RE: ZONING PERMIT, ZPHB14-0006, FOR A CLASS II HOME OCCUPATION
(PARKING/STORAGE OF COMMERCIAL VEHICLES - 2 TRUCKS / 2 TRAILERS)
ASSOCIATED WITH A LANDSCAPING BUSINESS IN THE A (AGRICULTURAL)
ZONE DISTRICT-AARON AND CAROLINE WALKER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Zoning Permit, ZPHB14-0006, was submitted by Aaron and
Caroline Walker, 36841 County Road 15, Windsor, Colorado 80550, for a Class II Home
Occupation (parking/storage of commercial vehicles -two trucks /two trailers) associated with a
Landscaping Business in the A (Agricultural) Zone District, for property which is located on the
following described real estate, to-wit:
Lot 3, 1st Filing, Roth Subdivision; located in part of
the E1/2 NE1/4 of Section 31, Township 7 North,
Range 67 of the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the unfavorable
recommendation of the Weld County Department of Planning Services and all of the exhibits and
evidence presented in this matter and, having been fully informed, finds that this request shall be
approved for the following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 23-4-990.8 of the Weld County Code.
2. It is the opinion of the Board of Weld County Commissioners that the applicant has
shown compliance with Section 23-4-990.D.1 thru D.8 of the Weld County Code as
follows:
A. Section 23-4-990.D.1 -- Compatibility with surrounding area, harmony with
the character of the neighborhood and its effects upon the immediate area.
B. Section 23-4-990.D.2 -- The proposal is consistent with the policies and
goals of Chapter 22 of the Weld County Code.
C. Section 23-4-990.D.3 -- Availability of adequate water and sewage
disposal facilities.
D. Section 23-4-990.D.4 -- The general health, safety and welfare of the
inhabitants of the area and the county.

E. Section 23-4-990.D.5 -- The proposal is consistent with the definition as
expressed in Section 23-1-90 of this Chapter.
F. Section 23-4-990.D.7--The proposed zoning permit complies with Division
13 of this Article.
G. Section 23-4-990.D.8 -- An access is or can be made available that
provides for safe ingress and egress to a public road. All accesses shall
be in accordance with Chapter 12, Article V of this Code, and shall
endeavor to achieve the goal of no "net increase" in the number of
accesses onto adjacent County roads when accesses already exist.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Aaron and Caroline Walker for Zoning Permit,
ZPHB14-0006, for a Class II Home Occupation (parking/storage of commercial vehicles - two
trucks /two trailers) associated with a Landscaping Business in the A (Agricultural) Zone District,
be, and hereby is, granted subject to the following conditions:
1. Permittee acknowledges that the issuance of the Home Occupation — Class II
permit is conditional upon Permittee's completion of the improvements and/or
meeting of the conditions which are described below and depicted in a set of plans
provided by Permittee (herein referred to as"Plans"), a copy of which is attached to
this document and made a part hereof.
2. Permittee is not allowed to engage in any activity described in the above
paragraph and/or any activity related to the business(es) described above, (OR
ANY OTHER ACTIVITY WHICH HAS NOT HERETOFORE BEEN PERMITTED),
until said improvements have been completed or said conditions have been met.
A. The following conditions must be met at all times throughout the existence
of the Home Occupation — Class II permit.
1) The business use of the property must be secondary to the use of
the property as a dwelling site.
2) The size of the business area is limited to fifty percent (50%) of a
dwelling unit and/or in accessory buildings with appropriate building
permits.
3) The business shall be conducted by the inhabitants of the dwelling
plus no more than two (2) external employees.
4) On parcels of land less than eighty (80) acres, the number of
commercial vehicles is limited to two (2) such vehicles with two (2)
rear axles. On parcels of land greater than eighty (80) acres, one
(1) tractor trailer (semi) and one (1) additional commercial vehicle
with two (2) rear axles are allowed.

5) Exterior storage of materials, goods, supplies or equipment related
to the business must be adequately screened.
6) The business use must not create any negative impact to the public
health, safety or welfare of adjacent property owners.
7) Only incidental sales of stocks, supplies or products shall be
conducted on the premises.
8) Only one sign advertising the business shall be allowed, subject to
the following restrictions:
a. Sign must be non-illuminated;
b. Sign must be no greater than nine (9) square feet
c. Sign must be attached to the face of the dwelling unit.
9) The traffic volume produced by the business must not exceed that
produced by the dwelling unit by more than sixteen (16) trips daily.
Trips include those produced by the residents for purposes related
to the business, the one or two employee(s), clients, deliveries, etc.
10) Hours of operation are limited to daylight hours.
11) Permittee shall maintain compliance with Health, Building and all
other local, state and federal regulations.
12) Permittee shall maintain compliance with Section 23-4-950 of the
Weld County Code at all times.
13) All activity, equipment and structures related to the Home
Occupation must occur on Lot 3, Roth Subdivision — 1st Filing.
14) The zoning permit shall not be transferable by the applicant and/or
owner to any successor. The zoning permit shall terminate
automatically upon conveyance or lease of the property.
15) In the event the Permittee's usage of the existing septic system
exceeds six (6) persons per day, the septic system shall be
evaluated by a Colorado registered professional engineer. The
review shall consist of observation of the system and a technical
review describing the system's ability to handle the proposed
hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed, the system
shall be brought into compliance with current regulations.

