Description of Proposed Use: This USR application is referred to as the WPD Storage Yard USR and it is provided from WPD Storage LLC. WPD Storage LLC works closely with companies that supply production equipment for the Oil and Gas industry. To better and more efficiently supply oil and gas production sites located within Weld County and the greater Wattenberg field area, the applicant proposes to construct a storage yard that will house new production equipment for future sales as well as oil and gas field equipment. If the proposed USR is approved, approximately 47 acres of the site will be used for the storing and selling of oilfield equipment, primarily oil and gas separators and combustors. The proposed storage area is anticipated to be used by oil and gas equipment operating companies with business ties to WPD Storage LLC. The site may also be used for oil and gas storage purposes. The remainder of the site not planned for use as a storage yard will be reserved for the existing oil and gas well facilities and buffering. The proposed use is located on parcel 105732000002 in Weld County and measures approximately 52.65 acres in total area. The parcel is located approximately 2/3 of a mile south of the Town of Gilcrest. The parcel is bordered by Highway 85 to the east and Weld County Road (WCR) 38.5 to the north. It is currently zoned Agricultural and is surrounded by Agricultural zoned properties. In addition there is an existing residence located to the northwest of the property. The property ownership keeps an active dialogue with the owners of this property and has agreed to designate an area of the subject property as a buffer to screen future all future uses. Please see the attached site plan for more details. The proposed operation on the subject parcel will include the receiving, storing, and dispatching of new oil-field equipment. A description of the proposed traffic associated with the site is provided in the attached memorandum. The proposed access road for the storage facility will be from WCR 38.5. WCR 38.5 and WCR 29 have a combined intersection with Highway 85 with acceleration and deceleration lanes for all movements. At this time the applicant is proposing a 30-foot wide drive access with 60-foot turning radii on WCR 38.5. Ample turnaround room for trucks is provided before the gates. Existing access points on WCR 38.5 for the two oil and gas wells located on the property will remain. One employee will staff the site to handle the day-to-day operations and for security purposes. A fence will be constructed around the storage area and a gate with padlock will be installed for WPD Storage Yard VI3ASELINE 4 Proposed Use by tiecial Review WPD Storage LLC Engineering Plonning • Surveying vehicles accessing the site. The owners will install a vehicle turn around area just north of the proposed access gate large enough to accommodate a semi-truck's turning radius. The ownership intends to construct two modular offices (one proposed, one future) onsite to accommodate the site supervisor. In addition two small warehouses (one proposed, one future) are planned to be installed to perform maintenance on equipment stored on site on an as-needed basis. A 25-foot tall radio communications tower is also proposed. Please see the attached site plan for more information regarding the layout and proposed uses. 2. Consistency with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan Comprehensive Plan Consistency Section 22-2- 10(D) emphasizes the extraction of natural resources as an important part of the economy of Weld County. This storage facility will contribute to the expansion of the county's industrial economic base by providing increased capacity for future marketing of oil production in Weld County. The property is located near Highway 85 and is a logical location for a storage yard. 3. Consistency with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. Section 23-3- 10 indicates that uses that are "more intense and have a potentially greater impact" are permitted within the A (Agricultural) zone district. The operation of a storage facility for oil & gas equipment can be considered more intense uses of land that are more suitable for locations such as the proposed site. Oil and gas facilities are allowed as a use by right in the A (Agricultural) Zone District. However oil and gas storage facilities and oil and gas support and services require a Use by Special Review (USR) permit in Weld County. 4. Surrounding Uses and Compatibility with surrounding uses The WPD Storage Yard is surrounded by large agricultural properties, a residence to the immediate northwest, and a moving company directly to the north. Also, the Strear Farms Company feed lot is located to the east of the parcel, across Highway 85 . A landscaped area, measuring approximately 3 .5 acres in total area, will be installed at the northwest corner of the site to buffer the proposed use from the neighboring residence. 