HomeMy WebLinkAbout20141965.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JUNE 30, 2014 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, June 30, 2014, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Douglas Rademacher, Chair Commissioner Barbara Kirkmeyer, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner William F. Garcia - EXCUSED Also present: County Attorney, Bruce T. Barker Clerk to the Board, Esther Gesick Controller, Barbara Connolly e MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of June 25, 2014, as printed. Commissioner Conway seconded the motion, and it carried unanimously. el READ ORDINANCE BY AUDIO: Commissioner Kirkmeyer moved to read Code Ordinance #2014-9 by audio. Commissioner Freeman seconded the motion, which carried unanimously. CJ CERTIFICATION OF HEARINGS: Commissioner Conway moved to approve the Certification of Hearings conducted on June 25, 2014, as follows: 1) COZ14-0002 — Mark and Jacquelyn Eberl, 2) PUDF14-0001 — Mark and Jacquelyn Eberl. Commissioner Freeman seconded the motion, which carried unanimously. A• MENDMENTS TO AGENDA: There were no amendments to the agenda. El C• ONSENT AGENDA: Commissioner Conway moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. IR PUBLIC INPUT: There was no public input. Minutes, June 30, 2014 2014-1965 Page 1 BC0016 L BIDS: El 1) APPROVE BID #B1400113, WCR 49 CORRIDOR PHASE I - RIGHT-OF-WAY ACQUISITION SERVICES - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, said staff recommends this be awarded to the low bidder, Western States Land Services, Inc., in the amount of $209,200.00. Public Works has worked with them previously with good results. Commissioner Conway moved to approve said bid, as recommended by staff. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. IR 2) PRESENT BID #B1400101, WELD COUNTY PARKWAY PROJECT (CR 49 EXTENSION) - DEPARTMENT OF PUBLIC WORKS: Mr. Jiricek said staff received eight bids and will make a recommendation on July 14, 2014. NEW BUSINESS: El 1) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - AMERICAN FURNITURE WAREHOUSE C/O THE E COMPANY, INC.: Christopher Woodruff, Assessor, reviewed the uses of the property, valuation analysis and staff's recommendation for approval of an abatement refund in the amount of $122,780.13. Commissioner Conway moved to approve said abatement refund as recommended by staff. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. Fl 2) CONSIDER MEMORANDUM OF UNDERSTANDING PURSUANT TO HOUSE BILL 04-1451 WITH VARIOUS AGENCIES AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director of Department of Human Services, explained this continues the collaborative arrangement, and it is anticipated that 2,896 at-risk youth may be assisted through the integrated multi-agency services. The MOU commits $9,000.00 per County partner (Human Services, Weld County, Health Department). Kelly Schramm, Youth and Family Connections, provided a brief update on the activities and progress being made through the program. He submitted a chart demonstrating the system work flow, marked Exhibit A. Commissioner Conway encouraged continued outreach to Greeley-Evans School District 6 and Chair Rademacher expressed pleasure with the participation of a south-County school district. Commissioner Kirkmeyer moved to approve said memorandum of understanding and authorize the Chair to sign. The motion, which was seconded by Commissioner Conway, carried unanimously. ID 3) CONSIDER VICTIM ASSISTANCE AND LAW ENFORCEMENT (VALE) BOARD CONTRACT FOR LONG TERM CARE OMBUDSMAN/FRIENDLY VISITOR PROGRAM AND AUTHORIZE CHAIR TO SIGN: Ms. Griego explained this contract allows the Ombudsman Program to provide education to long-term care residents, family members and facility staff and continue the Friendly Visitor Program. Commissioner Kirkmeyer moved to approve said contract and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. 4) CONSIDER TEMPORARY CLOSURE OF CR 76 BETWEEN CRS 51 AND 53: Janet Lundquist, Department of Public Works, reviewed this temporary road closure for a bridge re-deck. Commissioner Conway moved to approve said temporary road closure. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. to 5) CONSIDER TEMPORARY CLOSURE OF CR 390 BETWEEN CRS 104 AND 122: Ms. Lundquist reviewed this temporary road closure for five culvert replacements. Commissioner Freeman moved to approve said temporary road closure. The motion was seconded by Commissioner Conway, and it carried unanimously. Minutes, June 30, 2014 2014-1965 Page 2 BC0016 6) CONSIDER ADDENDUM TO SERVICES AGREEMENT FOR STATE OF COLORADO FUEL CARD PROGRAM AND AUTHORIZE CHAIR TO SIGN - WEX, INC.: Barbara Connolly, Controller, explained that this is an addendum to an existing agreement WEX has with the State of Colorado; it is a contingency plan for the dedicated CNG vehicles, in case a County fuel site is down for an extended period of time. Drivers can go to Agfinity, but will need to have a WEX fuel card to activate the pumps. She explained how the billing works and recommended approval. Commissioner Kirkmeyer moved to approve said addendum to agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Conway, carried unanimously. El 7) FIRST READING OF CODE ORDINANCE 2014-9, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE, AND CHAPTER 9 INFORMATION SERVICES, OF THE WELD COUNTY CODE: Mr. Jiricek explained this pertains to good management practices and procedures for the purchasing of IT resources by the Department of Information Technology. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve said code ordinance on first reading. Commissioner Freeman seconded the motion. The Board requested staff schedule a work session prior to the second reading. There being no further discussion, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance#2014-9 was approved on First Reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