16) There shall be no parking or staging of commercial vehicles on the
County roads or rights-of-way. The permittee shall utilize on-site
parking only.
17) Should noxious weeds exist on the property, or become established
as a result of the proposed development, the applicant/landowner
shall be responsible for controlling the noxious weeds, pursuant to
Section 15-1-180 of the Weld County Code.
18) A building permit will be required for any new construction,
alteration, addition or manufactured structure on the property to be
used for the Landscaping Business. Any fuel dispensing over 500
gallons will require building permits and Fire District notification
letters, above ground tanks and in ground tanks require building
permits, exception water tanks less than 5,000 gallons. Buildings
and structures shall conform to the requirements of the various
codes adopted at the time of permit application. Currently, the
following have been adopted by Weld County: 2012 International
Codes, 2011 National Electrical Code, and Chapter 29 of the Weld
County Code. A plan review shall be approved and a permit must
be issued prior to the start of construction.
B. Violation of Terms: If Permittee does not perform as outlined in this
document, such non-performance will constitute a violation of Permittee's
Home Occupation -Class II permit granted by County, and County will take
whatever remedial measures it deems necessary against Permittee. In
addition to any other remedy available to the County in law or equity, a
failure to meet the conditions will result in the loss of the permit and in the
initiation of legal action against the Permittee.
C. Engineering Services: In the event that Permittee is required to complete
any improvements or meet any conditions which require the services of an
engineer, Permittee shall furnish, at its own expense, all such services.
The required engineering services shall be performed by a Professional
Engineer and Land Surveyor registered in the State of Colorado, and shall
conform to the standards and criteria established by the County for public
improvements. The required engineering services shall consist of, but not
be limited to, surveys, designs, plans and profiles, estimates, construction
supervision, and the submission of necessary documents to the County.
D. Successors and Assigns: This Home Occupation - Class II permit may not
be delegated, transferred or assigned, in whole or in part, by Permittee.
This Permit shall terminate immediately upon the sale of the property and
or commercial enterprise, the cessation of the commercial enterprise, or
the death of the Permittee (if the Permittee is an individual). The County's
rights and obligations under this Agreement shall automatically be
delegated, transferred or assigned to any municipality which, by and
through annexation proceedings, has assumed jurisdiction and
maintenance responsibility over the roads affected by this Agreement.

E. County Engineer: All references in this Agreement to "County Engineer"
shall refer to any individual or individuals appointed by the County Engineer
to act on his/her behalf.
F. Violation of Terms of Agreement: If, in the County's opinion, the Permittee
has violated any of the terms and conditions set forth in this document, the
County shall notify the Permittee of its belief that there have been
violation(s) and shall state with specificity the facts and circumstances
which the County believes constitute the violation(s). The Permittee shall
have fifteen (15) days within which to either cure the violation or
demonstrate compliance. If, after fifteen (15) days have elapsed, the
County believes in good faith that there has been a violation of the terms of
this Agreement, the County shall initiate proceedings to revoke the Home
Occupation — Class II permit.
G. Termination of Permit: A Home Occupation—Class II permit shall terminate
upon the earliest of the following events:
1) Cessation of all Permit Related Activities: Termination of the Permit
shall occur upon the Permittee's complete cessation of all activities
permitted under the terms of the Permit. The Permittee shall
provide written notice to the County of a cessation of activity, which
the County shall then verify. If written notice is not provided to the
County, termination of the Permit shall occur three (3) years after
the County observes the cessation of the activities for which the
Permit was issued.
2) Execution of Replacement "Home Occupation — Class II
Agreement": The Agreement shall terminate following the County's
execution of a new Home Occupation — Class II Agreement with a
new Permittee who has purchased or then inhabits the property,
and intends to make use of the rights and privileges available to it
through the then existing Home Occupation —Class II permit.
3) Sale or Transfer of Property and/or Commercial Enterprise: The
Permit shall immediately terminate upon the Permittee's sale or
transfer of the property upon which the commercial enterprise is
conducted. The Permit shall also terminate immediately upon the
Permittee's sale or transfer of the commercial enterprise.
H. Governmental Immunity: No term or condition of this agreement shall be
construed or interpreted as a waiver, express or implied, of any of the
immunities, rights, benefits, protections or other provisions, of the Colorado
Governmental Immunity Act §§24-10-101 et seq., as applicable now or
hereafter amended.

