SUBJECT: USR14-0077, Van Cleave Gravel Pit
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues
may arise during the remaining application process.
COMMENTS:
General Project Information/Location:
A Site Specific Development Plan and Use by Special Review Permit for a mineral resource development
including open pit mining (sands, gravels and stones), and materials processing including stockpiling,
crushing and screening, recycling operations, and importing of raw and recycled materials as well as two
mobile trailers in the A (Agricultural) Zone District.
The applicant is proposing to mine a new gravel pit on parcel 047308000004.
This project is NW of the intersection of CR 139 and CR 104.5. Access is from CR the corner of CR 139
and CR 104.5.
Roads:
County Road 139 and CR 104.5 are designated on the Weld County Road Classification Plan as a local
road, which requires 60 feet of right-of-way at full build out. This project is not adjacent to either of these
roadways; therefore, no additional requirements are necessary.
There are no known traffic counts on the roads in this area. Discussions with PW Road Supervisor
indicated that these roadways are graded only once a month, have very little traffic, sharp curves, and low
water crossings that may be difficult to navigate at times. Additional truck traffic will likely impact these
roadways and require additional maintenance.
Traffic:
The traffic information provided with the submittal states that the site will operate from dusk till dawn
seven days per week with 6-8 employees on site. They anticipate mining the site in 2 phases with
completion of both phases expected in approximately 2 yrs. Truck traffic will consist of 25-30 trucks per
day.
Traffic Narrative with Triggers:
A Traffic Impact Study can be waived and a detailed Traffic Narrative submitted if the applicant
agrees to traffic triggers. Any triggers based upon the traffic narrative or the traffic study will be included
within the improvements and road maintenance agreement. The Traffic Narrative must include at the
minimum:
1. The type (i.e. trucks/passenger vehicles etc...) and number of vehicles per day
2. Peak hour traffic numbers
3. Expected routes
4. Trip distribution along the routes (i.e. 50% of traffic will come from the north, 20% from the south,
30%from the east)
5. Specifically agree in writing to the below improvements triggers.
A. 200 vpd or significant dust as identified by County-Mag-Chloride dust abatement
B. 300 vpd alternative pavement
C. 400 vpd pavement
Access:
An Access Permit is required for new accesses and/or change of use of an existing access, the fee and
photos are required (Access permit instructions and application can be found at
http://www.co.weld.co.us/Departments/PublicWorks/Permits/Applications.html.) Chapter 6, Sections 6.3,
6.4 and 6.5 of the Weld County Engineering and Construction Criteria, offer access design guidance.

olicies.html) Existing access points with change of use or new access points may or may not be granted.
Questions pertaining to access permits or access design shall be directed to the Public Works
Department.
An access application has been submitted and is under review by PW. The application does not state
how the applicant will get access to the parcel from the County road system. It appears the project will be
accessing across the parcel to the east which is held by the same owners and will also be accessing
across parcel (047315000008)owned by Two Mile Ranch. This would require an access easement from
Two Mile Ranch in order to get access to the County Roads. Should at any time the applicant chooses
to use the section line right of way for access, a non-exclusive license agreement would be required for
this use. The applicant shall contact this department for further information on section line right of way
use.
The gate (if used) must be set back a minimum of 75 feet from future right-of-way to allow a truck to pull
completely off of the roadway and open the gate after the future road widening.
Tracking control is required to prevent tracking from the site onto the County Roadway.
o Temporary Tracking Control shall be used during construction unless permanent tracking control
is installed ahead of construction activities.
o Standard tracking control for accesses onto gravel roads includes double cattle guards at the
access point.
Other PW Permits:
A Right-of-Way Use Permit is required for any work in the Weld County Right-of-Way. Contact Weld
County Public Works at 970-304-6496 ext. 3764.
A Transport Permit is required for any oversize and/or over weight vehicles. Contact Weld County Public
Works at 970-304-6496 ext. 3764.

