RESOLUTION
RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 70 - ALBERT SOLIS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
' Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, has reviewed the request of Albert Solis for an exemption

from the definition of "subdivision" and "subdivided land" in
Section 30-29-101 (10) , CRS 1973 , as amended, and Section 2-1 of
cC..t the Weld County Subdivision Regulations, and
WHEREAS, the Board of County Commissioners finds that Albert
Solis is the owner of a parcel of land in Part of the Southeast
Quarter, Section 17 , Township 5 North, Range 64 West of the 6th
P.M. , Weld County, Colorado, being more particularly described
as follows :
That portion of the Southeast Quarter of Section
17, Township 5 North, Range 64 West of the 6th
Principal Meridian, County of Weld, State of
Colorado, being more particularly described as
follows:
Beginning at the Southeast corner of said Section
17; thence along the East line of the Southeast
Quarter of said Section 17 North 00°12'22" West
1911.01 feet to the TRUE POINT OF RFfINNING:
thence continuing along said East line North
00°12'22" West 280.00 feet; thence departing
from said East line North 89°57'57" West 250.00
feet; thence South 00°12'22" East 280.00 feet;
thence South 89°57'57" Fast 250.00 feet more or
less to the TRUE POINT OF RFfINNING.
The above described parcel is subject to all
rights-of-way and easements of record. Said
parcel contains a y oss acreage of 1.61 Acres
irore or less.
WHEREAS, the Board of County Commissioners has considered
the recommendations of the Department of Planning Services on
this matter and has reviewed information submitted by the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the aforementioned tract
of land owned by the applicant, be, and hereby is, declared to be
exempt from the definition of "subdivision" and "subdivided land"

further finds that said tract shall be considered a single lot.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 15th day of
November, A.D. , 1978.

Applicant: Albert Solis
The owners of the following described property have requested an
exemption from Section 2-1 of the Weld County Subdivision Regu-
lations adopted August 30, 1972 , which defines the term subdivi-
sion:

The Planning Department has reviewed this request and recommends
that the request be approved for the following reasons :

COMMENTS :
Mr. Solis is moving out of state and desires to sell this property

residences to be separated from the balance of the property . A third
existing residence will be available for use with the property that
is being farmed.

COMMENTS : •
There are three existing residences on this property. Accesses to
the residences are existing. The elevation of the State Highway in
front of the residences appears to be fairly level for a quarter mile +
in each direction. There are some mature trees located on the west
side of the state highway right-of-way line. The trees do not appear
to be a sight distance safety factor. Visibility appears to be above
avegare on entering or exiting State Highway 37. The balance of the
property is in agricultural production (corn) . The closest residence
from the improvements area is located a quarter of a mile to the south
-ott_the east side of State highway 37.