I. No Third Party Beneficiary Enforcement: It is expressly understood and
agreed that the enforcement of the terms and conditions of a Home
Occupation — Class II permit, and all rights of action relating to such
enforcement, are strictly reserved to the County.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 27th day of October, A.D., 2014.

Per Section 24-4-90 of the Weld County Code, the definition of a Home Occupation is:
Home Occupation:An incidental use of a Dwelling Unit for gainful employment of the resident therein,
where:
a. Whether a Class I or Class II, a Home Occupation may utilize up to fifty percent(50%) of a Dwelling
Unit and/or in Accessory Buildings with appropriate building permits.
b. Such Use is clearly incidental and secondary to the Use of the dwelling for dwelling purposes and
shall not change the character thereof.
Ordinarily, a Home Occupation shall not be interpreted to include the following: clinic, HOSPITAL,
nursing home, animal hospital, Hotel/Motel, Restaurant, mortuary, vehicle or boat repair (including
painting) or organized classes where more than six (6) persons meet together for instruction on a
regular basis (does not include classes sponsored by a Public School).
c. Hours of operation for public access shall be limited between 7:00 a.m. and 7:00 p.m.
d. There is no exterior storage, display or sales of materials, goods, supplies or equipment related to
the operation of such Home Occupation, nor of any highly explosive or combustible materials.
e. Does not create any negative impacts to the public health, safety and general welfare of the
adjacent property owners, such as little or no offensive noise, vibration, smoke, dust, odors, lighting,
traffic congestion, trash accumulation, heat, glare or electrical interference, or other hazard or
nuisance noticeable off the Lot.
HOME OCCUPATION — CLASS I: A HOME OCCUPATION - CLASS I shall be conducted solely by the
inhabitants of the DWELLING UNIT and comply with all criteria called out in the HOME OCCUPATION
definition above. The site shall not be accessible by the public. Signage: may consist of a maximum of
one (1) nonilluminated sign no more than one (1) square foot in size which must be attached to the face
of the DWELLING UNIT. Ordinarily, a HOME OCCUPATION — CLASS I shall include similar uses to
home office (no customers), cake decoration and internet sales, etc. A day care home (eight [8] or fewer
children under the age of sixteen [16]) shall be considered a CLASS I HOME OCCUPATION.
HOME OCCUPATION - CLASS II: A HOME OCCUPATION - CLASS II shall be conducted by the
inhabitants of the DWELLING UNIT plus up to two (2) external employees and comply with all criteria
called out in the HOME OCCUPATION definition above. Two (2) associated COMMERCIAL VEHICLES
can be included under this application. There shall only be incidental sales of stocks, supplies or
products conducted on the premises. Signage: may consist of a maximum of one (1) nonilluminated sign
no more than nine (9) square feet in size which must be attached to the face of the DWELLING UNIT.
Does not produce traffic volumes exceeding that produced by the DWELLING UNIT by more than sixteen
(16) average daily trips, provided adequate off-street parking is provided. Please keep in mind that one
(1) vehicle produces two (2) trips, one (1)when arriving and one (1)when leaving. Therefore, an average
of only eight(S) cars can come to the property per day. Trips include those produced by the residents for
any purpose related to conducting the business, the two (2) employees, clients, deliveries related to the
business, etc. Ordinarily, a HOME OCCUPATION — CLASS II shall include uses similar to hair salon,
welding shop, tax preparation with customers, etc., provided it meets the criteria set forth.
Section 23-4-990.C.5. of the Weld County Code states, "When, in the opinion of the Department of
Planning Services, an applicant has not met one (1) or more of the standards of Paragraphs 23-4-990 D.1
through 8 and/or negative responses are received from at least thirty percent (30%) of the surrounding
property owners within five hundred (500) feet of the subject property, a hearing shall be scheduled
before the Board of County Commissioners."
This case comes before the Board of County Commissioners for the following reasons:
• The Department of Planning Services has received responses from at least thirty percent
(30%) of the surrounding property owners.