5. Describe the following: a Number of people who will use this site WPD estimates that ten trucks will come and go from this facility on a daily basis for loading and unloading purposes. Number of employees proposed to be employed at this site The tenant will staff approximately one ( 1 ) permanent employee for the purpose of managing the site. In addition there will be additional employees on-site temporarily for the loading and unloading of materials that come to the site via trucks. In addition some temporary employees may be on site for any required maintenance to the equipment. The total number of employees on site should not exceed five. a Hours of operation The WPD Storage Yard's primary operating hours are expected to be Monday through Saturday from 6 am to 6 pm. The facility is expected to operate mainly during the daylight hours. d Type and number of structures to be built on this site • One employee office building (modular) • One garage/warehouse for equipment maintenance and forklift storage • One (up to) 560 gallon diesel tank for non-commercial refueling • One (up to) 1 ,000 gallon propane tank should the property not utilize Atmos Energy natural gas services • One 25-foot communications tower • One future employee office building (modular) • One future garage/warehouse a Type and number of animals if any, to be on this site No animals will be kept on the site. f. Who will provide fire protection to the site The Platteville-Gilcrest Fire Protection District provides fire protection to this area. A referral packet will be sent to the District by the County. h. Water source on the property (both domestic and irrigation) The site can be served by domestic water tap provided by Central Weld County Water District. Please see the attached "can serve" letter from Central Weld County Water District. i. Sewage CIVOS91 system on the property (existing and proposed) A commercial onsite wastewater treatment system (septic) will be designed, permitted, and constructed in accordance with the Weld County Health Department's Regulations. A permit for this septic system will be delivered at a later date. A separate Onsite Wastewater Treatment System (OWTS) permit application will be submitted once the preliminary site layout is approved. j. I f storage a- warehousing is proposes, what type of items will be stored Oil and Gas separators, combustors, tanks, meters, and other similar equipment will be stored at the site before or after going to the well fields. In addition, forklifts, maintenance equipment, and other miscellaneous equipment associated with day-to-day operations will be located on-site in the warehouse. 6. Proposed L andscapi nq Trees to screen the property will be installed to buffer the property to the northwest. Please see the attached site plan. The perimeter of the site will be fenced. 7. Redamation Procedures WPD Storage LLC has no intentions of ceasing operations of this facility once it is operational. This facility is intended to be a long-term operation, however should the WPD Storage Yard no longer be needed, equipment will be removed from the site and any vegetation on site will be returned to previous conditions and comply with County standards. 8. Storm Water Drainage The proposed site is relatively flat and all storage and parking areas will be surfaced with gravel. Please refer to the drainage letter located in the appendix of this document for further explanation. 9. Construction period Construction of the WPD Storage Yard is anticipated to commence immediately upon approval of this requested USR permit. Wade Handling Plan Please note that a final Waste Handling Plan will be submitted after approval of the USR permit. No chemicals are intended to be stored on-site. A waste hauler for trash will be named in the plan. 11 . Du& Abatement Plan During the construction phase of the project, WPD will utilize water trucks to maintain dust suppression. After construction is completed the site will be stabilized using native vegetation in allowed areas, which will not be allowed to grow over 12" high. Additionally, WPD will gravel the access drive and all circulation areas on site. In addition, a water truck will be utilized to control dust after construction, as needed. WPD Storage Yard VBASELINE 8 Proposed Use by Special Review WPD Storage LLC Engineering • Planning • Surveying Section 2 1 . Notification Requirements County Notices: Section 23-2-210(B)( 1 ): Upon application completeness, agency notice submittal (28 day comment period). This step is completed by Weld County staff Section 23-2-210(B)(6), a sign shall be posted by the County on this proposed site. This step is completed