WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined, at a public hearing held on the 4th day of May, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land is owned by Haiko H. Eichler and Monika S. Eichler, West of Mead, Colorado, 80542 , which land is more particularly described as follows , to-wit: The South Half of the North Half and the North Half of the North Half of the South Half of the Northwest Quarter of Section 32, Township 4 North, Range 68 West of the 6th P.M. , Weld County, Colorado containing 60 Acres. WHEREAS , Haiko H. Eichler and Monika S. Eichler desire to split the hereinabove described tract of land into two parcels , and WHEREAS, Section 9-4A (6) of the Weld County Subdivision Regulations requires that a lot size variance be obtained before a Recorded Exemption is granted to the applicant, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4A (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED that a variance from lot size requirements be granted to Haiko H. Eichler and Monika S . Eichler for the above described parcel of land. The subject pro- perty is described as part of the NW* of Section 32 , T4N, R68W of the 6th P.M. , Weld County, Colorado. Said parcel is located 2-3/4 miles north and 2 miles west of Mead. The subject property contains approximately 60 acres of predominantly Class IV soils. The request is to obtain a variance from the minimum lot size requirement , Section 9-4(A) (6) , so that Mr . Eichler may make application to apply for a recorded exemption. Section 9-4(A) (6) states, "that the original tract or parcel of land to be divided under this section meets the minimum lot size requirements established by the Weld County Zoning Resolution: variance from the requirement being allowed only upon good cause being shown to the Board of County Commissioners, or where said tract or parcel land lies within the comprehensive plan area of an existing incorporated town of Weld County. (Re- vised 4/17/74) . " If this lot size variance is granted, Mr. Eichler will pro- ceed with his application for a recorded exemption to divide the property into two lots. One lot is proposed to contain approximately forty acres with an existing set of improvements. The second is proposed to contain approximately twenty acres which presently is an unimproved parcel . Based upon the information submitted and the adopted policies in the county, the Planning Commission staff recommends the request be approved for the following reasons: ( 1) The town of Mead Planning Commission has indicated the town of Mead has no objections to the granting of this lot size variance request . (2) The request complies with the intent clause of the recorded exemption procedure in that non-productive agricultural land (Class 4 soils) is proposed to be split and utilitzed for residential purposes which would be com- patible with land uses in the surrounding area. There are several reasons for our desire to split the property into two separate parcels. 1. The original filing of the proerty already separated the said property into two parcels, namely a 20 acre and a 40 acre parcel. However the mistake was made to separate into a north 40 and a south 20. We actually needed it the other way around, that is the north 20 and the south 40, as it is proposed now. 2. Due to the fact, that we are not now actively farming the non- irigated land, it has become an increasingly difficult burden to effectively control the weeds etc. which I feel, can be accomplished better by splitting that responsibility in half. 3. I feel that our request should be granted relative to other properties around us with similar circumstances, namely a 20 acre parcel just to our south where variances have been granted for a home on a. 2 acre lot and an additional home on the remaining 18 acres. 4. City water taps are available from the Little Thompson Water District and are not restricted at this time. waste disposal to be accomplished by means of a septic system, presently judged by ecological and environmental agencies to be the preferred and super for method of waste disposal relative to city disposal systems. The dimensions of the total nronerty are: 994.31 x 2641.68, approximately. The Planning Department has informed us that the nronerty has now merged back into one parcel. We are asking for a variance from Senate Bill #35 to sell off the NORTH 20 acres, being the N 1/2 S 1/2 N 1/2 NW 1/4 of Sec. 32 TS4N 16 SW of the 6th P.M., Weld County, Colorado with dimensions of 331 x 2620 feet. There is a Little Thompson Water District line in the road along the west side of the property. There is no sewer line, however, an individual tyre septic system can be utilized very easily. Dear Ms. Wells : The materials necessary for the above described request are complete with one exception. It would be very helpful if you would submit a letter indicating the particular circum- stances and reasons the Eichlers desire to split the pro- perty and what their intentions and proposed uses are with the two resulting parcels . When a request of this nature occurs within a three mile radius of an existing town, it is the policy of Weld County to refer the request to that particular town for review and comment . In this particular case, our office will refer the request to the Town of Mead which, according to our records, will conduct its next Town Board Meeting on May 2, 1977. Therefore, I have tentatively scheduled the meeting by the Board of County Commissioners for May 9, 1977, in order to give the Town of Mead an opportunity of review and comment on the request . The meeting with the County Commissioners will take place in the County Commissioner Hearing Room, First Floor, Weld County Centennial Center, 915 10th Street , Greeley, Colorado . It is recommended that you and/or a repre- sentative be there to answer any questions the Board might have on your request .