Background: The applicants are requesting approval of a zoning permit for a Home Occupation - Class
II. The applicants have been operating the business from their home without the proper
land use permits. A zoning violation under case number(ZCV13-00188) was initiated on
this site for operation of a commercial landscape business, including commercial vehicles
and outdoor storage. This case has been presented to the Weld County Magistrate
through the violation hearing process. The applicants had a pre-application meeting with
Weld County staff on June 20, 2014. At this meeting permitting options were discussed
including: the Class II — Home Occupation application and a Use by Special Review
Permit for a Home Business. Additionally, a stipulated court agreement regarding this
violation was accepted under case # 14-C-32179 by Weld County Court, Division 3 on
July 7, 2014. One of the terms of the agreement was that business reduce the number of
vehicles to two (2) commercial vehicles, remove any outside storage related to the
business and submit a Class II —Zoning Permit application to the Department of Planning
Services by no later than August 20, 2014. Based on the information provided and
subsequent discussion with staff, the applicants decided to submit a Home Occupation —
Class II zoning permit application. The application was accepted, notification of the
application was mailed to surrounding property owners and the application was sent out
for referrals. During the 28 day referral period staff was contacted by three (3)
surrounding property owners by phone expressing concern/objections to the proposed
application and to the ongoing operations occurring on the site.
Description: The proposed Home Occupation Class II application includes the following: The parking
of two (2) 2500 Dodge Ram trucks along with two (2) trailers for lawn equipment will be
located on the site. The two employees associated with the application live on the
property. The application indicates that no outside employees are proposed to be coming
to the site. The stated hours of operation are 7 am to 7 pm.
Staff received phones calls from two property owners in regards to this request and correspondence has
been received from multiple surrounding property owners indicating opposition and concern about the
business as well as support for the business. A total of six (6) responses indicated no conflicts with their
interests. Two (2) responses indicated support for the application. Thirteen (13) responses indicated
concerns or opposition to the application. Copies of the letters provided are included in the application
materials.
The following is a summary of concerns outlined in letters of opposition:
• Materials piled all over the property
• Noise from trucks
• No businesses allowed in Roth Subdivision (per covenants)
• Business has overgrown the site
• Parking of vehicles and equipment on neighboring lot
• Have been operating out of compliance for over a year
• Increased traffic on County Road 15
• Excessive Noise
• Commercial vehicles being driven aggressively on neighborhood streets
• Property looks unsightly
• Vehicles tracking mud onto County Road 15
• Rats, mice and other rodents are under pallets on the property
Filled in barrow ditch and built up property so water, mud and rocks drain onto County
Road 15
• Business is too large for the neighborhood
• Traffic safety
• Granting a Zoning Permit for a Home Business will set precedence for allowing other
business to locate within the subdivision.

The following is a summary of support for the business outlined in letters from surrounding
property owners:
• Applicants are very helpful. They helped me clean up my property.
• Very hard for small businesses to make it in this economy.
• It is a small inconvenience for the neighborhood to deal with.
• The applicants should be given the opportunity to operate.
The site is not currently in compliance with the requirements of a Class II Home Business. Staff visited the
site on October 16, 2014 and posted a hearing notice sign on the property on October 17, 2014. Pictures
of the site indicate a total of eight vehicles were parked on site — with four of these vehicles being
commercial vehicles associated with the business. In addition landscaping equipment and materials are
being stored on the site as well. A screening fence is being installed along the west property line. Staff
drove by an adjacent property to the west of the site in response to allegations that the business has
been storing equipment and vehicles on the property. There were three (3) trailers along with a backhoe
and two vehicles on this property. Staff could not verify whether any or all of these vehicles are
associated with the landscaping business. It should be noted that this lot is under separate ownership.
There is no residence on this property and storage of vehicles and equipment on this property is not
allowed. Based on my visits to the site, the property does not appear to be operating in compliance with
the stipulated court agreement and is not operating in compliance with the Class II — Home Occupation
definition in the Weld County Code.
DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE DENIED
FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-4-990.
B of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has not shown
compliance with Section 23-4-990.O.1. thru O.8. of the Weld County Code as follows:
A. Section 23-4-990.D.1 -- Compatibility with surrounding area, harmony with the character of the
neighborhood and its effects upon the immediate area.
The Department of Planning Services has received thirteen (13) responses from surrounding
property owners regarding the operation of the business. Field checks of the site indicate that
the business does not appear to be operating in compliance with the Class II — Home
Occupation requirements and is not in compliance with the stipulated court agreement. Staff
believes that the business has outgrown the site and is not concerned that the applicant will
be able to operate in compliance with the strict parameters of a Class II — Home Occupation.
B. Section 23-4-990.D.6. -- The application complies with any Homeowners Association (HOA)
standards, if applicable.
This parcel is within a subdivision (Roth Subdivision). A Declaration of Protective Covenants
for the Roth Subdivision was recorded on August 14, 1972 under reception number 1595502.
These covenants state: "residential lots shall be used for residential purposes only, except
that doctors, lawyers, architects, accountants and real estate brokers maintain professional
offices within their homes."
The Covenants further state: "These covenants are to run with the land and shall be binding
to all parties, on all persons claiming under them for a period of 10 years from the date of this
covenants' recording, after which time said covenants shall be automatically extended for
successive periods of 10 years unless and instrument signed by a majority of the then
owners of all lots in this subdivision has been recorded, agreeing to change said covenants,
in whole or part."