by Weld County staff Section 23-2-210(B)(4): Notice to owners of property within 500 feet of the parcel. As per 23- 2-260(B)(9), the list attached was created from Assessor records of Weld County on September 13, 2013. Posted Notice: In accordance with Section 23-2-210 of the Weld County Code a sign shall be posted by the County on this proposed property stating that a Use by Special Review Permit has been requested. VIPD Storage Yard VI3ASELINE 9 Proposed Use by tiecial Review WPD Storage LLC Engineering Plonning • Surveying 2. Operation Standards Noise Control : The operation of the WPD Storage Yard will be limited to daylight hours. The facility is not expected to generate noise and will stay well below the maximum noise level. Air and Water Quality: All activities will be in compliance with the permit and control provisions of the Colorado Air Quality Control Program, Title 25, Article 7, and C.R.S. as applicable. No waste water will be discharged within the site. Human wastes will go into the permitted septic vault and leach field. Lighting: Lighting on the site will be downcast and shielded lighting will be provided on the proposed building. Lighting is for nighttime security and emergency work only. Any source of lighting on the site shall be shielded so that light rays will not shine directly onto adjacent properties where such would cause a nuisance or interfere with the use on the adjacent properties. In addition, neither direct nor reflected light from any light source on site will create a traffic hazard to operators of motor vehicles on the adjacent access road. Weed Control : The facility will be kept free of weeds, rubbish, and other waste material. The area shall be treated if necessary and as practicable to prevent invasion of undesirable species and noxious weeds. Required Permits Weld County: A Use by Special Review Permit is required to be approved by the Board of County Commissioners. Access to the site from WCR 38.5 will be coordinated with the Weld County Department of Public Works. WPD Storage LLC will submit any additional permits necessary for county approval prior to the commencement of construction on site. Platteville-Gilcrest Fire Protection District: The Site Plan and Use by Special Review Application will be referred to and reviewed by the Platteville-Gilcrest Fire Protection District. A letter from the fire district regarding this proposal will be added to the Appendix once it is received. Oversize Load Permits If necessary, oversize load permits will be obtained prior to moving any new equipment onto the site. Fire & Emergency Response There is adequate provision for the protection of the health, safety and welfare of the inhabitants of the neighborhood and the county. All roads leading to and those in the site area are designed and maintained to support fire apparatus. Ample turnaround room to accommodate fire apparatus will be present. 6. Spill Prevention, Control and Countermeasure An SPCC is not anticipated to be required at this site. Storage is only for equipment. If required, an SPCC plan will be created for the facility prior to construction of the storage facility. WPD owns approximately 54 acres southwest of the intersection of WCR 29, WCR 38.5 and US Highway 85. The property is located in unincorporated Weld County and zoned A (Agricultural). The USR seeks to permit a storage yard for oil and gas equipment, such as empty tanks, stairs, and other equipment related to the drilling and production of oil and gas. These types of uses are allowed in the A zone district with approval of a USR without the need for rezoning. The property is within the Urban Growth Area (UGA) of the Town of Gilcrest. Land use cases within the UGA are governed by an Intergovernmental Agreement (IGA) between Gilcrest and Weld County. Further, in 2012 Gilcrest adopted an update to its Comprehensive Plan. The Comprehensive Plan contains a land use Framework Plan. The land use designation for the WPD Storage property is split between Low Density Residential and Employment. Further, the plan places the property almost wholly within the Energy Sector Job Growth Opportunity Area. On page 3 of this memo, the property is shown in red in a snapshot from the Framework Plan . The Weld County-Gilcrest IGA is codified in Article XVI of Chapter 19 of the Weld County Code. Sec. 19- 16-50 outlines planning coordination between the two governments within the UGA. Per the IGA, the Town of Gilcrest has been notified of the proposed USR. The Town Board of Trustees responded to a Notice of Inquiry in October 2014. It has been suggested in the response from Gilcrest that the Town is unclear of a position for the USR because the proposal is not in conformance with Gilcrest's Comprehensive Plan. In response, we are providing demonstration, in accordance with