WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 17th day of October, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land, being the property of Alexander Grauberger, located in Section 14 , Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, and more particularly described as follows, to-wit: The West Half of the Northeast Quarter (W'NE4) , the Southeast Quarter of the Northeast Quarter (SE4, NE4) , and the Northwest Quarter of the Southeast Quarter (NW4 SE4) , all in Section 14 , Township 5 North, Range 65 West of the 6th P.M. , EXCEPT that portion described in deed dated August 29 , 1966, recorded August 30, 1966, in Book 573, under Reception No. 1, 494 , 628, Weld County Records . does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A (3) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED, by the Board of Wunty Com- missioners of Weld County, Colorado, that the hereinabove de- scribed parcel of land owned by Alexander Grauberger, be exempt from the definition of the terms, "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , Cf 6 _ 67 r.2 770709 CRS 1973. The parcel of land is described as Pt. of the EA of Section 14, T5N, R65W of the 6th p.m. , Weld County, Colorado. Said property is located 31 miles west of Kersey. The subject property contains 138. 665 acres of Class III and IV irrigated soils. The request is to split the property into parcels of 5. 165 acres and 133. 5 acres. Each of the two resulting parcels would contain an existing set of residential improvements. As indicated in his letter dated September 19, 1977, it is Mr. Grauberger ' s desire to convey the 5.165 acre parcel with the existing residents to his daughter who is currently residing on the property. It is also indicated that Mr. James Clark who is the purchaser of the property Lot B will have the first right of refusal to the 5. 165 acre parcel if that property is placed on the market for sale. Based upon the information submitted and the adopted policies in the county, the Planning Commission staff recommends the request be approved for the following reasons : 1. The City of Greeley Planning Commission has reviewed the request and indicated that they have no objections to the approval of the recorded exemption. 2. The proposed split conforms with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) , the intent clause of the Agricultural District (Section 3. 3(a) of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that each resulting parcel would have an existing set of improvements and the use would be compatible with the surrounding agricultural uses.