Staff has reviewed the Clerk and Recorders records and can find no evidence that an
instrument has been signed and recorded that removes this provision from the covenants.
There is no Homeowners Association on the site to enforce these provisions but staff has
concerns that homeowners have moved to this subdivision with the
expectation/understanding that commercial businesses of this type are not allowed in this
subdivision. Any disputes regarding operating a business not in compliance with covenants
would have to be resolved through a civil action between the individual homeowner(s) and
the lot owner/operator.
This recommendation is based, in part, upon a review of the application materials submitted by
the applicant, other relevant information regarding the request, and responses from referral
entities.
If approved by the Board of County Commissioners staff's recommendation for approval is
conditional upon Statement of Terms and Conditions and Limitations.
Permittee acknowledges that the issuance of the Home Occupation — Class II permit is conditional upon
Permittee's completion of the improvements and/or meeting of the conditions which are described below
and depicted in a set of plans provided by Permittee (herein referred to as "Plans"), a copy of which is
attached to this document and made a part hereof.
Permittee is not allowed to engage in any activity described in the above paragraph and/or any activity
related to the business(es) described above, (OR ANY OTHER ACTIVITY WHICH HAS NOT
HERETOFORE BEEN PERMITTED), until said improvements have been completed or said conditions
have been met.
A. Required Conditions: The following conditions must be met at all times throughout the existence
of the Home Occupation—Class II permit.
1. The applicant shall submit a Dust Abatement Plan, detailing on site dust control measures,
for review and approval, to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. Evidence of acceptance shall be submitted,
in writing, to the Weld County Department of Planning Services.
2. The business use of the property must be secondary to the use of the property as a
dwelling site.
3. The size of the business area is limited to fifty percent (50%) of a dwelling unit and/or in
accessory buildings with appropriate building permits.
4. The business shall be conducted by the inhabitants of the dwelling plus no more than two
(2) external employees.
5. On parcels of land less than eighty (80) acres, the number of commercial vehicles is limited
to two (2) such vehicles with two (2) rear axles. On parcels of land greater than eighty (80)
acres, one (1) tractor trailer (semi) and one (1) additional commercial vehicle with two (2)
rear axles are allowed.
6. No exterior storage of materials, goods, supplies or equipment related to the business is
permitted.
7. The business use must not create any negative impact to the public health, safety or
welfare of adjacent property owners.
8. Only incidental sales of stocks, supplies or products shall be conducted on the premises.
9. Only one sign advertising the business shall be allowed, subject to the following
restrictions:
a. Sign must be non-illuminated;
b Sign must be no greater than nine (9) square feet
c. Sign must be attached to the face of the dwelling unit.
10. The traffic volume produced by the business must not exceed that produced by the
dwelling unit by more than sixteen (16) trips daily. Trips include those produced by the

