently and cost effectively. c. The land use on the subject property is not viable for crop production or livestock. The site, based on its relative size and adjacency to larger agricultural land uses, best serves the agricultural industry as a support or accessory use, as is proposed by this application. d . The subject property and proposed land use as a storage facility is committed to County regulations related to derelict vehicles, refuse, litter and other unsightly materials. The site has been and will continue to be maintained by keeping weeds mowed , ongoing trash collection, dust abatement through gravel driveway maintenance and watering , and screening if necessary. e. The proposed land use is consistent and compatible with the adjacent agricultural land uses in the immediate area. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located . The Weld County Zoning Code is designed to designate land use districts within the County that will provide a structure for regulations and will ultimately protect the health , safety, and welfare of the present and future inhabitants of the County. The subject property is located within the A-Agricultural Zone District. The Agricultural zone district is "intended to provide areas for the conduct of agricultural production without the interference of other, incompatible land uses. " The proposed use is to provide an off-season structure for the storage of farm equipment. This would be considered a use by right as an accessory use to an allowed agricultural use in the A zoning district. However, because this structure and proposed use is the primary use of the subject property, rather than an accessory use, and because it is considered an "Agricultural Service establishment primarily engaged in performing agricultural services on a fee or contract basis. " (as stated in 23-3-40B), the proposed use apparently falls into a "Use by Special Review" use category. It should be noted that the proposed storage use is not included in the 18 agricultural service establishments listed in this particular code. It is clear this particular use is somewhat unique and should be given consideration as such. 4. What types of uses surround the site? Explain how the proposed use is consistent and compatible with surrounding land uses. Agricultural uses that surround this site are primarily crop farming, hay production , cattle grazing , dairies, feedlots and rural residential . This proposal is compatible with the surrounding agricultural uses and the Weld County Comprehensive Plan . 5 . Describe, in detail, the following : a . Number of people will use this site? This shop will only be used for the storage of farm equipment. The personnel associated with the use will be for the purpose of transportation only. There will be no personnel assigned to the facility, and it will be occupied for only short periods of time. b. Number of employees proposed to be employed at this site? No full time employees will be employed at this site. c. Hours of operation? This facility will be accesses primarily during the winter months and during daylight hours. However, because of the storage nature of the facility it may be possible for the site to be accessed at any time. d . Type and number structures to be erected (built) on this site? There is an existing storage facility and an existing public facility structure on the site. No new structures are proposed . e. What type and number of animals, if any, will be on this site? There will be no animals on the site. f. Kind of vehicles (type, size, weight) that will access this site and how often? Typical vehicles accessing this site include farm trucks and trailers, tractors, harvesting equipment and other typical farming equipment. g . Who will provide fire protection to the site? Ault-Pierce Volunteer Fire Department h . What is the water source on the property? (Both domestic and irrigation) There is a North Weld County water tap at the facility. The tap was installed by a previous owner, and will not be used by the applicant. i. Sewage disposal system on the property? ( Existing and proposed ). The sewage disposal system consists of a portable toilet, as required by Weld County Codes. j . If storage or warehousing is proposed , what type of items will be stored? Storage consists of farm trucks and trailers, tractors, harvesting equipment, and miscellaneous other items that pertain to an agriculture harvesting operation. 6 . Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal . This is an existing facility, there is no further landscaping planned with this permit application . 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Should the facility be permanently discontinued for use as an equipment storage facility, it would be marketed under applicable county planning and zoning regulations to its greatest and best use. No reclamation of the current use is required . 8. Explain how the storm water drainage will be handled on the site. A water quality feature is planned . See the enclosed Storm Water Management Plan for stormwater calculations and the Site Plan for the location of the water quality feature. