I discussed your proposed changes with our Land Manager, Pam Kingery and our Operations
Manager, Mark Brown. Both have reviewed and we are okay to waive your 30 day notice. Bayswater
Exploration & Production, LLC hereby officially approves of your plans to make the Lot changes per
the maps you sent to me on May 9th, which correspondence is attached for reference. I have also
included Kim Ogle on this email so Weld County is aware of our decision and that you no longer
need to wait the full 30 days. Let me know if you need anything else or if we need to sign a waiver
letter to make it official. If so you can send it via email to me and I will circulate for signatures.

I reviewed the plans and made my suggestions after talking with our Ops Engineer yesterday.Just to
clarify nothing is changing on the 21.493 acre LOT 5 parcel on the North side of the map. Just Lot 1
on the East side and Tract A on the south west corner correct?If so I don't foresee an issue but
we're taking into consideration the proposed setbacks to be voted on in this November's ballot and
the distance these changes are to our existing location. I sent my recommendations up the chain
late yesterday afternoon and should hear something back today. I will let you know immediately
when I hear back.

Pete,
Just so I can run this by our engineers and get approval to waive, can you send me the proposed lot
changes.
Our biggest concerns at this point are the 500' setbacks from current and future potential wells as
well as the 1000' buffer for potential "Urban Mitigation Requirements" with any future work
performed. If I know specifically how you're splitting up the lots and roughly where the proposed
building envelopes will be it will help me out a ton in getting approval from the engineers. I'm
unsure of our future plans of development from the existing pad site just on the other side of the
section line but will discuss it with the engineers as well. Shooting from the hip I don't foresee any
problems with our current HZ drilling program and your development of the acreage but I'll need to
clear that with the engineers.
Do you mind sending me copies of the proposed I..ot change maps?

I received a letter from the Clerk of the Board about a Commissioner meeting. That's great news,
but I think we have a problem. I wasn't aware that I needed to send the oil and gas notification
letters out. I had eye surgery about 3 weeks ago for a detached retina and it has been difficult to
read . All the mineral rights have been leased to Bayswater a couple of years ago and they are
pumping oil . So, my friend, what do I need to do? Tried to contact you yesterday afternoon during
the tornado warning, but the phone went unanswered. Basement?
