Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: This project is proposing a salt water injection facility. The proposal will be to accept piped water, however trucked water will also be accommodated. Approximate Access Location: From CR116 and CR114 south along Section line ROW of CR133, then East along Section Line ROW CR114 to site. Roads: The intersection of CR116 and CR133 are the closest county maintained roadways. The site is south along CR133 section line ROW 1 mile then half a mile east on CR114 section line ROW. Latest ADT on CR 116 just west of the site was taken on 10/29/14 which counted 1075 vpd with 59% trucks. Traffic: A traffic narrative was submitted and indicated the facility was being built to accommodate up to 50 water trucks daily; however the expectation is that the facility will see an average of 10 water trucks daily under normal operating conditions. The site will be unmanned and the primary method of water delivery will be by pipeline. 75% of the traffic is expected to come from CR133 south and the remainder is expected to access from CR116 east. Access: An access permit has been approved for the access to the site (AP15-00091). Tracking Control: Tracking control is required to prevent tracking from the site onto the County Roadway. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. More than 10 round large truck trips/day or more than 50 round passenger vehicles trips/day: Access onto gravel roads requires a tracking control device and a minimum of 300ft of recycled asphalt/road base. *Tracking control devices can be double cattle guards or other specialized device " Tracking control for unmaintained public ROW is required just prior to entering publically maintained roadways. General Site Plan Requirements: i.e (IA, RMA, City Town Agreement, etc..., offsite auxiliary lanes) -Improvements Agreement: Improvements/Road Maintenance Agreement: An example agreement is available at: http://www.co.weld.co.us/Departments/Plann incZon i nq/Land U seApplicationsAssistance/ApplicationAssist ance.html o An Improvements Agreement is required for sites with required offsite improvements. Collateral is required to ensure the improvements are made. o Road Maintenance is typically included as a section of the Improvements Agreement when the County feels that the site activities may impact the County roadways. Possible mitigations included in the road maintenance agreement may include but are not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers. An Improvements Agreement between the Applicant and the County will be required for this project. It will detail the approved haul route(s), outline when offsite improvements will be triggered, and include a maintenance agreement for the haul routes. Geologic hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This area IS NOT in a Floodplain. Drainage Study: A drainage letter dated 1/28/15 prepared by Michael Welker PE39871 was submitted with the application. The drainage letter included a water quality design. The engineer will be resubmitting the cover letter with a correction to be consistent with referencing a water quality feature. Grading Permit A Weld County Grading Permit will be required if disturbing more than 1 acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303- 692-3575. CONDITIONS OF APPROVAL: A. The applicant shall complete a Non-Exclusive License Agreement for the upgrade and maintenance of Weld County Right-of-Way. (Department of Public Works) B. An Improvements and Road Maintenance Agreement is required for offsite improvements at this location. Road maintenance including dust control, damage repair, specified haul routes and future traffic triggers for improvements will be included. (Department of Public Works) C. An accepted Water Quality Feature drainage design is required. (Planning-Engineering) D. The map shall be amended to delineate the following: 1. County Road 116 is a gravel road and is designated on the Weld County Road Classification Plan as a collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall verify and delineate on the plat the future and existing right-of-way and the documents creating the existing right-of-way. If the existing right of way cannot be verified it shall be dedicated. All setbacks shall be measured from the edge of right-of-way. This road is maintained by Weld County. (Planning-Engineering) 2. County Road 133 is a gravel road and is designated on the Weld County Road Classification Plan as a collector road, which requires 80 feet of right-of-way at full buildout. This road is not maintained by Weld County. (Planning-Engineering) 5. Show and label the approved Non-Exclusive License Agreement and recorded reception number and date on the map. (Planning-Engineering) 6. Show and label the approved access(es) and access permit number(s) on the map (AP15- 00091). (Department of Public Works) 7. Show and label all easements with the recorded document reception number and date on the map. (Planning) 8. Show and label a tracking control device and a minimum of 300ft of recycled asphalt/road base on the map. (Planning-Engineering) 9. The approved access and tracking control shall be constructed prior to on-site construction. (Planning-Engineering) B. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. (Planning-Engineering) DEVELOPMENT STANDARDS (NOTES ON THE SITE MAP) 1. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Planning-Engineering) 2. The Non-Exclusive section line right-of-way shall be graded and drained to provide an all-weather access. (Planning-Engineering) 3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized. (Department of Public Works) 4. The historical flow patterns and runoff amounts will be maintained on the site. (Planning-Engineering) 5. Weld County is not responsible for the maintenance of onsite drainage related features. (Planning- Engineering) stk MEMORANDUM J\ TO: CHRIS GATHMAN, PLANNING SERVICES c - - N T Y FROM: HEATHER BARBARE,ENVIRONMENTAL HEALTH SUBJECT: USR15-0021, EH REVISED REFERRAL-WHITING HORSETAIL SWD WELL DATE:JUNE 9, 2015 Environmental Health Services has reviewed this proposal to a non-commercial Class II Oilfield Waste Disposal Facility to include a Class II injection well and associated infrastructure. The facility will be unmanned and the injection well will be monitored remotely. The applicant is proposing to provide portable toilets for the facility during construction and operation. Portable toilets and bottled water are consistent with the following section of the Environmental Health Services, Weld County Department of Public Health & Environment, Septic Policies. 2.2.K Use of portable toilets and bottled water(revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Bottled water from a commercial source and portable toilets are allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Note: Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. The applicant submitted a Dust Abatement Plan. The dust abatement plan indicates that during construction a water truck will be used to control dust and that the access road and facility will consist of gravel road base. It also indicates that vehicle speeds will be limited onsite and water trucks will be utilized, as necessary. The applicant submitted a Waste Handling Plan, a Groundwater Sampling Plan, and evidence of financial assurance for the site. The applicant will be required to have an SPCC Plan, and submit evidence of an Air Pollution Emission Notice (APEN) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, as applicable. