APPLICATION
On November 17, 2014, Apollo Operating, LLC (Operator No. 10051) ("Apollo" or
"Applicant") filed a verified application pursuant to §34-60-116, C.R.S., for an order to:
1) Vacate Order No. 407-536 which established an approximate 640-acre drilling
and spacing unit for the Application Lands, for the production of oil, gas and associated
hydrocarbons from the Niobrara Formation.
APPLICABLE RULES AND ORDERS

• On January 23, 2012, Order No. 407-536 established an approximate 640-acre drilling
and spacing unit, and approved one horizontal well within the unit, with the treated
interval of the permitted well to be located no closer than 600 feet from the boundaries of
the unit, for the production of oil, gas and associated hydrocarbons from the Niobrara
Formation.
NOTICE IS HEREBY GIVEN, pursuant to: 1) the general jurisdiction granted to the Oil
and Gas Conservation Commission of the State of Colorado under §34-60-105 C.R.S.; 2)
specific powers granted pursuant to §34-60-106 C.R.S.; 3) the State Administrative Procedures
Act at §24-4-105 C.R.S.; and 4) the Commission's Series 500 Rules at 2 CCR 404-1, that the
Commission has scheduled the above-entitled matter for hearing on:

At hearing, the Commission will consider the Application and enter an order pursuant to

January 12, 2015. Such interested party shall, at the same time, serve a copy of the protest or
intervention to the person filing the application. One electronic
(cogcc.hearings_unit@state.co.us), one original and two copies shall be filed with the
Commission. Anyone who files a protest or intervention must be able to participate in a
prehearing conference during the week of January 12, 2015. Pursuant to Rule 511., if the
matter is uncontested, it may 'oe approved without a hearing.

Apollo Operating, LLC ("Apollo" or "Applicant"), by and through its attorneys, Fox Rothschild
LLP, respectfully submits this Application to the Oil and Gas Conservation Commission of the State
of Colorado ("Commission") for an order vacating Cause No. 407, Order No. 407-536, establishing
a drilling and spacing unit, for the development of the Niobrara Formation, comprised of All of
Section 14, Township 5 North, Range 62 West, 6th P.M., Weld County, Colorado.
In support of its Application, Applicant states and alleges as follows:
1. Applicant is a limited liability company duly authorized to conduct business in the
State of Colorado, and is registered as Operator No. 10051 with the Commission.
2. Applicant owns substantial leasehold interests in the below-listed lands ("Application
Lands"):
Township 5 North, Range 62 West. 6th P.M.
Sections 14: All
Containing 680 acres, more or less
3. A map depicting the acreage comprising the Application Lands is attached hereto
and incorporated herein as Exhibit A.
• 4. On April 27, 1998, the Commission adopted Commission Rule 318A, which among
other things, allowed certain drilling locations to be utilized to drill or twin a well, deepen a well or
recomplete a well and to commingle any or all Cretaceous Age Formations from the base of the
Dakota Formation to the surface. Commission Rule 318A supersedes all prior Commission drilling
and spacing orders affecting well location and density requirements of Greater Wattenberg Area
wells.
5. On December 5, 2005, Commission Rule 318A was amended, among other things,
to allow interior infill and boundary wells to be drilled and wellbore spacing units to be established.
6. On August 8, 2011, Commission Rule 318A was again amended, among other
things, to address drilling of horizontal wells. The Application Lands are subject to Commission
Rule 318A for the Niobrara Formation.

7. The Application Lands lie entirely within the Great Wattenberg area as set forth in
Commission Rule 318A.
8. On January 23, 2012, the Commission entered Cause No. 407, Order No. 407-536
which, among other things, established an approximate 640-acre drilling and spacing unit
comprised of All of Section 14, Township 5 North, Range 62 West, 6`h P.M., Weld County,
Colorado, and approved one (1) horizontal well for such drilling and spacing unit for the production
of oil, gas and associated hydrocarbons from the Niobrara Formation, the treated interval of which
to be located no closer than 600 feet from the boundaries of such drilling and spacing unit ("Order
No. 407-536").
9. As of the filing of this Application: (a) no horizontal wells have been drilled on the
Application Lands pursuant to Order No. 407-536 and (b) there are no pending or issued
Applications for Permit to Drill covering the Application Lands.
10. The effect of vacating Order No. 407-536 will be the return of the Application Lands
to the establishment of drilling and spacing units for horizontal wells subject to the provisions of
Commission Rule 318A.
11. No interested party will be prejudiced by the granting of the relief sought herein,
which relief will prevent waste, protect correlative rights, and provide predictability with respect to
the development of the Application Lands.
12. The granting of this Application is in accord with the Oil and Gas Conservation Act,
found at § 34-60-101, et seq., C.R.S., and the Commission Rules.
13. That the names and addresses of the interested parties (owners within the
Application Lands) are attached hereto and incorporated herein as Exhibit B.
14. Applicant shall submit a certificate of service for this Application within the seven (7)
days required by Commission Rule 503.e.
WHEREFORE, Applicant respectfully requests that this matter be set for hearing, that notice
be given as required by law, and that upon such hearing this Commission enter its order:
A. Vacating Order No. 407-536; and
B. For such other findings and orders as the Commission may deem proper or advisable
in the premises.
