Sailing and Joyce L. Bowles, who is the authorized agent for Dennis R. and Joyce L. Sailing, for a Recorded Exemption. The parcel in question is described as part of the SWa of Section 28, T2N, R64W of the 6th P.M. Weld County, Colorado. Said property contains 124.558 ± irrigated acres. The request is to split off a 6.440 acre parcel with improvements from the property. Based upon the information submitted, the Planning Commission staff re- commends denial for the following reasons: 1 . The proposed split does not comply with the Weld County Comprehensive Plan because it would promote non-agricultural use of agricultural land and it would encourage urban encroachment on rural land use. 2. The recorded exemption request is not in compliance with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) . Said clause states: "The intent is establishing the Recorded Exemption procedure is to provide, in accordance with the Weld County Comprehen- sive Plan, a means whereby non-productive agricultural lands may be developed for higher or more productive uses, in-so-far as such uses are compatible with surrounding agricultural uses in areas where such land divisions are proposed. (Rev. 4/17/74)" Soils in this area are Class II. The granting of the recorded exemption would allow for the conversion of productive agricultural lands since a new set of improvements would be allowed on the 118.118 acre parcel . The recorded exemption request is not in conformance with the intent clause of the Agricultural Zone District (Section 3.3 A of the Weld County Zoning Resolution) which states: "Intent - The intent in establishing the A-I Agricultural Zone District is to allow all agricultural and related uses in those areas in which agriculture is and should continue to be the predominant land use. This district is intended to discourage encroachment of incompatible uses upon the agricultural land in the district, to en- courage agricultural uses as the highest and best use of the land in the district as compared with other uses in conflict therewith, and to provide for the orderly ex- pansion of urban growth in conformance with the Weld County Comprehensive Plan." The request would not be encouraging agricultural uses as the highest and best uses, it would not be providing for the orderly expansion of urban growth, and it would be breaking up a large block of agricultural land. Weld County Planning Co mission February I, 1976 Greeley, Colo 80631 Gentlemen: When I purchased the old Haffner farm West of Keenesburg in 1972 it was with the full intention of using the farm as my principal residence. I am no stranger to rural living - having previously owned a farm in Prospect Valley - and living at Keenesburg was compatible with my job as an equipment salesman with Moore Equip. Co. Extensive remodeling was done to the old farmhouse on the property and we moved into the house about the time the energy crisis; recession; unemployment and all the other problems seemed to strike. These rather sudden changes brought some demands from my job that required me to travel extensively and be away from home for a number of days at a time. It was during one of these times while my wife was alone that an incident occurred which caused me a great deal of concern. While alone in the house, an individual who appeared to be under the influence of drugs or alcohol attempted to get into the house and it required the assistance of the Weld County Sheriff to arrest the party. This in the summer of 1975. My job demands still require me to travel and be away from home. I do not feel that I can ask my wife to continue to stay alone after the incident described. The investment in the house is such that we would not want to rent the property. The present farm tenant has his own new home and he would not want the use of the house. I am well satisfied with my tenant and would not want to take the farm away from him just to get someone elsenlive in the house. Therefore, until the economics change and I could be at the farm, I feel I have no choice but to provide a home in town for my wife. I therefore wish to sell the improvements and retain the farmground. Approximately 6 acres are required to go with the house due to location of the irrigation ditch serving the farm.
