HomeMy WebLinkAbout20152208.tiff RESOLUTION RE: ACCEPT REQUEST OF NOBLE ENERGY, INC., TO WITHDRAW APPLICATION FOR A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0022, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, OIL AND GAS SUPPORT AND SERVICE, INCLUDING STORAGE OF PIPE AND PRODUCTION EQUIPMENT, AND ANY LNG RELATED USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICT; AND A TRUCK PARKING AREA IN THE A (AGRICULTURAL) ZONE DISTRICT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on July 17, 2013, by Resolution #2013-1781, the Board approved the application of Noble Energy, Inc., 1625 Broadway, Suite 2000, Denver, CO 80202, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0022, for a Mineral Resource Development Facility, Oil and Gas Support and Service, including storage of pipe and production equipment, and any LNG related Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone District; and a truck parking area in the A (Agricultural) Zone District on the following described real estate, to-wit, and: Lot B of Recorded Exemption, RECX12-0069; being located in part of the E1/2 NW1/4 and the W1/2 NW1/4 of Section 26, Township 6 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, on July 22, 2015, the Board was presented with a letter, dated July 15, 2015, from the applicant requesting the withdrawal of the application, stating Noble Energy does not intend to utilize the site as a storage yard at this time, at which time the matter was continued to allow staff to confirm with the applicant concerning their decision and WHEREAS, on July 27, 2015, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to grant the applicant's request and thereby accept the withdrawal of the application. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Noble Energy, Inc., to withdraw the application for a Site Specific Development Plan and Use by Special Review Permit, USR13-0022, for a Mineral Resource Development Facility, Oil and Gas Support and Service, including storage of pipe and production equipment, and any LNG related Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone District; and a truck parking area in the A (Agricultural) Zone District on the parcel of land described above be, and hereby is, accepted. 2015-2208 PL2227 cc-PL(g()) �1aA ACCEPT WITHDRAW REQUEST (USR13-0022) - NOBLE ENERGY, INC. (Gill Storage Yard) The property is located on Lot B RECX12-0069 being part of the W2NW4 and E2 NW4 of Section 26,T6N, R64W of the 6th P M., Weld County Colorado and more specifically located South of and adjacent to County Road 66 Section Line, East of and adjacent to County Road 57, North of and adjacent to County Road 64.5 The Department of Planning Services has received a written request dated July 15, 2015(attached) from Mr. Greg Pickerel, Project Manager for Noble Energy, Inc.who indicates that Noble Energy has made a business decision to withdraw USR application and vacate the approved Board of County Commissioner Gill Storage Yard Site Specific Development Plan and Special Review Permit for Mineral Resource Development Facilities, Oil and Gas Support and Service USR13-0022 permit. AS the costs associated with permitting are high,did you want to request an extension to the timing of implementing the permit. By Code,the facility is required to be constructed within 3 years of Board of County Commissioners approval. The Board was seeking confirmation that Noble Energy had no plans now or in the future to utilize the current permit at the Gill location. If at all possible are you able or someone from your office to be in attendance at the 9:00 AM hearing on Monday July 27th?
