RE: AMENDMENT OF RECORDED EXEMPTION 140
WHEREAS, on June 26, 1974, the Board of County Commis-
sioners of Weld County, Colorado granted an exemption from
the definition of subdivision to Richard H. Geisert and
Francis M. Geisert, P. O. Box 1265 , Greeley, Colorado 80631,
for a tract of land located in part of Lot 6 and in part of
Lot 5 of the Southeast Quarter (SE4) of the Northeast Quarter
(NE4) of Section 5, and Lot 3 of the Southwest Quarter (SW4)
of the Northwest Quarter (NW4) of Section 4, Township 5 North,
Range 65 West of the Sixth Principal Meridian, according to
the Union Colony Subdivision, Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, Weld County,
Colorado at a public meeting held in the Chambers of the
Board on August 30, 1976, heard the application of Richard H.
Geisert and Francis M. Geisert to amend Recorded Exemption
140 covering the above described property to include a parcel
known as Lot 10 of a proposed subdivision in Geisert Industrial
P.U.D. being more particularly described as follows :
A Tract of land located in Part of Lot 5
of the Southeast Quarter (SE4) of the
Northeast Quarter (NE4) of Section 5,
Township 5 North, Range 65 West of the
Sixth Principal Meridian, according to the
Union Colony Subdivision, Weld County,
Colorado and being more particularly de-
scribed as follows;
Beginning at the Southeast corner of Lot 3
and considering the South line of said Lot
3 to bear South 87°52 ' 00" West and with all
other bearings contained herein relative
thereto;
Thence South 87°52 ' 00" West, 606. 52 feet to
the True Point of Beginning;
Thence North 02009 ' 00" East, 263. 06 feet:
Thence North 86O44 ' 00" West, 249 . 12 feet;
Thence South 06045 ' 30" East, 16.81 feet;
Thence North 83°14 ' 30" East, 20 . 00 feet;
Thence South 06045 ' 30" East, 271. 51 feet;
Thence North 87°52 ' 00" East, 185. 18 feet
to the True Point of Beginning;
Said Tract contains 1. 30 acres, and
WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present and having been

NOW, THEREFORE, BE IT RESOLVED that Recorded Exemption 140
be, and hereby is, amended by the addition of the above-
described tract of land.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 8th
day of September , A.D. , 1976 .

EXEMPTION NO. 0961-4-2-RE140
I believe we have complied with your recommendations for amending the Recorded
Exemption for Geisert; and enclosed is the amended plat and descriptions which
need the approval of the Board of County Commissioners.
At the time of the original recorded exemption, Lot 10 was thought to be part
of the highway right-of-way; but further research and consultation with the
Highway Department resulted in determining that it was not highway right-of-
way; but, in fact, belonged to the Geiserts as conveyed to them by Warranty Deed
recorded under Reception Number 1609156 dated March 13, 1973.
An agreement to purchase Lot 10 has been reached between the Geiserts and Greeley
Aerial Crop Dusters, Inc. ; thus, the entire area of Tract B will now be under the
ownership of Greeley Aviation Co.