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. This is an existing facility and no new construction or landscaping is proposed with this plan. 10. Explain where storage and/or stockpile of wastes will occur on this site. A dumpster service is contracted to dispose of any waste or garbage. WCR 80 is an unimproved , gravel County road . WCR 39 is a paved roadway with 60' R. O.W. Access to the site is from WCR 80, which borders the subject property on the south side. The site is currently functioning , and will continue to function as a storage facility for agricultural vehicles and equipment to support the KB Custom Ag Services, LLC. The Company is currently headquartered in Ault, where there are offices and facilities for 14-15 employees. There will be no employees assigned to this facility. Typical vehicles accessing this site include farm trucks, trailers, tractors, harvesting equipment and miscellaneous other items that pertain to any agricultural harvesting operation . The trips that are generated by this facility are very seasonal and insignificant. Trips will not exceed 10-20 per week during the spring , summer and fall months (April through November) and no more than 10-20 per month during the winter months. The site requires a water quality feature to provide a Water Quality Capture Volume (WQCV). Calculations were performed using a spreadsheet based on the suggested methods of Weld County in their Water Quality Feature Procedure as presented in Appendix A. This procedure is based off the Drainage Criteria Manual V.3. A copy of Weld County's procedure is included in Appendix B. Results show that for a developed drainage area of±243,936 square feet a required storage volume of at least 2,100 cubic feet would be required at the site. Two proposed impoundments of 50' x 21'x 1' (length x width x depth) are proposed on the southeast corner of the site as shown in a site map in Appendix C. The shape of the impoundments can vary provided that they contain 2,100 cubic feet of storage volume. Larger basins can result In less net reduction of pollutants than is obtained when using the recommended 80th percentile capture volume that can be obtained from Figure SQ-2. Storms larger than the 80"'percentile events still receive some treatment when their capacity is exceeded by larger storms,but at a somewhat lower efficiency. Thus,the law of diminishing returns for cost-effective pollutant removal takes effect, not only because of the large number of small storms found in the total population of storms, but because the first flush of runoff for larger storm is also captured and that pollutant removal continues to occur for in-line capture basins when the runoff exceeds their design capacity. 4.4 Determining the Water Quality Capture Volume 4.4.1 Use of Directly Connected Impervious Area The procedures described in the RAINFALL and in the RUNOFF chapters of Volume 1 of the Manual are intended for the design of drainages and flood facilities that prevent damage to property and help protect human life. These procedures show that the depth of rainfall produced from a design storm varies somewhat throughout the Denver region and that runoff is a function of total imperviousness. Water quality enhancement focuses more on the smaller events that deliver frequent flow pulses and pollutant loads to the receiving waters. The runoff volume for smaller events is especially sensitive to the impervious area that is hydraulically connected to the stormwater runoff system. The impervious portion of a watershed determines the runoff volume that needs to be used for the design of water quality facilities,and the percentage of Impervious surface therefore becomes important in the design of structural BMPs. The RUNOFF chapter of the Manual,Volume 1, includes the methodology for calculating basin imperviousness. This procedure needs to be modified,however,when using the practice of minimizing directly connected impervious areas in combination with extended detention basins, retention ponds, wetlands, and other practices depended on a design water quality capture volume. Whenever applicable,the needed modifications are described in the appropriate chapters of this volume of the Manual. 4.4.2 Water Quality Capture Volume(WQC1/1 All structural BMPs recommended in this volume of Manual are based on the 80'"percentile event. Specific guidance for finding the needed WQCV is provided in each BMP types'design section. This WQCV varies with the type of BMP used and is based on the time it takes to fully drain the brim-full WQCV. Figure SQ-2 summarizes the WQCV requirements as a function of the tributary catchments total imperviousness as a ratio of the total area of the catchment for 6-, 12-,24-, and 40-hour drain times of the WQCV. 10-2005 SQ-23 Urban Drainage and Flood Control District STORMWATER QUALITY MANAGEMENT DRAINAGE CRITERIA MANUAL(V. 3) Figure SQ-2 is appropriate for use in Colorado's high plains near the foothills. The chapter on RUNOFF in Volume 1 of the Manual contains guidance for how to find the total imperviousness of a watershed and its use is recommended. Figures SQ-4,SQ-5 and SQ-6 are duplicated in this chapter to help the reader estimate the imperviousness of single family residential areas. Note that these figures require the knowledge of the average housing densities, types of housing,and average human occupied total square footage of the houses in the area to find the imperviousness of these areas. Find WQCV from above highlighted#2 equation using a=1.0 and your i from step 1 3. Find required storage from highlighted#3 equation on page SQ-24 using your WQCV from step 2 and the Total Site Area 4. Show the area for the water quality depression on your site plan downstream of any parking,building or operations areas and label it as"Water Quality Feature, No Build Area".The depression should be 1-2'deep and have enough volume for the required storage amount you calculated above.