residents for purposes related to the business, the one or two employee(s), clients,
deliveries, etcetera.
11. Hours of operation are limited to hours between 7:00 a.m. and 7:00 p.m.
12. Permittee shall maintain compliance with Health, Building and all other local, state and
federal regulations.
13. The Weld County Department of Public Works may require the construction of
improvement(s), or the meeting of conditions deemed appropriate to the safe conduct of
the business.
14. The applicant shall maintain compliance with Section 23-4-950 of the Weld County Code at
all times.
15. All activity, equipment and structures related to the Home Occupation must occur on Lot 3,
Roth Subdivision — 1st Filing.
16. The zoning permit shall not be transferable by the applicant and/or owner to any successor.
The zoning permit shall terminate automatically upon conveyance or lease of the property.
17. In the event the applicant's usage of the existing septic system exceeds 6 persons per day,
the septic system shall be evaluated by a Colorado Registered Professional Engineer. The
review shall consist of observation of the system and a technical review describing the
system's ability to handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public Health
and Environment. In the event the system is found to be inadequately sized or constructed
the system shall be brought into compliance with current Regulations.
18. There shall be no parking or staging of commercial vehicles on the County roads or rights-
of-way. The applicant shall utilize on-site parking only.
19. Should noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the
noxious weeds, pursuant to Section 15-1-180 of the Weld County Code.
20. A building permit will be required for any new construction, alteration, addition or
manufactured structure on the property to be used for the Landscaping Business. Any fuel
dispensing over 500 gallons require Building Permits and Fire District notification letters,
above ground tanks and in ground tank require building permits, exception water tanks less
than 5,000 gallons. Buildings and structures shall conform to the requirements of the
various codes adopted at the time of permit application. Currently the following has been
adopted by Weld County: 2006 International Residential Building Code; 2012 International
Energy Code; 2006 International 2011 National Electrical Code; and Chapter 29 of the
Weld County Code. A plan review shall be approved and a permit must be issued prior to
the start of construction.
B. Timing of Improvements: Permittee shall be required to complete all improvements and/or meet
the limitations of the foregoing conditions within 30 days of approval of the Permit by the Board of
County Commissioners.
C. Violation of Terms: If Permittee does not perform as outlined in this document, such non-
performance will constitute a violation of Permittee's Home Occupation - Class II permit granted
by County, and County will take whatever remedial measures it deems necessary against
Permittee. In addition to any other remedy available to the County in law or equity, a failure to
meet the conditions will result in the loss of the permit and in the initiation of legal action against
the Permittee.
D. Engineering Services: In the event that Permittee is required to complete any improvements or
meet any conditions which require the services of an engineer, Permittee shall furnish, at its own
expense, all such services. The required engineering services shall be performed by a
Professional Engineer and Land Surveyor registered in the State of Colorado, and shall conform
to the standards and criteria established by the County for public improvements. The required
engineering services shall consist of, but not be limited to, surveys, designs, plans and profiles,
estimates, construction supervision, and the submission of necessary documents to the County.

E. Successors and Assigns: This Home Occupation - Class II permit may not be delegated,
transferred or assigned in whole or in part by Permittee. This Permit shall terminate immediately
upon the sale of the Property and or commercial enterprise, the cessation of the commercial
enterprise, or the death of the Permittee (if the Permittee is an individual). County's rights and
obligations under this Agreement shall automatically be delegated, transferred or assigned to any
municipality which, by and through annexation proceedings, has assumed jurisdiction and
maintenance responsibility over the roads affected by this Agreement.
F. County Engineer: All references in this Agreement to "County Engineer" shall refer to any
individual or individuals appointed by the County Engineer to act on his/her behalf.
G. Violation of Terms of Agreement: If in County's opinion, Permittee has violated any of the terms
and conditions set forth in this document, County shall notify Permittee of its belief that there have
been violation(s) and shall state with specificity the facts and circumstances which County
believes constitute the violation(s). Permittee shall have fifteen (15) days within which to either
cure the violation or demonstrate compliance. If, after fifteen (15) days have elapsed, County
believes in good faith that there has been a violation of the terms of this Agreement, County shall
initiate proceedings to revoke the Home Occupation — Class II permit.
H. Termination of Permit: A Home Occupation — Class II permit shall terminate upon the earliest of
the following events:
1) Cessation of all Permit Related Activities: Termination of the Permit shall occur upon
Permittee's complete cessation of all activities permitted under the terms of the Permit.
Permittee shall provide written notice to County of a cessation of activity, which County shall
then verify. If written notice is not provided to County, termination of the Permit shall
occur three (3) years after County observes the cessation of the activities for which the
Permit was issued.
2) Execution of Replacement "Home Occupation — Class II Agreement": The Agreement shall
terminate following County's execution of a new Home Occupation— Class II Agreement with
a new Permittee who has purchased or then inhabits the Property, and intends to make use
of the rights and privileges available to it through the then existing Home Occupation — Class
II permit.
3) Sale or Transfer of Property and/or Commercial Enterprise: The Permit shall immediately
terminate upon Permittee's sale or transfer of the property upon which the commercial
enterprise is conducted. The Permit shall also terminate immediately upon Permittee's sale or
transfer of the commercial enterprise.
Governmental Immunity: No term or condition of this agreement shall be construed or interpreted
as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other
provisions, of the Colorado Governmental Immunity Act §§24-10-101 et seq., as applicable now
or hereafter amended.
J. No Third Party Beneficiary Enforcement: It is expressly understood and agreed that the
enforcement of the terms and conditions of a Home Occupation — Class II permit, and all rights of
action relating to such enforcement, are strictly reserved to the County.

2. The property is on the edge of Roth subdivision out in the country. It is Windsor
unincorporated. We are near a lot of agriculture and we are very similar to agriculture.
3. rezoning this property isn't going to change anything around it or within this property. There
are several properties in this area that have lawn equipment and trucks.Across the street is
several areas of farm that they drive there tractors up and down the street all the time, my
equipment fits in well. And the zoning for a small landscape business fits within the agriculture;

11. Baby Blue Eyes spruce trees along the north property line as per map. Drainage will be a
swale dug out along the width of the rock drive, to the shop. The swale will have 2"-8"cobbles
so there will be no erosion and cattle guards will be installed on top so we can drive trucks over
them. The cobble swale will lead to the culvert in the far northeast corner of the property, where
the water already naturally drains.