o An Improvements Agreement is required for sites with required offsite improvements. Collateral
is required to ensure the improvements are made.
o Road Maintenance is typically included as a section of the Improvements Agreement when the
County feels that the site activities may impact the County roadways. Possible mitigations
included in the road maintenance agreement may include but are not limited to: dust control,
specified haul routes, damage repairs, and future improvement triggers.
-Geologic hazard Area:
This site IS NOT in a Geologic Hazard Area.
-Floodplain:
The project site IS NOT within a known floodplain.
Drainage Study:
A drainage narrative was submitted stating that the project will create a natural pond and all storm water
will be retained onsite. This is a dry pit and will not expose ground water.
The applicants will be required to maintain historic drainage flows and run-off amounts on the property!
Grading Permit
If more than 1 acre is to be disturbed for construction of non mining activities such as structures, parking
lots, etc..., a Weld County grading permit will be required prior to the start of construction. Contact the
Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-
692-3575.
CONDITIONS OF APPROVAL:
Prior to recording the plat:
A. An Improvements Agreement and Road Maintenance Agreement is required for offsite
improvements at this site. Road maintenance including dust control, damage repair,
specified haul routes and future triggers for improvements will be included.
The map shall be amended to delineate the following:
A. Show the approved access(es) on the plat and label with the approved access permit
number (will be provided).
B. Show and label standard tracking control onto publically maintained roadways on the map.
C. Show and label the drainage flow arrows, turning radii, and parking and circulation on the
map.
D. Show any proposed gate back a minimum of 75ft from the right of way.
Prior to Construction:
A. If more than 1 acre is to be disturbed for non-mining activities such as parking lots,
structures, etc., a Weld County grading permit will be required prior to the start of
construction. Contact the Planning Department for application information.
B. A Right-of-Way Use Permit is required for any work in the Weld County Right-of-Way.

DEVELOPMENT STANDARDS (NOTES ON THE PLAT)
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit for a mineral resource
development including open pit mining (sands, gravels and stones), and materials
processing including stockpiling, crushing and screening, recycling operations, and
importing of raw and recycled materials as well as two mobile trailers in the A
(Agricultural) Zone District.
As this is a temporary use, portable toilets and bottled water are acceptable for sanitary
uses.
Noise will be restricted to the level allowed in the industrial zone district. Noise can be
limited by utilizing haystacks, white noise backup beepers, equipment located at bottom
of pit and a circular mining pattern.
Dust abatement will consist of watering roads and not mining when there are high
winds. Water for dust control will be trucked in.
Waste will be placed in covered containers and Waste Management will provide service
as needed. A mobile fuel truck will deliver on a daily basis. If fuel is stored onsite the
application indicates secondary containment will be provided.
The State does not require registration of aboveground fuel storage tanks associated
with gravel pits as long as the following requirement is adhered to: "Aboveground
storage tanks used to store flammable and combustible liquids at mining facilities and
construction and earthmoving projects, including gravel pits, quarries, and borrow pits
where, in the opinion of the state inspector of oils, tight control by the owner or
contractor and isolation from other structures make it unnecessary to meet the
requirements of this article." The fuel tank shall be contained within a secondary
containment berm.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirement be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. Alternately, the applicant can provide evidence from the Air
Pollution Control Division, Colorado Department of Health and Environment that
they are not subject to these requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal
in a manner that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with the
approved Waste Handling Plan, at all times.
4. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved Dust Abatement
Plan, at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.

7. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. Portable toilets and bottled
water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand sanitizers.
8. The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
9. All potentially hazardous chemicals must be handled in a safe manner, in
accordance with product labeling, and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
10.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the following
comments:
A building and electrical permit will be required, per Section 29-3-10 of the Weld County Code, for any
permanent new structures ,additions or renovation to any existing structures. A building permit application
must be completed and two complete sets of engineered plans. MSDS sheets for all materials stored
shall be submitted with building permit applications.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2012 International Building
Code; 2012 International Mechanical Code; 2012 International Plumbing Code:; 2012 International Fuel
Gas Code; 2006 International Energy Code; 2011 National Electrical Code; 2009 ANSI 117.1
Accessibility Code and Chapter 29 of the Weld County Code.
RESOLUTION #35 Factory Built Nonresidential Structured CRS 24-32-3305
Every Factory-Built Nonresidential Structure manufactured after the effective date of these regulations
that is manufactured, sold, or offered for sale in this state must display an insignia issued by the Division
of Housing certifying that the unit is constructed in compliance with the standards adopted in schedule "B"
which is incorporated herein and made a part of these Rules and Regulations by reference, and all other
requirements set forth by this resolution.
