RE: APPROVE SUPPORT FOR A REVISED ENTERPRISE ZONE PLAN WITHIN WELD
COUNTY AND APPROVE DELEGATION OF ENTERPRISE ZONE ADMINISTRATION
AND FEES TO THE GREELEY-WELD ECONOMIC DEVELOPMENT ACTION
PARTNERSHIP, DBA UPSTATE COLORADO ECONOMIC DEVEOPMENT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Colorado Urban and Rural Enterprise Zone (EZ) Act provides incentives for
private enterprise to expand and for new businesses to locate in economically depressed areas of
the State, and Section 39-30-103(2)(c), C.R.S., requires a review of EZ designations no less
frequently than once every ten years; the state has commenced this review with updated
designations to be effective January 1, 2016, and
WHEREAS, the Greeley-Weld Economic Development Action Partnership, dba Upstate
Colorado Economic Development (Upstate), has administered the EZ in Weld County on behalf of
Weld County, and
WHEREAS, Upstate has assessed a fee on EZ contributions to cover a portion of the costs
of administering the program, which is one and one-half percent (1 .5%) of the eligible contribution
value, and
WHEREAS, Upstate has asked the County to approve and support the proposed Weld
County EZ development plan and updated boundaries, re-formalize the EZ administrative
arrangement with Weld County and re-authorize an administrative fee to be collected.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Weld County does hereby support the revised plan of the EZ and proposed
updated boundaries.
BE IT FURTHER RESOLVED by the Board that the administration of the EZ in Weld
County be, and hereby is, delegated to Upstate with Cathy Schulte, Senior Vice President, acting
as the official EZ Administrator.
BE IT FURTHER RESOLVED by the Board that the Upstate Board of Directors be, and
hereby is, authorized to set and collect a reasonable administrative fee from enterprise zone
projects of one and one-half percent (1 .5°/0) of the contribution value, unless otherwise approved
by the Board of County Commissioners, to defray the costs of administering the EZ in Weld
County.
