WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Weld County Disposal, Inc. , c/o James W. Smith, Ground Floor, Bass Building, Enid, Oklahoma 73701 , has requested permission to amend Special Use Permit 319 : 79 :24 for an oilfield fluids recycling and disposal site on a tract of land described as follows: That part of the Northwest one-quarter Northwest one-quarter Section 12 , Town- ship 1 North, Range 66 West of the 6th Principal Meridian, Weld County, Colo- rado, described as: Beginning at the Northwest corner said Northwest one- quarter Northwest one-quarter; thence South 89°55 ' 41" East on an assumed bearing along the North line said North- west one-quarter Northwest one-quarter a distance of 1259 .89 feet to a point 50 . 00 feet West of the Northeast corner of said Northwest one-quarter Northwest one-quarter; thence South 00°21 ' 56" West parallel with the East line said Northwest one-quarter Northwest one- quarter a distance of 1333 . 30 feet to a point on the South line said North- west one-quarter Northwest one-quarter; thence North 89°57 ' 04 " West along the South line said Northwest one-quarter Northwest one-quarter a distance of 1263. 39 feet to the Southwest corner said Northwest one-quarter Northwest one-quarter; thence North 00 °30 ' 56" East along the West line said Northwest one- quarter Northwest one-quarter a distance of 1333 . 83 feet to the point of beginning. WHEREAS, the Board reviewed the testimony of the applicant and of all others present, and reviewed the recommendations of the Weld County Planning Commission, and having been fully informed, is satisfied that the request to amend Special Use Permit 319 : 79 : 24 should be approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Special Use Permit 790 393 319: 79 : 24 of Weld County Disposal, Inc. be, and hereby is, amended for an oilfield fluids recycling and disposal site as set forth in the recommendations of the Weld County Plan- ning Commission and is subject to the development standards contained in the Special Use Permit. BE IT FURTHER RESOLVED by the Board that the findings of fact and reasons for approval contained in the Planning Commission recommendations dated September 18 , 1979 be, and hereby are, adopted by the Board of County Commissioners. Mom Honn reviewed the Planning Commissions favorable recommendation -and related development standards. James W. Smith, owner of Weld County Disposal, Inc. was present and answered questions. Colorado Division of Wildlife representative Thomas Lynch, presented to the Board three photographs of the existing special use permit facilities. Mr. Lynch testified to the Division of Wildlife' s findings of oil-soaked waterfowl in this area since the inception of said special use permit. The Division recommends that all pits and/or ponds be covered with wire mesh to prevent waterfowl gaining access to them. CHANGE TAPE #79-138 Further testimony in opposition to this request was given by those present. Following discussion Commissioner Steinmark made a motion to approve this request subject to the development standards with the exception of #8 being amended to read all pits and/or ponds to be screened with one-inch wire mesh. Commissioner Roe seconded the motion. The motion failed by the following vote: Commissioners Steinmark and Roe voted aye and Commissioners Kirby, Dunbar and Chairman Carlson voted nay. A motion was made by Commissioner Kirby and seconded by Commissioner Dunbar to approve the request with the development standards as recommended by the Planning Commission. The motion carried by the following vote: Commissioners Kirby, Dunbar and Chairman Carlson voted aye, Commissione s Steinmark and Roe voted nay. For the past two years dead, oil-soaked waterfowl have been found in, around, and on the old pond which is apparently abandoned at the present time. During the migration period, 31 birds were picked up at one time. This is the pond which has been recently covered with dirt. As recent as September 17, 1979, pond #4 was full of water and had -an oil cover of approximately 35 percent of the surface area. Pond #2 has apparently just recently been rebuilt. Neither of these ponds has any protective screening in place. We recommend that no permit be granted because of past performance by Weld County _Disposal, Inc. , -and that the current operation be serminated. The fall migration of waterfowl makes it imperative that action be taken immediately. BOX Roc BRIGHTON, COLORADO 439 August 28, 1979 Weld County Planning Board Weld County Courthouse Greeley, Colorado 80631 Dear Sirs: At your Board meeting August 21, 1979, Cecil King and Lewis Hiller, directors of The Fulton Irrigating Ditch Co. , were present to voice their objections to the oil well disposal or leech field owned by Stan Rech on the SWy of Section 22, Township 2 North, Range 66 West on land formerly owned by Adolph Anderson, one mile north and two miles east of Fort Lupton. We are fearful of a similar incident which occurred the week