RESOLUTION
RE: AMENDMENT TO SECTION III.P OF THE WELD COUNTY BUILDING CODE
ALLOWING DIRECTOR OF BUILDING INSPECTION TO EXERCISE DISCRE-
TION IN CERTAIN MATTERS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the

affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado conducted a public hearing in its Chambers on the first
floor of the Weld County Centennial Center on September 20, 1978
at 2 : 00 o' clock p.m. for the purpose of considering a proposed
amendment to Section III.P of the Weld County Building Code
making provision for the approval of deviations from the Weld
County Building Code by the Director of Building Inspection at
his discretion whenever there are practical difficulties involved
in carrying out the provisions of the code, and
WHEREAS, the Board considered the recommendations of the
Weld County Planning Commission, the statements of the Director
of Building Inspection and the recommendation of the Weld County
Building Trades Advisory Committee in this matter, and
WHEREAS, the Board finds that it is in the best interests
of Weld County to adopt the proposed amendment to Section III .P
of the Weld County Building Resolution as submitted by the Weld
County Planning Commission.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that Section III.P of the
Weld County Building Code is hereby amended as shown in the
certified copy of Section III.P attached hereto and incorporated
as a part hereof by this reference.

I hereby certify that pursuant to a notice dated August 21, 1978, duly
published August 24, 1978 and August 31, 1978, September 7, 1978 and
September 14, 1978 in the Johnstown Breeze, a public hearing was held
for the consideration of amendments to the Weld County Building Code,
Section III.P. Gary Fortner, Planning Director, and Joe Jarvis,
Building Inspector, were present and explained the amendments. There
was no one in the audience opposed to the adoption of the proposed
amendments. After review, Commissioner Roe made a motion to approve
the proposed amendments. Commissioner Jacobucci seconded the motion
and it carried unanimously. All five commissioners were present for
the hearing. It was noted that the Weld County Building Trades Advisory
Board has reviewed and approved the proposed changes.

AMENDMENTS TO SECTION III .P < `�
OF THE WELD COUNTY BUILDING CODE
Section III .P of the Weld County Building Code is amended
to read:
P. Alternate materials and modifications.
1. Alternate materials authorized - The provisions of
this Building Code are not intended to prevent the
use of any material or method of construction not
specifically prescribed by this Building Code,
providing any such alternate has been approved.
2 . Approval - The Director of Building Inspection
may prove any such alternate provided he finds
that the prcposed design is satisfactory and that
the material method or work offered is for the
purpose intended at least the equivalent of that
prescribed in this Building Code in quality,
strength, effectiveness , fire resistance, dura-
bility and safety. The Director of Building Inspec-
tion shall require that sufficient evidence or
proof be submitted to substantiate any claims that
may be made regarding its use.
3 . Modifications - Whenever there are practical diffi-
culties involved in carrying out the provisions of
this Code the Director of Building Inspection may
grant modifications for individual cases provided
he shall first find that a special individual reason
makes the strict letter of this Code impractical

and that the modification is in conformity with
the spirit and purpose of this Code, and that such
modification does not lessen any fire protection
requirements or any degree of structural integrity.
The details of any action granting modification
shall be recorded and entered in the files of the
Division of Building Inspection.