Sec. 19-16-50.C.7 of the IGA that the proposal is not in conflict: (applicant response in bold italics) Sec. 19-16-50.C.7 If any MUNICIPALITY recommendation of disapproval of a Development proposal is based upon a conflict or incompatibility between proposed uses in the Development and anticipated MUNICIPALITY zoning classification for the property, the COUNTY will not approve the same unless the applicant demonstrates: (a) that no such conflict or incompatibility will reasonably occur, The proposed storage yard use is located on a parcel designated in the Framework Plan partially Low Density Residential and partially Employment. The plan states that "the land use designations are illustrative and are not intended to depict either parcel specific locations or exact acreage for specific uses. " The Plan clearly calls for Employment uses to be located along the entirety of US Highway 85 through the UGA, which is a logical location for an employment designation. The Plan does not specify how deep these uses should extend beyond the highway. The land immediately to the west of the parcel is currently residential and agricultural. The subject site will continue to remain zoned Agricultural which allows low density residential. We believe that placing the proposed use on the WPD site is in conformance with the Gilcrest land use designations in the Plan and that there is no conflict. Further, the proposed use is directly tied to the energy sector and the property is within the Plan 's Energy Sector Job Growth Opportunity Area. Therefore, we suggest the proposal is not in conflict with the IGA. (b) that suitable mitigation measures to be imposed by the COUNTY as conditions of approval will eliminate or adequately mitigate adverse consequences of incompatibility or conflict, or Weld County Use by Special Review permits typically contains as many as 30 conditions of approval. These conditions are imposed to ensure that the use does not adversely affect surrounding properties. Conditions are placed on dust, noise, traffic, and visual impacts. We believe Weld County will place conditions on the USR that will adequately protect the Town 's interests and those of surrounding property owners. Again, there appears to be no conflict with the IGA. In addition, a USR is by nature a temporary use. The property will remain zoned Agricultural. If anything, leaving the land zoned agricultural does not meet the Gilcrest Comprehensive Plan 's land use designations as a large employment center could not be located here. (c) that the MUNICIPALITY's anticipated zoning classification of the property is unreasonable because of existing or planned uses of adjacent property. We believe that the proposed use is in conformance with the Comprehensive Plan 's Framework Plan. We do not find the designation of Employment or Energy Sector Job Growth Opportunity to be in conflict with our proposal. The property is within the "Tier 3 Priority Growth Area. " This area is defined as the lands not in Tier 1 or Tier 2, the Primary and Secondary Growth Areas. Tier 3 assumes that growth could not occur within 25 years (as of 2012). We believe that the infrastructure is in place today to adequately serve the proposed storage yard. Gas, electric, and water services are nearby and the yard's employees can be served by an onsite wastewater treatment system (OWTS). We see and suggest that there is no conflict with these criteria as well, with the IGA. On behalf of the landowner, we respectfully request that the application be referred out and begin to schedule the case to the Planning Commission and Board of County Commissioners hearing agendas. We are scheduled to meet with the Gilcrest Town Administrator on Monday May 4, 2015 to continue the conversation/discussion. Currently this site is native rangeland and is 100% pervious consisting of native vegetation. Total acreage of the site is approximately 54 acres. A new Storage Yard and associated access is proposed that will encompass approximately 48 acres. EXISTING SITE DESCRIPTION The existing site is located west of Hwy 85 and south of WCR 38.5 . It is currently undeveloped agricultural land . Two existing well heads and supporting equipment will remain and not be impacted as part of this project. PROPOSED SITE DESCRIPTION Under the proposed conditions a substantial majority of the overall site will remain unchanged . The proposed improvements will include re-grading and access improvements, modular office buildings , and warehouse facilities. These improvements will be installed over a disturbed area of approximately 0 . 