of August 13, 1979, when a similar disposal pond released oil waste into the Speer Canal. The Fulton Canal carrying water to several thousand acres of land owned by Weld County farmers flows through Section 21, less than a mile west of the disposal pond. Any overflow or seep from the pond will pollute the waters of Fulton and damage farm lands. The oil field fluids recycling and dispos-al site granted by this Special Use Permit on the hereon described parcel is limited to the facilities shown hereon. Said facilities shall be: a. A 14' X 60' structure built in accordance with the requirements of the Uniform Building Lode and utilized as an -office and a residence by an employee for control , operation, and security of the facility; b. Three 300 barrel tanks; c. One circulating pump and motor d. One 8' X Z0' heat and filtering vessel ; and e. Three bentonite sealed earth pits. Addtionally, all _uses permitted by right in Section 3.3 of the Weld County Zoning Resolution are allowed within the Special Use Permit area. 2. Access to the Special Use Permit area is limited to the one access point shown hereon. All private interior roads shall be graveled. 3. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 4. Representatives -or members of the Weld County Health Department shall tie -gr-anted access onto the site at any reasonable time in order to in- sure the operations carried out on the site comply with all applicable Weld County and State Health -Regulations. 5. Upon cessation of operations at the site all structures shall be re- moved to 30" below grade -and all ponds or pits shall be filled and graded so as to conform with the surrounding terrain. All mud from reserve pits will be pumped into pit #3, and when possible, can be reused for drilling of now wells. These oil field fluids will be hauled in by trucks and pumped into 300 barrel tanks. These tanks are connected to the heating, seperating and filtering system that is located in the 8 x 20 heater treater located 100 feet east of the tanks. The heater will returnclean water to pit #1 and all foreign matter back to clean tank. Pit #1 is just a safety feature and the water from it will be pumped from pit #1 to pit +2. This will be pumped by electric motor and centrifical pump. The water out of pit +2 will be pure enough to be used for treating wells and drilling rigs. Our plans now are to use some of this water to irrigate alfalfa on the rest of our acerae'e. STATEMENT OF INTENT The operation to be conducted on this site shall be an oil field fluids recycling and disposal system, consisting of 3 - 300 barrel steel tanks in which fluids shall be deposited and then transferred by pipe line and pump to an 8' x 20' heating, treater and filtering vessel that will separate the hydrocarbons and the water. The -hydrocarbons will then be returned to one of the tanks for re-use and/or marketing. The water will be deposited into Pit #1 which shall be a 60' x 100' sealed open pit. This water shall then be transferred as pure grater to Pit #2 for FF use in oil well drilling, or to be applied to the adjacent lands en the site as irrigation water. lit #1 shall further serve as a safety feature so that if the treater filter vessel should malfumetlhyhydreearbons would be trapped and recycled into the tanks and through the vessel for proper processing. Pit #3 shall be located South of Pit #2 and will be used solely for the storing of oil well drilliegn ad to be used in oil well drilling or for lining and sealing of drill ponds. The 14' x 60' building shall be a UBC structure used as an office and living quarters for a 24 hour security guard. Employees will number two or three with one man on site 24 hours a day for security purposes, and one er tiro men working varied shifts as the need dictates. The vehicle traffic will range from 0 to 25 tank trucks per day depending upon the volume of drill activity in the area. There will be no oil field drilling equipment stored on the property. Parking will be provided for employees and trucks leading and unloading. All on site roads will be graded and gravel surfaced. Pits 1 and 3 will be screened with • one inch -wire mesh to prevent migratory game fowl from lighting thereon. Oil field fluids will provide a minimum amount of odor either in storage er in processing. The noise level will be dictated by the trucks entering and leaving the site. Domestic water for use in the office/dwelling shall be from a private domestic well to be drilled on -site and sewage disposal shall be by private system, both-meeting the standards -of the Health Department of Weld County. FENCING The site shall have a four wire barbed wire fence around the perimeter with a livestock crossing at the entrance with an additional security gate. We will not object to the four strand barbed wire fence across the Speer Canal provided there is installed a 16 (sixteen) foot gate at each location where the fence is to crows the Speer Canal. These cotes must be on the low side bank for access for our Ditchriders. ie will not require gates on the high side bank if we can -have in writting, permission to go through the proposed site inside the fence to maintain or clean the Speer Canal if neccessary. 