Engineering Development Review has reviewed this proposal. This project falls under the Use by Special
Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments
made during this phase of the Use by Special Review process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
This project is west of CR 105 and north of CR 74. Parcel number 071933000002. Access is from CR 74.
An access permit has been approved for the access to the site (AP14-00037).
This project was constructed previously to test the capabilities of the ground water well. It was shown to
be sufficient so the applicant is now going through the USR process to utilize it.
The applicant anticipates that no full time employees on site. Daily site traffic consists of 15 truck trips per
day and 1 maintenance vehicle. Much of the water is anticipated to be piped to local wells.
Tracking control is required to prevent tracking from the site onto the County Roadway. Standard
tracking control for accesses onto gravel roads includes double cattle guards at the access point.
Alternatives such as recycled AC, recycled concrete, or gravel may be considered with lighter traffic
impact projects.
A Weld County grading permit (GRD12-00037) was issued for the temporary activities. If additional work
is required which creates more than 1 acre of disturbance then a new grading permit will be required.
A Construction Stormwater Permit is required with the State for disturbing more than 1 acre. Contact:

Improvements/Road Maintenance Agreement: A draft of the agreement will be provided to the applicant
after approval of the application at the BOCC hearing. An example agreement is available at:

c An Improvements Agreement is required for sites with required offsite improvements. Collateral
is required to ensure the improvements are made.
o Road Maintenance will be included as a section of the Improvements Agreement when the
County feels that the site activities may impact the County roadways. Possible mitigations
included in the road maintenance agreement may include but are not limited to: dust control,
specified haul routes, damage repairs, and future improvement triggers.
A drainage narrative and water quality calculation was submitted on July 25, 2014. This narrative is
acceptable by Engineering Review.
Erosion drawings were previously submitted during the temporary operations for the GRD12-00037
grading permit.

CONDITIONS OF APPROVAL/REQUIREMENTS:
Prior to recording the plat:
A. An Improvements Agreement and Road Maintenance Agreement is required for this
site. Road maintenance including dust control, damage repair, and triggers for
improvements will be included.
The plat shall be amended to delineate the following:
1. County Road 74 is designated on the Weld County Road Classification Plan as a
gravel local road, which requires 60 feet of right-of-way at full build out. The applicant
shall verify the existing right-of-way and the documents creating the right-of-way and
this information shall be noted on the plat. All setbacks shall be measured from the
edge of future right-of-way. If the right-of-way cannot be verified, it shall be
dedicated. This road is maintained by Weld County.
2. Show the approved access on the plat and label with the approved access permit
number AP14-00037.
3. Show and label standard tracking control onto publically maintained roadways on the
map.
4. Label the water quality feature on the plat as "Water Quality Feature, No
Build/Storage Area" and label the required volume.
5. Show the drainage flow arrows on the plat.
Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction. In the event that 1 or more acres are disturbed, the applicant shall
obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado
Department of Public Health and Environment.
B. Right of way permit is required for any work within the public right of way.
C. Special transport permit is required for any over size or over weight vehicles.
DEVELOPMENT STANDARDS/NOTES ON THE PLAT
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility including an oil and gas support and service (water hauling) in the
A (Agricultural) zone district.
The application included a well permit which provides water to the reservoir. Well permit
76687-F is permitted for industrial, commercial, irrigation and livestock watering.
The application states a maximum of 40 trucks per day could utilize the site.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Portable toilets and bottled water from a commercial source are allowed
in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this Department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The dust abatement plan states the main access drive, circulation area and loading
area are constructed of road base. Vehicle speeds are limited and if necessary water
will be utilized to control dust.
The waste handling plan states that Waste Management will be utilized to collect and
dispose of waste.
We have no objections to the proposal; however, we do recommend that the following
condition be part of any approval:
We recommend the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved Waste Handling Plan, at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved Dust Abatement
Plan, at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Non Specified Zone as delineated in Section 14-9-30 of the Weld County
Code.

6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets are
acceptable. Records of maintenance and proper disposal for portable toilets
shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. The fresh water storage and loading system shall be operated in a manner to
minimize spills. Fresh water spills should be captured in above-ground
containment areas for reuse or allowed to infiltrate. There shall be no discharge
from this process to surface waters or through the facility's stormwater
management system, in accordance with the Rules and Regulations of the
Colorado Water Quality Control Commission, and the Environmental Protection
Agency.
8. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV14-00129)was noted. This
violation was initiated due to the presence of a water hauling and trucking operation without first
completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld
County Court Magistrate through the Violation Hearing process. Since this application was submitted prior
to an actual court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
If this application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, all water hauling and trucking operations
shall be removed from the property within 30 (thirty) days of denial or the violation will proceed in court
accordingly.

A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any
new structures ,additions or renovation to any structures. A building permit application must be completed
and two complete sets of engineered plans. MSDS sheets for all materials stored shall be submitted with
building permit applications.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2012 International Building
Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel
Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1

which is incorporated herein and made a part of these Rules and Regulations by reference, and all other

Dear Ms. Aungst:
The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the
referral information and provide comments. The comments will not address the adequacy of the
water supply plan for this property or the ability of the water supply plan to satisfy any County
regulations or requirements.
The applicant is seeking a Site Specific Development Plan and Use by Special Review (USR)
permit for a mineral resource development facility on a parcel of approximately 320 acres. The
facility is described as a water well storage and water load-out facility to support oil and gas
operations, known as the Weitzel Sec 33 Water Facility. The property contains an 80,000 barrel
capacity reservoir with three truck filling bays. This USR is requested to allow a change in use from
the storage pond originally used for water distribution by pipe to allow truck hauling operations when
needed.
The site is anticipated to be accessed by approximately fifteen water haulers and one
employee per day. The facility will not have any full-time employees onsite; therefore potable
water will not be provided at the site. Portable toilet facilities will be available at the site.
The proposed source of water to fill the onsite storage pond an existing well, permit no.
76687-F, producing from the Pawnee aquifer pursuant to Division 1 Water Court case no. 2011CW240.
The average annual amount of ground water that may be withdrawn by well permit no. 76687-F in
combination with all other wells permitted pursuant to case no. 2011CW240 is limited to 2,268 acre-
feet. The permitted use of the well is commercial, industrial, irrigation, and stock watering, which
appears consistent with the proposed uses.
