RE: WITHDRAWAL OF A CHANGE OF ZONE, COZ14-0006, FROM THE R-2 (DUPLEX
RESIDENTIAL) ZONE DISTRICT TO THE R-3 (MEDIUM RESIDENTIAL) ZONE
DISTRICT—VICKI LAKE
A public hearing was conducted on March 4, 2015, at 10:00 a.m., with the following present:

Commissioner Steve Moreno

The following business was transacted:
• I hereby certify that pursuant to a notice dated November 26, 2014, and duly published
December 1, 2014, in the Greeley Tribune, a public hearing was conducted on January 14,
2015, to consider the request of Vicki Lake, for a Change of Zone, COZ14-0006, from the R-2
(Duplex Residential) Zone District to the R-3 (Medium Residential) Zone District, at which time
the Board deemed it advisable to continue the matter to March 4, 2015, to allow staff time to
reconsider the impact of the mass zoning effort of 1981 regarding this particular neighborhood
and make decisions according to the best interest of the residents affected, in particular and at
this time, Ms. Lake. Brad Yatabe, Assistant County Attorney, made this a matter of record.
I hereby further certify that pursuant to the above mentioned notice and continuance, a public
hearing was conducted on March 4, 2015, concerning the request of Vicki Lake for a withdrawal
of application for a Change of Zone, COZ14-0006, from the R-2 (Duplex Residential) Zone
District to the R-3 (Medium Residential) Zone District and a refund of her application fee. Brad
Yatabe, Assistant County Attorney, again, made this a matter of record.
e Diana Aungst, Department of Planning Services, stated the applicant has submitted a
letter to withdraw the application, dated February 4, 2015.
e Vicki Lake, applicant, stated she submitted the withdrawal request in order to receive a
reimbursement of her application fees and it is her understanding that the County will be
correcting the zoning designation on her property. Chair Kirkmeyer stated she may still be
subject to building permit requirements, to which Ms. Lake indicated she has already completed
that process.

e Commissioner Conway moved to approve the request of Vicki Lake to withdrawal said
application for a Change of Zone, COZ14-0006, from the R-2 (Duplex Residential) Zone District
to the R-3 (Medium Residential) Zone District, with direction to staff to refund the application
fee. The motion was seconded by Commissioner Freeman. Commissioner Conway thanked
the applicant for working with the County to correct a situation which was created in 1981. He
stated her previous statements concerning the struggles she was encountering brought the
situation to light and allowed the County to correct the situation for her and also look at resolving
similar zoning errors for other residents in the area. Commissioner Cozad agreed and also
requested staff provide a status report at a separate time concerning the rezoning in the area.
In response to Ms. Lake, Chair Kirkmeyer confirmed the other property owners in the area are
also being notified of the zoning corrections for their properties. There being no further
discussion, the motion carried unanimously and the hearing was completed at 10:10 a.m.
This Certification was approved on the 9th day of March, 2015.