2. If the above mentioned fence is to keep cattle out , then there must be installed a free swinging metal cattle shield at each location where the fence crosses the canal. This will allow the water and weeds to move down the ditch with no obstruction. 3. On October 15, 1976 I inspected the site for the Oil Field Fluids Recycling facility at the Corner of County road 12 and County •road 35 in Weld County. The legal description is NW—i of NW+ of Section 12, Township 1 North, Range 66 W of the 6th P. M. It will consist of about 38 2/3 acres of land. The area is presently in an advanced state of "go back" from having been broken out to farm. The soil is very sandy on top and appears to have had blowing problems in the past. As of now it is covered with mostly annual weeds and a fairly good stand of sandsage. As far as wildlife is concerned there will not he too much effect, as the area appears to be extremely dry. Even the sunflowers are extremely sparse and very small, so it is doubtful if even doves would use it for a feeding area even though trees and water are available on/u short distance away. It no doubt has small rodents, but that would be about it. • My main concern here would be that any and all tanks which will have or might have any oil at any time, should be protected from migratory birds, either waterfowl or shorebirds. Therefore, I would recommend these open tanks be protected by woven wire or poultry netting, both from above and a side approach. The oil and gas lease operators use a screen type cover for this purpose. The purpose of the cover is to prevent wildlife, particularly migratory birds, from getting into any hydrocarbon substances. They are deep soils that have a permeability rate of 6.0 to 20 inches per hour. The shrink swell potential and risk of corrosion to concrete is low. 4, Wind erosion is a hazard on these soils. The use of these soils for sewage disposal systems have severe limitations due to high seepage. You have indicated that the lagoon will be lined with impervious material. Mr. Schaefer explained that the ditch is on his property, he runs his own water in it, and he could see no reason why he couldn't do it. Gary Fortner explained that when Gil Olson, County Engineer went out to inspect the problem, he saw part of the county right-of-way being used as more or less a particular route from the access on one side to the access on the other side. Mr. Heitman explained that if you took the dedication of that road, the width of the road that is dedicated, that P1r. Schaefer was probably driving on part of the county dedication. Mr. Schaefer stated that that ditch is covered up and is on his property and it is his ditch. Sears stated that there was a definate problem in the disposal and storage of oil drilling fluids. He explained that this would be a service that is badly needed- in the county. Tom Honn read the recommendations of the staff as follows: The Weld County Planning Commission staff recommends that this request be approved for the following reasons: (1 ) It is the opinion of the Planning Commission staff that this proposed facility is in compliance with the provisions of Section 3.3(E) (2) of the Weld County Zoning Resolution. The proposed use will be compatible with the surrounding area, in harmony with the character of the neighborhood and existing agricultural uses, compatible with future develop- ment in the area, and will not adversely affect the health, safety, and wel- fare of the inhabitants of the area and the County for the following reasons: (a) Adverse impacts on the surrounding environment appears to be minimal since the pits shown on the plans shall be sealed with bentonite to prevent seepage and possible contamination of ground water resources in the area. (b) The Weld County Health Department has recommend approval of this request in- dicating the proposal is in compliance with all applicable Weld County and State Health standards and regulations, and that ground water resources will not be adversely affected if the plans are carried out as specified. (c) Pits 1 and 3 as shown shall be screened with a 1" wire mesh to prevent the landing of water fowl and their contamination by hydrocarbons as requested by the State Division of Wildlife and the Colorado Oil and Gas Conservation Commission. (d) The Ft. Lupton Fire District has indicated they have no objections to the proposed operation. (e) The Weld County Engineering Department has indicated that there are no engineering problems with the application as proposed. DEVELOPMENT STANDARDS: (1 ) The oil field fluids recycling and disposal site granted by this Special Use Permit on the hereon described parcel is limited to the facilities shown hereon. Said facilities shall be: (a) A 14' X 60" structure built in