This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: General Project Information/Location: Parcel number 105310400025,north of CR46 west of CR57 accessing from CR57. 'f he project is for tool rental and repair business. Roads: CR57 is maintained by Weld County and is a local gravel road. Traffic: The traffic information provided with the submittal states there will be eight people utilizing the site with six full time employees. There will be 5 pickup trucks leaving the site twice per day and two semis leaving once per day. The traffic counts on CR57 from 2012 are 79 ADT. Access: An access permit has been approved for the access to the site(AP14-00374). Access improvements are required and shall include 60ft radii to accommodate turning trucks. Tracking control is required to prevent tracking from the site onto the public roadways. Standard tracking control for accesses onto gravel roads includes double cattle guards at the access point. Standard tracking control for accesses onto paved roads includes either 300 feet of pavement onsite OR 100 feet of pavement plus double cattle guards. Alternatives such as recycled AC, or gravel can be considered for this project as the traffic impacts are expected to be lighter. Traffic Route: 100% of the inbound traffic is expected to come from the north while outbond traffic is expected to be equally split traveling north and south along CR57. General Site Plan Requirements: -Geohazard Area: This site is not in a Geologic Hazard Area. -Floodplain: The project site is within the Box Elder Creek floodplain. A floodplain permit is required for any development in the floodplain. Drainage Study: The applicants will be required to maintain historic drainage flows and run-off amounts on the property. A drainage narrative and water quality design was submitted and found to be acceptable by the County. Grading Permit A Weld County Grading Permit will be required if disturbing more than I acre. Contact the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay,303-692-3575. CONDITIONS OF APPROVAL: Fhe plat shall be amended to delineate the following: A. County Road 57 is designated on the Weld County Road Classification Plan as a gravel local road, which requires 60 feet of right-of-way at full build out. The applicant shall verify the existing right- of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. B. Show the approved access(es) on the plat and label with the approved access permit number(AP 14- 00374). C. Show and label tracking control onto publically maintained roadways on the map. D. Show the accepted water quality feature on the map and label as WATER QUALITY FEATURE, NO-BUILD OR STORAGE AREA E. Show and label the floodplain limits on the map. Prior to Construction: A. If more than I acre is to be disturbed,a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for application information. DEVELOPMENT STANDARDS(NOTES ON THE PLAT) 1. Should noxious weeds exist on the property, or become established as a result of the proposed development,the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II,of the Weld County Code. 2. The historical flow patterns and runoff amounts will be maintained on the site. 3. Weld County is not responsible for the maintenance of onsite drainage related features. 4. There shall be no parking or staging of vehicles on County roads. On-site parking shall be utilized. 'oats $186" � MEMORANDUM _ �■Ii � TO: DIANA AUNGST, PLANNING SERVICES a - N T I .973/4\ FROM: LAUREN LIGHT, ENVIRONMENTAL HEALTH C Q_U--T SUBJECT: USR14-0064 DATE: NOVEMBER 13, 2014 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Use by Special Review Permit for any Use Permitted as a Use By Right, an Accessory Use, or a Use By Special Review in the Commercial or Industrial Zone Districts (a shop, employee and commercial truck parking) provided that the property is not a lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. There will be up to 6 employees accessing the site. The property will be served by a shared domestic well that will be repermitted to commercial and a commercial septic system. The application indicates bottled water and a portable toilet will be provided for employees that are on site for less than 2 consecutive hours a day. The dust abatement plan indicates the entrance and internal roads will be graveled. If necessary a water truck will be utilized. The waste handling plan indicates that employee waste will be collected in a dumpster and Northern Colorado Disposal will provide trash removal. There is minor maintenance of vehicles that occurs on site. There will be no washing of vehicles or fuel storage at the facility. The waste handling plan will need to be revised to include disposal of tires, batteries and other scrap parts generated from vehicle maintenance that cannot be disposed of in a dumpster. The disposal of solvent and sludge that is not contained in the recycling machine shall be included. If there will be floor drains in the maintenance shop the drains must discharge to a watertight vault, and contents removed for proper off-site disposal. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirement be met prior to allowing the plat to be recorded: 1. The applicant shall submit a revised waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include disposal/recycling of tires, batteries and other scrap parts generated from vehicle maintenance and disposal of solvent and sludge from the recycling machine including the names, telephone numbers and addresses of the waste handlers and disposal/recycling facilities. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved Waste Handling Plan, at all times. 4. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved Dust Abatement Plan, at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Non-Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 2 7. Sewage disposal shall be by septic system when the number of full time on site employees exceeds 2. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to On-site Wastewater Treatment Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes when the number of full time on site employees exceeds 2. 9. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. For employees or contractors on site for less than 2 consecutive hours a day and 2 or less full time employees on site, portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 10.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling. All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 11. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 12. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 13.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 3 MEMORANDUM ti r To: Diana Aungst, Planner October 16, 2014 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR14-0064 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV14-00088)was noted. This violation was initiated due to the operation of a Commercial Trucking operation without first completing the necessary Weld County Zoning Permits. This case has been forwarded to the County Attorney's Office and we have initiated legal action; therefore, an investigation fee IS required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. If this application if approved by the Board of County Commissioners and once a plat is recorded will correct this outstanding violation. If this application is denied,the Commercial Trucking operation shall be removed from the property within 30(thirty)days of denial or the violation will proceed in court accordingly. Water Division 1, Water District 1 Dear Ms. Aungst, This referral does not appear to qualify as a "subdivision" as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The application requests a site specific development plan and use by special review permit to allow a shop, employee and commercial truck parking on a 7.78 acre parcel described as Lot B of Recorded Exemption number RE-4314. The land is currently vacant. The proposal involves the construction of a shop, some on-site domestic animal watering and a possible future residence. According to the application materials, sanitary facilities will be provided for the shop through an on-site porta potty until a septic system is constructed; drinking water will be hauled in. The application materials reference an existing domestic and stock well that is shared with the land owner to the north of the property, well permit no. 286001. The materials go on to state that "if in the future the well is to be used for the building, a change of use will be processed with the state engineer's office." Permit no. 286001 was issued on June 23, 2011 as the only well on 38 acres, a portion of which includes the parcel subject to this application. The uses on the permit include household purposes inside three single family dwellings, the irrigation of up to one acre of home gardens and lawns, and the watering of domestic animals. The well was constructed in 2012 on Lot A of RE-4314 into the not-nontributary Laramie-Fox Hills aquifer. The uses allowed under this permit do not include commercial purposes. So long as permit no. 286001 exists, an exempt well permit will not be available on the subject property. If the owner of permit no. 286001 applies to re-permit the well, a new evaluation would be based on the size of the parcel on which the well is located. Since Lot B of RE-4313 is less than 35 acres, a new residential well permit would be limited to household uses only inside one single family dwelling with no outdoor uses allowed. So long as the applicant does not use water from the well operating under permit no. 286001 for any commercial purposes, including but not limited drinking and sanitary facilities in the shop and water for dust suppression, this office has no objection to this proposal. The applicant may be limited in their ability to obtain an exempt commercial well permit on this property in the future so long as well permit no. 286001 remains in effect.
