Steve Moreno Date of signature: ��� U 2015-1828 PL1815 1861 MEMORANDUM To: Board of County Commissioners 'n E � From: Kim Ogle, Planning Services' . u1G0JNTYj Subject: Barefoot Lakes, LLC; do Brookfield Residential Properties Reconsideration of Condition of Approval - PUDF14-0009 Prior to Recording the PUD Final Plat, Item 1.B Date: June 22, 2015 The Board of County Commissioners at their May 6, 2015 land use hearing approved a request for a Planned Unit Development Final Plat-Amendment to First Filing, PF-1078-Replat of Lots 1-32,Block 7; Lots 1-11, Block 8; Lots 1-14 Block 9;Lots 10-17, Block 10; Lots 1-7, Block 14 and Tract H (243 Lots with R-1 (Low Density Residential); C-1 (Neighborhood Commercial); C-2(General Commercial)Zone Uses and the vacation of various rights-of-way, and continuing Oil and Gas Production Uses along with approximately 213 acres of open space consisting of a river corridor, private recreational lakes and community parks in the 1-25 Regional Urbanization Area Overlay District- Barefoot Lakes PUD). The case, PUDF14-0009, was conditionally approved with several items to be addressed Prior to Recording the PUD Final Plat. Condition of Approval, Item 1.6 states: "The applicant shall enter into an updated Improvements and Road Maintenance Agreement for onsite and offsite improvements. Collateral needs to be submitted to and accepted by the Weld County Board of County Commissioners prior to recording of the plat. Previously accepted collateral (2006-1915 and 2007-2154) was obtained for PF- 1078, Final Plan for St. Vrain Lakes PUD." The Department of Planning Services has received a written request dated June 16, 2015 (attached) from Mr. Cameron Grant, Esq., Legal Counsel for Brookfield Residential Properties, the developer of the Barefoot Lakes PUD development in southwest Weld County concerning the timing of entering into the Improvements Agreement. The request is to move this condition, item number 1.B from "Prior to Recording the PUD Final Plat"to Item 7. "Prior to the release of any Building Permits." The recordation of the Barefoot Lakes PUD Final Plat is a pre-condition to the annexation into the Town of Firestone and would allow Barefoot Lakes LLC and Firestone to complete the annexation — eliminating the need for the Improvements and Road Maintenance Agreement with the County. Should the annexation into Firestone fail for any reason, the developer would still be required to enter into an updated improvements agreement and submit appropriate collateral, and would do so prior to the issuance of any building permits. The developer has already executed a development/annexation agreement with the Town of Firestone, so this request is designed to prevent duplicative efforts. The County Attorney's office has reviewed this request and is in support of this action. This specifically relates to the timing of entering into an Improvements Agreement with the County. As you Madoline Wallace-Gross know, the 1,300 acre Barefoot LLC property is on the brink of annexation to the Chad A.Kupper Blair M.Dickhoner Town of Firestone. Recordation of the final plat for Barefoot Lakes Filing No. 1 Elizabeth M.Joyce 15 a pre-condition to that annexation. Upon annexation, we have a negotiated Annexation Agreement and Development and Vested Rights Agreement with Firestone that will govern a variety of matters, including construction of public SPECIAL COUNSEL improvements associated with the property. Barefoot proposes to move that condition (currently 1(b)) in the Resolution to section 6 of the Resolution (making it a new 7(F)). This change would allow Daniel F.Bernard(7942-2011) County Barefoot and the to move ahead with recordation of the Plat. Thereafter, Barefoot and Firestone would complete the annexation —eliminating the need for the Improvements and Road Maintenance Agreement with the County. As currently drafted, the Resolution requires us to go through an unnecessary exercise with the Improvements Agreement. In the unlikely event that the Annexation fails, leaving the Improvements Agreement condition in Section 7 would require Barefoot to return to the County with such an agreement before obtaining any permits for vertical construction.
