WHEREAS, it has been determined by the Board of County Commis-
sioners, Weld County, Colorado, that Frank Hepp and Emma Hepp, of Weld
County, Colorado, are the owners of a parcel of land described as follows:
A tract of land located in the SW4, Section 27, Township
one (1) North, Range 68 West of the 6th P.M„ Weld
County, Colorado, more particularly described as follows:
Beginning at the southwest corner of said Section 27, con-
sidering the west line of the SWI, said Section 27, to bear North
0000'00" East with all other bearings relative thereto;
Thence North 0°00'00" East along the west line of the SWI,
said Section 27, a distance of 906. 22 feet to a point;
Thence North 90°00'00" East, a distance of 322. 38 feet to the
intersection with the westerly right-of-way line of the 50-foot
Community Ditch, as constructed;
Thence North 19°36'30" East along the said west right-of-way
line, a distance gf 147. 49 feet to a point;
Thence North 24 08'45" East along the said west right-of-way,
a distance of 99. 79 feet to a point of curve;
Thence on a curve to the right, having a radius of 286.48 feet and
a central angle of 29°20'30" along the said west right-of-way, a
distance of 146. 71 feet to a point of tangency;
Thence North 53°29'15" East along the said west right-of-way
line, a distance of 118. 25 feet to the intersection with the north
line of the SZ, SW4, said Section 27;
Thence easterly along the said north line a distance of 2, 052. 72
feet to the intersection with the east line, SW4, said Section 27;
Thence southerly along the said east line a distance of 1, 324. 07
feet to the south quarter corner of said Section 27;
Thence westerly along the said south line, SWI, said Section 27,
a distance of 2, 645. 08 feet to the point of beginning.
The south and west 30 feet of the described parcel shall be for
County Roadway purposes, said parcel containing 76. 42 acres,
more or less, which acreage shall include the south and west 30
feet for County Roadway.
WHEREAS, the Hepps are desirous of selling a 1. 76 acre parcel of the
above described real property, and keeping the balance unto themselves, and
WHEREAS, it appears that to accomplish said sale, the Hepps may
apply for a Recorded Exemption from the Subdivision Regulations of Weld
County, as the same is defined in Section 9-4 of the Weld County Subdivision
Regulations, and
WHEREAS, in addition to evidence presented by the Hepps, the Weld
County Planning Commission staff has presented evidence and made representa-
tions concerning the desirability of granting said variance, and
WHEREAS, the Board of County Commissioners feels that when all the
evidence and representations are considered, good cause for granting said
variance of up to 1. 76 acres, more or less, from the minimum lot size re-
quirements of the Weld County Zoning Resolution has been shown.
NOW, THEREFORE, BE IT RESOLVED, that pursuant to the powers
granted to the County under Chapter 106 CRS 1963 and Section 9-4A (6), Weld

County Subdivision Regulations as amended; that Frank Hepp and Emma
Hepp are granted a variance of 1. 76 acres, more or less, from the lot
size requirements of the Weld County Zoning Resolution,
BE IT FURTHER RESOLVED, that this variance is allowed so that
Frank Hepp and Emma Hepp may proceed to apply for a Recorded Exemption
and the lot size variance is conditioned of Frank Hepp and Emma Hepp
applying for and doing all necessary to obtain said Recorded Exemption
within 1 year, and said variance is limited to Frank Hepp and Emma Hepp,
and will terminate if they sell or otherwise discontinue their interest in the
above mentioned Recorded Exemption.

Dear Sirs:
The enclosed letter and other materials refer to the request by Charles P.
and Cheryl A. Hepp for a Lot Size Variance on the farm belonging to Mr. Hepp's
parents, Frank and Emma Hepp. The farm is approximately 76 acres, irrigated,
located in the SZ of the SW4 of Section 27, T1N, R68W of the 6th P. M. , Weld
County, Colorado.
The Hepps request a Lot Size Variance so that they may apply for a Recorded
Exemption involving a 1 .76 acre parcel and the remainder of the farm. The
1 .76 acre parcel is intended as their homesite.
Please note that Recorded Exemption #22 was granted to Leroy J. Baker, James
W. Hepp, and Johannes Lauer, Jr. , on February 21 , 1973. The property described
in that Recorded Exemption is adjacent on the north side to Charles and
Cheryl Hepp's proposed homesite and was once part of the parents' farm.
At the time of R. E. #22 the entire 80 acre farm was not included in the
legal description, although that instrument recorded under Reception Number
1597179, Sept. 8, 1972, indicates that the conveyance from Frank and Emma Henn
to Leroy Baker and James Hepo, took place after August 30, 1972, the effective
date of Senate Bill 35.
Staff comments regarding RE-22 state that the various conveyances involving
the Hepps, Leroy Baker, etc. , "do not constitute the creation of any new
parcels, but rather the addition to existing parcels from neighboring ones. "
While at this time there are some questions concerning that earlier staff
comment and the plat of RE-22, the Planning Commission staff recommends
approval of this Lot Size Variance for the following reasons:
1 . During the two and one-half ,years since RE-22 was approved,
James Hepp and Leroy Baker have built homes on the two
lots created then.

2. The 1 .76 acre parcel proposed as a homesite by Charles and
Cheryl Hepp is the only remaining portion of Frank and Emma
Hepp's farm located west of the ditch and, therefore, cut off
from the body of the farm.
3. The intent clause for Recorded Exemptions. Section 9-2 of
the Weld County Subdivision Regulations, has been satisfied
because non-productive agricultural lands may be developed
for higher or more productive uses, and because the pro-
posed use is compatible with surrounding agricultural uses.
4. Proof of availability of domestic water and approved sewage
disposal has been submitted.

We request a lot size variance so that we may apply for a recorded
exemption.
The legal description of this parcel is a tract of land located in the
SWa, Section 27, T.1N. , R. 68W. of the 6th P.M. , Weld County, Colorado.
This small parcel , 1 .74 acres, is part of my parents farm, which is to
small to be farmed. We would like it for a building site. The ground
is separated by an irrigation ditch.
