WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of
land, being the property of Dennis R. Sailing and Joyce L. Sal-
ling, 8158 West 69th Way, Arvada, Colorado 80004 , and more
particularly described as follows, to-wit:
All that part of the Southwest Quarter (SWa) of Section
28 , Township 2 North, Range 64 West of the 6th P .M. ,
Weld County, Colorado, lying South of the Southerly
Right-of-Way Line of the Chicago, Burlington & Quincy
Railroad being more particularly described as follows :
Beginning at the Southwest Corner (SW Cor) of said Sec-
tion 28 and considering the West Line of the Southwest
Quarter (SWa) of said Section 28 as bearing North
00°00 ' 00" East, with all other beatings contained herein
relative thereto;
Thence North 00°00 ' 00" East, along the West Line of the
Southwest Quarter (SW;) of said Section 28 , 2487 .75 feet
to a point on the Southerly Right-of-Way Line of said
Chicago, Burlington & Quincy Railroad;
Thence along the Southerly Right-of-Way Line of said Chi-

Said described parcel of land contains 124 . 558 Acres, more
or less , including a strip of ground 30 feet in width along
the South and West sides of said described parcel of land
reserved for County Road Right-of-Way purposes and is sub-
ject to any rights-of-way of other easements as recorded
by instruments of record or as now existing on said parcel
of land,
does not come within the purview of the definition of the terms
"subdivision" and "subdivided lands" as set forth in CRS 106-2-33 (a)
and (b) 1963 , as amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, desires to exempt this particular division
of land upon the recommendation of the Weld County Zoning Administra-
tor for the reasons as stated and pursuant to its authority under
CRS 106-2-33 (d) , 1963 , as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Dennis R. Salling and Joyce L. Sal-
ling, Arvada, Colorado, be exempt from the definition of the terms
"subdivision" and "subdivided lands" as provided for in the new
Weld County Subdivision Regulations at Section 2-1A. , (3) , adopted
August 30, 1972 , as amended.

Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Philip G. Bowles, who is the authorized agent for Dennis R.
and Joyce L. Sailing, for a Recorded Exemption. The parcel in question
is described as part of the SWa of Section 28, T2N, R64W of the 6th P.M.
Weld County, Colorado. Said property contains 124.558 ± irrigated acres.
The request is to split off a 6.440 acre parcel with improvements from
the property.
Based upon the information submitted, the Planning Commission staff re-
commends denial for the following reasons:
1 . The proposed split does not comply with the Weld County Comprehensive
Plan because it would promote non-agricultural use of agricultural
land and it would encourage urban encroachment on rural land use.
2. The recorded exemption request is not in compliance with the intent
clause of the recorded exemption procedure (Section 9-2 of the Weld
County Subdivision Regulations) . Said clause states:
"The intent is establishing the Recorded Exemption procedure
is to provide, in accordance with the Weld County Comprehen-
sive Plan, a means whereby non-productive agricultural lands
may be developed for higher or more productive uses, in-so-far
as such uses are compatible with surrounding agricultural uses
in areas where such land divisions are proposed. (Rev. 4/17/74)"
Soils in this area are Class II. The granting of the recorded exemption
would allow for the conversion of productive agricultural lands since a
new set of improvements would be allowed on the 118.118 acre parcel .

3. The recorded exemption request is not in conformance with the intent
clause of the Agricultural Zone District (Section 3.3 A of the Weld
County Zoning Resolution) which states:
"Intent - The intent in establishing the A-I Agricultural
Zone District is to allow all agricultural and related
uses in those areas in which agriculture is and should
continue to be the predominant land use. This district
is intended to discourage encroachment of incompatible
uses upon the agricultural land in the district, to en-
courage agricultural uses as the highest and best use of
the land in the district as compared with other uses in
conflict therewith, and to provide for the orderly ex-
pansion of urban growth in conformance with the Weld
County Comprehensive Plan."
The request would not be encouraging agricultural uses as the highest
and best uses, it would not be providing for the orderly expansion of
urban growth, and it would be breaking up a large block of agricultural
land.

Deed dated March 29 1971 , wherein The Great Western Sugar Com-
pany conveys and quit claims its interest in the property described
herein to Philip G. Bowles and Merle E . Bowles, as joint tenants,

A tract of land consisting of two parcels lying within the
boundaries of the West-half Section Twenty Eight (28) , Township Two
(2) North, of Range Sixty Four (64) West of the Sixth P. M. , in Weld
County, Colorado, more particularly described as follows :

Commencing at the West Quarter corner of Section
28, Township 2 North, of Range 64 , West of the 6th P.M. ;
Thence Easterly along the half-section line for a dis-

Gentlemen:
When I purchased the old Haffner farm West of Keenesburg in 1972 it was with the
full intention of using the farm as my principal residence. I am no stranger to
rural living - having previously owned a farm in Prospect Valley - and living at
Keenesburg was compatible with my job as an equipment salesman with Moore Equip.
Co.
Extensive remodeling was done to the old farmhouse on the property and we moved
into the house about the time the energy crisis; recession; unemployment and all
the other problems seemed to strike. These rather sudden changes brought some
demands from my job that required me to travel extensively and be away from home
for a number of days at a time.
It was during one of these times while my wife was alone that an incident occurred
which caused me a great deal of concern. While alone in the house, an individual
who appeared to be under the influence of drugs or alcohol attempted to get into the
house and it required the assistance of the Weld County Sheriff to arrest the
party. This in the summer of 1975.
My job demands still require me to travel and be away from home. I do not feel
that I can ask my wife to continue to stay alone after the incident described. The
investment in the house is such that we would not want to rent the property. The
present farm tenant has his own new home and he would not want the use of the house.
I am well satisfied with my tenant and would not want to take the farm away from
him just to get someone elsenlive in the house.
Therefore, until the economics change and I could be at the farm, I feel I have
no choice but to provide a home in town for my wife. I therefore wish to sell the
improvements and retain the farmground. Approximately 6 acres are required to go
with the house due to location of the irrigation ditch serving the farm.
I am sure that anyone placed in my position will agree that the request to sell
the farm improvements is reasonable.

Gentlemen:
We did not originally dig the well located above. It is quite an old well. We
have serviced this well and from the information in our files, it is approximately
800 feet in depth and in the Foxhill sand. It produces about 15 gallons per minute
and would be adequate for one-family domestic use plus limited farm livestock use.

3 . That the lots resulting from the proposed land division will

Dear Mr. Bowles:
I have reviewed the application and related materials you submitted
yesterday for a request for a Recorded Exemption on land currently
owned by Dennis R. and Joyce L. Salling located in part of the SW14
of Section 28, T2N, R64W of the 6th P.M. , Weld County, Colorado.
With the exception of proof of domestic water for Lot B of the Re-
corded Exemption request, the application is complete including fees.
Our office will process the application with hopes that some arrange-
ment can be worked out with the State Engineer on the proof of dom-
estic water for Lot B. I have tentatively scheduled the hearing be-
fore the Board of County Commissioners on March 22, 1976.
