Bradford Janes, Professional Forester Liaison, Office of Special Projects Subject: Parcel 122 - Resource Development Project OMILR Permit NI-2015-033 For greater continuity and ease of reference, we have iterated the comments from the OMLR Adequacy Review of 6 August 2015, necessitating a reply according to its respective items, iterated in a graphical box, with our comments in blue following: On July 28, 2015, the Division of Reclamation, Mining and Safety (Division/DRMS) received the 112 Construction Materials Reclamation Permit Application package for the Parcel 122 — Resource Development Project. Preliminary review of the information received determined the following items must be received before the Division can consider the application as being submitted and technical review can begin: Application Form 1. The Division requires the permit application list the exact company name registered with the Colorado Secretary of State office, "Varra Companies, Inc.". Please revise the company name on the notary section of the certification page, Page 8 of the application form, to indicate "Varra Companies, Inc.". Please refer to the corrected page 8 as revised, signed and notarized on 20 August 2015. 1 6.4.1 Exhibit A - Legal Description 2. Rule 6.4.1(1) states the legal description shall be by, township, range and section, to at least the nearest quarter-quarter section. The applicant provided the legal description to the quarter-quarter section only on the Exhibit B - Index Map. Please provide the legal description to the nearest quarter-quarter section as required by the Rule in Exhibit A. Please refer to the corrected Exhibit A - as revised on 25 August 2015. 6.4.18 Exhibit R — Proof of Filing with County Clerk and Recorder 3. Please provide an affidavit or receipt indicating the date on which the revised application documents were placed with the weld County Clerk and Recorder in response to this letter. Please refer to the signed, dated, and stamped receipt of this correspondence and attached materials as provided to the Weld County Clerk to the Board on 25 August 2015. 6.4.19 Exhibit S - Permanent Man-made Structures 4. The Applicant did not provided (sic) Exhibit S as part of the permit application package. Please provide a list of any significant, valuable and permanent man-made structures located within two hundred (200) feet of the affected land. The Applicant must attempt to obtain structure agreements with all property, including easement holders, and structure owners within two hundred feet of the affected land. The Division will not consider the engineering evaluation submitted by the Applicant as part of the permit application until all appropriate attempts to obtain structure agreements have been exhausted and documentation of the attempts are provided to the Division. Included with this correspondence, please find an updated and revised Exhibit C, identifying a list of structures for each appropriate Owner. Also included is an updated and revised Exhibit C-l: Existing Conditions Map where the Rules provide for the identification of structures on a map under this Exhibit. Exhibit C-1: Existing Conditions Map is now at a larger scale to aid identification of Owners and Structures respective of the identified Permit Boundary and correlated Extraction Limits. While the Engineering Evaluation assures adjacent owners of structures and property that planned extraction does not threaten those structures. it further 2 addresses planned extraction that the Office of \lined Land Reclamation (O -1LR) has concerned itself routinely in previous applications, and should be considered as appropriate to considerations detailed in other exhibits and correlated maps. Notification and attempts to obtain structure agreements will commence subsequent to the first publication. We will provide evidence of attempts to obtain structure agreements with all owners of structures within 200 feet of the permit boundary along with our proofs of publication and notification of adjacent surface owners of record as part of the review process subsequent to a finding of 'Completeness' of the application. The application will not be considered submitted until the information listed above is received and found sufficient to begin our review. A decision date will be established 90 days from the date of receipt of all of the requested information. Additionally, if you have already published notice you will need to republish notice, after the Division considers the application submitted. This notice must be published once a week for four (4) consecutive weeks, starting within ten (10) days of the date your application is considered submitted. We will notify you when you should initiate republication of your notice. The final date for receiving comments is the twentieth (20th) day after the fourth publication or the next regular business day. You have sixty (60) days from the date of this letter to submit all necessary documents the Office needs for the application to be considered filed. If, at the end of the sixty day period, application has not been determined to be filed the PP with the Office, the Office shall deny the application and terminate the application file. The response due date is October 5, 2015. This letter shall not be construed to mean there are no other technical deficiencies in your application. The Division will review your application to determine whether it is adequate to meet the requirements of the Act after submittal of all required items. Acknowledged. It is also our understanding that an applicant can withdraw an application and the Division will refund the application fee. Description shall be by (a), township, range, and section, to at least the nearest quarter-quarter section and (b), location of the main entrance to the site reported as latitude and longitude, or the Universal Transverse Mercator (UTM) Grid as determined from a USGS topographic map. A metes and bounds survey description is acceptable in lieu of township, range, and section. Where available, the street address or lot number(s) shall be given. This information may be available from the County Assessor's office or U.S. Geological Survey (USGS) maps. The property boundary comprises 156.78± acres.
