HomeMy WebLinkAbout20143064.tiff HEARING CERTIFICATION DOCKET NO. 2014-78 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR14-0041, FOR A MINERAL RESOURCE DEVELOPMENT, INCLUDING OPEN PIT MINING (SAND, GRAVEL AND STONE) AND MATERIALS PROCESSING, INCLUDING STOCKPILING, CRUSHING, SCREENING, RECYCLING OPERATIONS AND IMPORTING OF RAW AND RECYCLED MATERIALS IN THE A (AGRICULTURAL) ZONE DISTRICT - SCOTT KOSKIE, C/O WELD COUNTY PUBLIC WORKS A public hearing was conducted on October 8, 2014, at 10:00 a.m., with the following present: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Diana Aungst Public Works representative, Wayne Howard Health Department representative, Lauren Light The following business was transacted: lEti I hereby certify that pursuant to a notice dated August 29, 2014, and duly published September 3, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request of Scott Koskie, do Weld County Public Works, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0041, for a Mineral Resource Development, including open pit mining (sand, gravel and stone) and materials processing, including stockpiling, crushing, screening, recycling operations and importing of raw and recycled materials in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. The mine will occupy approximately 40 acres of a 320-acre parcel. There will be two mobile trailers on site and some storage (stockpiling) area. It is estimated that the site has 10 years (or less) of gravel and sand reserves; afterwards the land will be reclaimed and returned to cropland. Ms. Aungst addressed surrounding land use, stated the closest residence is three quarters of a mile from the mining activity, and confirmed no correspondence has been received. A Department of Reclamation Mining and Safety (DRMS) permit has been received. The rural nature of the area, and the existing surrounding mining operations make this use compatible. She showed images of the site, the site plan and views from the site. 2014-3064 PL2296 CC '. &4 YL,?w, ItL i°Ia0 HEARING CERTIFICATION - SCOTT KOSKIE C/O WELD COUNTY PUBLIC WORKS (USR14-0041) PAGE 2 e Wayne Howard, Department of Public Works, provided a brief overview of the transportation plans and requirements: CR 20 is a local gravel road, between 25-30 trucks will be coming and going from the site, and there is no ADT for this road. In response to Chair Rademacher, Mr. Howard said there isn't an ADT scheduled at this time; however, that would be prudent. • Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions: bottled water and portable toilets are acceptable. The applicant submitted an Air Emissions Permit, and noise is restricted to the Industrial Zone level. la Clay Kimmi, Department of Public Works, stated staff did a good job of presenting what the plans are for this site. He explained that the Lear Gravel Pit, to the North of this site, has been mined since the late 80's and is now mined out and being reclaimed. Test of these fields looks comparable to that pit, so a lease agreement was approved by the Board in October, 2013. The DRMS permit was issued, as well as the other requisite permits. They anticipate an initial stockpile between 80,000 and 100,000 tons of gravel, then refilled when completed, so the life of the mine would be around 5-7 years. In response to Chair Rademacher, he said all 40 acres are permitted, the lease is 12 years, and if it is as good as they expect, the pit may be expanded in the future, with the cooperation of the land owner. • No public testimony was offered concerning this matter. Mr. Kimmi indicated he has no concerns. e Commissioner Rademacher addressed Development Standard #3, and Mr. Kimmi assured him that six employees on-site is adequate (that is a crew), and truck drivers will come and go. He also noted that Development Standard #5 and 6 seem redundant. Commissioner Kirkmeyer explained the differences, so those remain unchanged. • In response to Chair Rademacher, Clay Kimmi, on behalf of Weld County Public Works, indicated he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. IE Commissioner Conway moved to approve the request of Scott Koskie, c/o Weld County Public Works, for a Site Specific Development Plan and Use by Special Review Permit, USR14-0041, for a Mineral Resource Development, including open pit mining (sand, gravel and stone) and materials processing, including stockpiling, crushing, screening, recycling operations and importing of raw and recycled materials in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously.