Environmental Health Services has reviewed this proposal to allow a home business for
parking of 2 commercial vehicles for a landscaping business. The application states
there are no employees, however the map indicates employee parking. There is an
existing septic system (Permit No. G19710761) that was permitted for a 3 bedroom
residence (6 people). The septic system will require an engineer's review to ensure
there is sufficient capacity to serve the business if the daily usage exceeds 6 people.
North Weld Water District supplies water to the parcel. Gallegos Sanitation provides
trash removal. Oil, tires and batteries are recycled according to the application. An on-
site dust abatement plan shall be submitted.
The following conditions are recommended to be part of any approval:
1. In the event the applicant's usage of the existing septic system exceeds 6
persons per day, the septic system shall be evaluated by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the system's ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.
2. The applicant shall submit a Dust Abatement Plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services
Division of the Weld County Department of Public Health and Environment.
Evidence of acceptance shall be submitted, in writing, to the Weld County
Department of Planning Services.

Upon review of my case files and computer, an active Zoning Violation (ZCV13-00188)was noted. This
violation was initiated due to the operation of a commercial landscape business, including commercial
vehicles and outdoor storage without first completing the necessary Weld County Zoning Permits. This
case has been presented to the Weld County Court Magistrate through the Violation Hearing process.
Since this application was submitted after the case had been set up through the court process an
investigation fee IS required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staffs policy to no longer accept staff initiated complaints.
If this application if approved and the outdoor storage removed, the zoning violation will be corrected. If

CR 15 is a collector road and requires an 80-foot right-of-way at full build out. There is
presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90required setback is measured

I am Jerry Offenbacker: I live at 36883 wcr 15 Windsor,Co,next door to the Property in Question.
When I called this spring-my question to the County was--What were the rules and regulations about
Overhead Fuel Tanks in a residential location. At this time the Person to whom I spoke questioned me
about the application of what was going on next door.At this time I was informed that no businesses
were allowed in the Roth Sub Division. I have lived here at this address since 1980 and was never told
that this was residential only—no businesses. Understood we were listed as agricultural as far as
animals,etc was concerned.
On this day In question I want it understood I didn't call complaining about Walker and his business,only
wanted to know if fuel tanks were allowed in our Sub.Division.°I didn't want 300 gal.of fuel within
150feet of my house".As far as the county rules and regs.of businesses in Residential Areas,that is for
the County to Regulate and Control as the Law will allow.
When Walker moved onto the property he came with a small landscaping business,as I remember he
had a couple of Pickups and 2 16'trailers with lawn mowers and sprinkler service equipment,that was
about 7 years ago,since then the business has grown into a full service business,with 7 to 12 employees
at given times,stock piles of landscaping and equipment able to handle big boulders as needed,etc.
The business has well overgrown the size of the location, has to park some of the vehicles and
equipment on the neighbors spare lot. This operation at this location has done nothing to benefit the
values of adjacent properties.
I have no personal Vendetta against Mr Walker as a neighbor,but the business is getting out of hand
and needs to be relocated.Come and look for yourselves-I think you will agree something needs to be
done.
Equipment housed there consists of: 1 Dump truck and dump trailer,2 16'ft flat trailers,2 18'enclosed
trailers,1 Ton enclosed truck for sprinkler service,1 Bob-Cat,3 pickups,multitude of mowers,ditchers,
weeders,etc. All kinds of sprinkler hose stock,decorative rock,boulders,landscaping timbers,etc.
FOOT NOTE;
Since I raised the question about Fuel Tanks being allowed I have been accused of causing Mr Walker a
"Problem". I want to be very clear on this matter--It would seem to me if you were moving from
La rimer County to Weld County with a "business",would it not be politically correct to go to Weld
County's Planning Offices,etc.and get the low down on what you have to do to comply with the Rules
and Reg.in Weld County? Don't just move in with Squatter Right Ideas and figure it will all work out.
So in closing, I wish Mr Walker all the success in his endeavors, but please don't blame me for your short
comings. Had you done your due-diligence before you moved in,maybe just maybe this Demise would
not have presented itself.