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: 1. Prior recording the plat: A. The applicant shall submit evidence of an Air Pollution Emission Notice (APEN) and Emissions Permit application from the Air Pollution Control Division (APCD), Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. We recommend that the following requirements be incorporated into the permit as development standards: A. No disposal of waste, other than Class II, as currently defined by the Environmental Protection Agency, is permitted. No Class II waste, other than Class II waste from wells operated by the injection well operator is permitted for disposal. Any changes from the approved Class II use will require an amendment to this Use by Special Review Permit. B. All liquid wastes received at the facility shall be unloaded on the unloading pad. The unloading/loading pad leak detection system shall be constructed and operated in accordance with the approved design. The unloading pad will be kept in good condition and cleaned at a frequency that prevents oils and other wastes from building up on the pad. During winter months, the facility shall maintain the unlading pad free of ice. 2 C. Analytical waste data and environmental monitoring data shall be made available to Weld County Department of Health and Environment upon request. The Weld County Department of Health and Environment reserves the right to require additional monitoring. D. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. E. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. F. A leak detection system shall be designed and installed beneath concrete unloading pad(s), piping, and sump(s). The unloading pad shall be kept in good condition and leak detection and unloading pad plans shall be onsite and available upon request. G. Secondary containment shall be concrete for all storage and processing tanks. Secondary containment volume shall provide containment for the entire contents of the largest single tank plus sufficient freeboard to allow for precipitation. The plans and engineered drawings will be stamped and signed by a Colorado Registered PE. Synthetic structures (non-concrete) are permitted, provided a Colorado Registered PE provides a certification indicating that the proposed alternate containment system meets, or exceeds, the function of a concrete system with regard to containment, spills, and unintended releases. The secondary containment shall be kept in good condition. Secondary containment plans and certifications, volume calculations demonstrating sufficient freeboard is available, and PE stamped drawings shall be onsite and available upon request. H. Unloading pad(s), secondary containment and tanks shall be inspected for integrity and leaks at least monthly. Documentation of inspections will be kept onsite and available upon request. I. Any stained or contaminated soils on the facility shall be removed and disposed of in accordance with applicable rules and regulations. All spills will be documented and records will be kept onsite for WCDPHE review upon request. All spills will be reported to local, state and federal agencies in accordance with all state and federal regulations. 3 J. WCDPHE will be notified prior to the closure of the facility. Upon site closure, the facility will remove all wastes from the site and decontaminate all equipment, tanks, and secondary containment. All wastes removed from the site during closure activities will be disposed of off-site, in accordance with all state and federal rules and regulations and with Weld County Code. Documentation of closure activities will be provided to WCDPHE. K. The facility shall comply with the accepted Groundwater Monitoring Plan. L. All stormwater, which has come into contact with waste materials on the site, shall be confined on the site. In the event the storm water is not adequately controlled on the site, upon written notification from the WCDPHE or CDPHE, a comprehensive site-wide Stormwater Plan shall be developed and implemented. The plan must be approved, in writing by the WCDPHE or CDPHE, prior to implementation. M. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the accepted "waste handling plan"and with Chapter 14, Article 1 of the Weld County Code, at all times. N. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code, or with all applicable State noise statutes and/or regulations. Q. Fugitive dust and fugitive particulate emissions should be controlled on this site. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. P. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. If employees or contractors are on site for less than 2 consecutive hours a day portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. Q. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of 4 hazardous air pollutants and volatile organic compounds. All chemicals must be stored securely, on an impervious surface, and in accordance with manufacturer's recommendations. R. A Spill Prevention, Control and Countermeasure Plan, prepared in accordance with the applicable provisions of 40 CFR, Part 112, shall be available on site, at all times. S. The applicant shall submit a waste handling plan, for acceptance, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1. A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2. A list of the type and volume of chemicals expected to be stored on site. 2 3. The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 4. Solids and sediment will accumulate in the storage tanks. The waste handling plan shall include a detailed plan that describes the method of how those solids will be removed, including all on-site handling procedures. 5. The waste handling plan shall provide a commitment to notify the Weld County Department of Public Health and Environment in writing, in the event the plan is amended. The plan shall be reviewed and approved by the Weld County Department of Public Health and Environment. 2. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to release of building permits: A. The facility shall post financial assurance with the COGCC. The financial assurance shall be adequate to cover a third-party closure of the facility, including the plugging and abandonment of the well, in accordance with industry standards, and the removal of all structures (including concrete) on the facility. The site shall be returned to its original grade. The facility shall submit evidence to Weld County Department of Public Health and Environment that the appropriate financial assurance has been obtained. 3. We recommend that the following requirements be incorporated into the permit as development standards: A.
