THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY
DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT - GORDON
WEICHEL, CIO GRADY WEICHEL
A public hearing was conducted on April 9, 2014, at 10:00 a.m., with the following present:

The following business was transacted:
E I hereby certify that pursuant to a notice dated February 28, 2014, and duly published
March 5, 2014, in the Greeley Tribune, a public hearing was conducted to consider the request
of Gordon Weichel, c/o Grady Weichel, for a Site Specific Development Plan and Use by
Special Review Permit, USR14-0001, for one (1) Single-Family Dwelling Unit per lot, other than
those permitted under Section 23-3-20.A (second single-family dwelling unit) in the
A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of
record.
e Chair Rademacher advised Grady Weichel, that, since Commissioners Conway and
Kirkmeyer are not able to attend today's hearing, he had the option of continuing this matter to a
date with the full Board present. However, if he decides to proceed today, it will require three
affirmative votes, or the matter would be deemed denied. Mr. Weichel indicated he would like to
proceed.
Ei Diana Aungst, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written for two additional dwellings on the southeast corner of the 80-acre parcel
which will be occupied by family members or caregivers, and the applicant would like to have
the option of renting these at some point in the future. She indicated no referrals expressed
concerns and no public comments were received; there will be three separate septic systems,
one for each residence. Ms. Aungst reviewed surrounding land use; the closest residence is .5
miles from the site. She showed images of the site and adjacent area and confirmed there are
no recorded exemptions on the property at this time.

E Don Carroll, Department of Public Works, provided a brief overview of the transportation
plans and requirements, as well as traffic counts. He said approved access is off of CR 22, and
the access comes across another parcel owned by the applicant, so staff is requesting a 30-foot
easement on that property.
El Lauren Light, Department of Public Health and Environment, reviewed the water and
sewer provisions. She said the only condition from staff is a certificate of occupancy regarding
the septic system.
ID Mr. Weichel, applicant, stated that they are demolishing an existing residence and building
a shop and a house/apartment for his son and daughter-and-law to live in.
No public testimony was offered concerning this matter. ID Mr. Weichel requested time
to consult with other family members about the location of the easement. In response to Chair
Rademacher, he indicated he has reviewed, and agrees to abide by, the Conditions of Approval
and Development Standards, as amended. Mr. Carroll noted they can set up two easements, if
they so wish.
El Commissioner Garcia moved to approve the request of Gordon Weichel, c/o Grady
Weichel for a Site Specific Development Plan and Use by Special Review Permit, USR14-0001,
for one (1) Single-Family Dwelling Unit per lot, other than those permitted under Section 23-3-
20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Freeman, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:15 a.m.
This Certification was approved on the 14th day of April, 2014.