wanted to use the form of communication most handy to me as I take
time from my busy schedule to write you regarding a zoning variance
application in my neighborhood.
This written comment regards the application by the Walkers, case
number ZPHB14-0006.
I have reviewed the request and object for the following reasons:
• The Walkers have already been out of compliance for over a year,
and only now are they applying for a variance.
• The current violations are already beyond the parameters of the
requested variance. In other words, they already have more than
two trucks and two trailers on site.
• Their current use is well beyond that of "parking/storage." They
run the business from this location, which means trucks coming
and going each day, several times a day, storage of landscaping
materials and equipment on site, employees coming and going,
increased traffic on hwy 15, breach of the neighborhood
covenants, and the like.
• Since they are already clearly operating out of compliance, one
could reasonably assume that the owners would then exceed the
use allowed by any new variance, leading to an even bigger
operation.
• If such a variance is allowed, what is to stop every other property
along CR 15 from likewise being used/developed for commercial
purposes?
Please do not allow this variance to go through, and, furthermore,
please give the Walkers notice that, within a reasonable time frame,
they must pull back their operations, as they are currently in violation.
They will need to keep their residence as a residence, and find an
alternative location from which to run their business.
Please confirm receipt of this objection, and please let me know if you
need any additional information from me.

Walker's property ended and Weld County Ditch began.A few months later,Mr. Walker mostly
filled the ditch with dirt and landscaping and built his own property up so that the water,mud,and

In response to the Walker Landscaping Business receiving a Class II Home
Occupation Zoning Permit we object for the following reasons.
On the Weld County Planning Website we found a procedural guide for Class II
Home Occupation. Under Definition (23-1-90) item "d". It states that there shall
be no exterior storage, display or sales of materials, goods, supplies or
equipment related to the operation of such home occupation, nor of any highly
explosive or combustible materials. Currently, there is so much storage and
display of goods and equipment related to the business that the property no
longer has a residential look to it and is in violation of the procedural guide. The
visibility of the equipment and materials needs to be addressed.
The procedural guide for Class II Home Occupation under Definition (23-1-90)
item °b" also states such use is clearly incidental and secondary to the use of the
dwelling for dwelling purposes and shall not change the character thereof. Other
residences in the nearby vicinity have been impacted by the condition of the
property. If this continues it will affect property values in the area and will also
encourage other light industrial businesses to move in to a residential area.
Once you allow one business to operate like this then it will be easier for other
business to get permits also. The Walker Landscaping Business can place their
business in an area more desirable for their type of work.
There are several employees which come to work every day at the Walker
Landscaping Business. The area is a residential area with a 30 MPH speed limit
and bus stops along County Road 15. There have been many times in which the
employees have not seemed to have cared about the 30 MPH and drove fast to
arrive at work on time and left work in a hurry. This makes it a safety issue also.
The procedural guide also discusses impact to adjacent property owners under
Definition (23-1-90) item "e". The business is situated such that the mud and
water from their business drains onto County Road 15 after rain and snow
storms. This becomes a muddy issue for the road as well as a safety issue since
drivers use the opposite lane so they don't need to drive in the mud. As the area

continues to have this drainage problem then Weld County will need to supply
the funds to repair the road. If the Walker Landscaping Business would install a
wheel tracking device it would help prevent transportation of the mud and dirt
from the wheels of their vehicles onto County Road 15. The Walker Landscaping
Business would also need to provide a proper drainage swale to prevent water
running from their property onto County Road 15. This would convey the water
into the borrow ditch and prevent drainage from their lot onto the road surface to
prevent ponding of water and ice on County Road 15.
The term "parking/storage" on the letter we received is of questionable wording.
What is your definition for parking? What is your definition for storage? Storage
to us is storing a snowplow for next year. Parking is parking a truck or trailer for
a day until you use it again the next day.
The procedural guide also discusses the number of vehicles and external
employees. This will need to be enforced in order for the business to meet
compliance.
We think that this is an important decision that Weld County needs to carefully
consider. By allowing this business to gain a permit it will negatively affect the
residential area and make it easier for other residences to get Class II Home
Occupation permits for similar type work.
If Weld County grants the permit for the Class II Home Occupation for the Walker
Landscaping Business to continue to operate in its current location the items
discussed above will need to be enforced and adhered to.

We have a few other questions that we would like the Board of Commissioners to consider.
1) How many employees does Walker Landscaping currently have? According to the procedural guide there is a limit
of(2) two external employees. Who will be monitor the number of employees?
2) According to the procedural code there is a limit of two (2) associated commercial vehicles for the business. Who
will monitor this?
3) According to the procedural guide code there is a limit of sixteen (16) average daily trips for the business. Who will
monitor this?
4) Does Walker Landscaping understand that their business will not be able to grow in this location? It seems like a
different location would allow their business to grow and thrive in the area especially with all the growth in the surrounding
area.