accordance with the requirements of the UBC as an office and a residence by an employee for the control , operation, and security of the facility; (b) Three 300 barrel tanks, (c) one cirulating pump and motor; (d) One 8' x 20' heat and filtering vessel , and (e) Three bentonite sealed earth pits. Additionally, all uses permitted by right in Section 3.3 of the Weld County Zoning Resolution are allowed within the Special Use Permit area. (2) Access to the Special Use Permit area is limited to the one access point shown hereon. All private interior roads shall be graveled. (3) The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. (4) Representatives or members of the Weld County Health Department shall be granted access onto the site at any reasonable time in order to insure the operations carried out on the site comply with all applicable Weld County and State Health Regulations. (5) Upon cessation of operations at the site all structures shall be re- moved to 30" below grade and all ponds or pits shall be filled and graded so as to conform with the surrounding terrain. The Special Use Permit area shall be reclaimed to a farmable state upon completion of the operations. The property shall be seeded in wheat or alfalfa. (6) Storage of oil field drilling and associated equipment shall not be permitted within the Special Use Permit area. (7) Pits #1 and #3 as designated hereon, shall be screened with a one inch wire mesh to prevent water fowl from landing thereon. (8) The Special Use Permit shall be limited to the plans submitted and governed by the development standards stated above and all applicable Weld County Regulations. Any changes to the Special Use Permit plans and/or development standards shall require approval of another Special Use Permit before such changes shall be allowed. Glenn Paul from County Health Department stated that he highly recommended approval of this request. The site is located approximately one-half mile south of S.H. 52 on Weld County Road 35. Although the proposal is not adjacent to a State Highway, it will have an effect on the turning movements onto and off of S.H. 52 from County Road 35. The Division would request that Weld County give due consideration to having the developer construct accel/decel lanes on the south side of S.H. 52. These lanes should be 12 feet wide with a four-foot shoulder and be a minimum of 300 feet in length, including 100 feet of taper. Asphalt surface should be three inches in thickness, and the base and shoulder should be a minimum of 12 inches in depth. Turning radii should be a minimum of 50 feet, measured at the edge of the roadway. A permit will be required to construct the above. Issuance of this permit will require a letter describing the work to be done. The permit is issued through Mr. Dave Fraser, District Maintenance Superintendent, P. 0. STATEMENT OF INTENT The operation to be conducted en this site shall be as oil field fluids recycling and disposal system, consisting of 3 - 300 barrel steel talks in which fields shall be deposited and then transferred by pipe line and pump to an 8' x 20' heating, treater and filtering vessel that will separate the hydrocarbons and the water. The hydrocarbons will then be returned to else of the tanks for re-use and/or marketing. The water will be deposited into Pit #1 which shall be a 60' x 100' sealed open pit. This water shall then be transferred as pure water to Pit #2 for u se in oil well drilling, or to be applied to the adjacent lands on the site as irrigation water. Pit #1 shall further serve as a safety feature so that if the treater filter vessel should malfuaetlEsphydrecarboss would be trapped and recycled into the tasks and through the vessel for proper processing. Pit #3 shall be located South of Pit #2 sad will be used solely for the storing of oil well drillinroud to be used in oil well drilling or for lining and sealing of drill pods. The 14' x 60' building shall be a UDC structure used as an office sad living quarters for a 24 hour security guard. Employees will number two or three with one man on site 24 hours a day for security purposes, and one or VIA sea working varied shifts as the need dictates. The vehicle traffic will range from 0 to 25 teak trucks per day depending upon the volume of drill activity is the area. There will be no oil field drilling equipment stored en the property. Parking will be provided for employees and trucks loading and unloading. All on site roads will be graded and gravel surfaced. Pits 1 and 3 will be screened with a one inch wire mesh to prevent migratory game fowl from lighting thereon. Oilffield fluids will provide a minimum amount of odor either in storage or in processing. The noise level will be dictated by the trucks entering and leaving the site. Domestic water for use in the office/dwelling shall be from a private domestic well to be drilled on site and sewage disposal shall be by private system, both meeting the standards of the Health Department of Weld County.