9 acres, or roughly 1 .6% of the site. An additional 12 acres of the site will be reinforced with gravel and used for equipment and material storage . The remaining portion of the site will remain undeveloped . In the event the undeveloped portion of the site is leased at a future date, the lessee will be responsible for updating the drainage requirements. The disturbed area will have a combined imperviousness of 10% . The applicant is responsible for providing a water quality feature at the downstream end of the developed site that conforms to the methodology outlined in Volume 3 , Section 3.3. 0 of the Urban Storm Drainage Criteria manual . The site is one large basin that generally flows to the roadside ditch on the south side of WCR 38.5. Proposed site grading will maintain historic drainage patterns and flow to a water quality feature prior to leaving the site. There are no known issues with the current drainage. WAIVERS FROM CRITERIA Due to the size of the existing parcel , 53. 19 acres, the small percentage of impervious surface being added within the basin , in addition to the remote nature of the project, a waiver from stormwater detention is being requested . CONCLUSION The proposed drainage system will continue to follow historic drainage paths. The runoff from the site will pass through a water quality feature prior to out-falling at the existing roadside ditch adjacent to Weld County Road 38 . 5 at near historic runoff rates. The subject property that will house the proposed use is located in Weld County south of Gilcrest, Colorado, or more specifically, west of the intersection of Weld County Road (WCR) 29 and WCR 38.5. This memo provides an overview of the long term traffic associated with the proposed use. PROEJCT DESCRIPTION Access to the site will be located on WCR 38.5 via a proposed driveway. WCR 38.5 is a gravel road with one lane in each direction . It contains no turning lanes and has a 60-foot of right-of-way. Ample turnaround will be provided in the interior of the site, off of the right-of-way. The proposed use will require one small office, a storage yard for oil and gas related equipment, and an equipment warehouse. These uses are proposed and will not be constructed until a proposed Use by Special Review application is approved . The USR contains expansion potential of another office and warehouse. Traffic will access the site from the east via Highway 85 . Trucks will travel north and south on Highway 85 until they reach Weld County Road 38.5. They will then travel west on WCR 38.5 until they reach the proposed access point. The trucks will disperse from the site by the same route indicated above. Highway 85 has acceleration and deceleration lanes in all directions at the intersection of and WCR 38.5/29. Other special : The information below is given to call attention to the issue of "Naturally occurring considerations radioactive materials". Although Radon-222 levels in the product represented by this MSDS do not present any direct Radon exposure hazard, customers should be aware of the potential for Radon daughter build up within their processing systems, whatever the source of their product streams. Radon-222 is a naturally occurring radioactive gas which can be a contaminant in natural gas. During subsequent processing , Radon tends to be concentrated in Liquefied Petroleum Gas streams and in product streams having a similar boiling point range. Industry experience has shown that this product may contain small amounts of Radon-222 and its radioactive decay products, called Radon "daughters". The actual concentration of Radon-222 and radioactive daughters in the delivered product is dependent on the geographical source of the natural gas and storage time prior to delivery. Process equipment (i.e. lines, filters, pumps and reaction units) may accumulate significant levels of radioactive daughters and show a gamma radiation reading during operation. A potential external radiation hazard exists at or near any pipe valve or vessel containing a Radon enriched stream , or containing internal deposits of radioactive material due to the transmission of gamma radiation through its wall. Field studies reported in the literature have not shown any conditions that subject workers to cumulative exposures in excess of general population limits. Equipment emitting gamma radiation should be presumed to be internally contaminated with alpha emitting decay products which may be a hazard if inhaled or ingested . During maintenance operations that require the opening of contaminated process equipment, the flow of gas should be stopped and a four hour delay enforced to allow the gamma radiation to drop to background levels. Protective equipment such as coveralls, gloves, and respirator (NIOSH/MHSA approved for high efficiency particulates and radionuclides, or supplied air) should be worn by personnel entering a vessel or working on contaminated process equipment to prevent skin contamination , ingestion, or inhalation of any residues containing alpha radiation.
