County of Weld, State of Colorado Parcel: 028523000003 USR Questionnaire Questions 1-11 1. Explain in detail the proposed use of the property: Whiting Oil and Gas Corporation has leased the NE '/a of Section 23, T10N, R58W of the 6t'' P.M. and would like to construct a 100' communications tower and small (8' x 12') communications building on the Razor site which requires approval of a USR application. The tower will be used to relay critical operational data from field locations to operators and engineers in offices in Denver. Site is zoned Agricultural AG, tract of land is 220' x 220' more or less (1 . 11 acre). Floodplain, Geological Hazard and Airport Overlay = N/A. See attached documents for further clarification on the need for the tower. 2. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan: G. A. Goal 7. 2. A. Policy 7.2 states that conversion of agricultural land to nonurban residential, commercial and industrial uses should be accommodated when the subject is in an area that can support such development and should attempt to be compatible with this region. All other goals are in compliance with this USR. The proposed tower and building are located in an area that is located in the Agriculture Zone. Although the tower is not an agricultural use, it is a land use that is commonly located in agricultural areas and does not conflict with the goals outlined. Careful site planning can be developed with only a minimal localized loss of agricultural land quality. Ground disturbance is minimized. Impacts to environmental resources such as air, water, waste, noise, and public health would be minimal and limited to the construction period (see Sections 21 -3-330.B.5.g, 21 -3-330.B. 12, and 21 - 3-330.B. 15). Mitigation practices shall be implemented to minimize impacts to environmental resources. Natural resources such as sensitive wildlife areas, recreation areas, and mineral and energy resources would not be impacted by the proposed Project. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located: Structures and buildings may be constructed, occupied and operated and maintained in the A (Agricultural) zone district upon approval of a permit in accordance with the requirements and procedures set forth in Article II, Division 4 of this Chapter: L. Telecommunication antenna towers which require a USR are subject to Article IV, Division 10 of this chapter. 4. What types of uses surround the site (explain how the proposed use is consistent and comparable with surrounding land uses): AG-A, the surrounding area is agricultural use and pasture land within a 1 mile minimum radius. 5. Describe in detail, the following: a. Number of people who will use this site: Approximately, one person once a month. b. Number of employees proposed to be employed at this site: None for the communications tower. c. Hours of operation: 24 hours per day, seven days per week. d. Type and number of structures to be erected (built) on this site: An 8' x 12' building for instrumentation, see attached Thermobond Building index and drawings Exhibit B. 1 Parcel #028523000003 e. Type and number of animals, if any to be on this site: None. f. Kind of vehicle (type, size, weight) that will access this site and how often: One 3/4 toil pickup truck once per month. g. Who will provide fire protection to the site: All applicable fire laws and regulations, as outlined in the Colorado Revised Statutes (CRS) 31 -16-601 , would be observed during the construction period. The Pawnee Fire Protection District will be sent a Notification Form as well. h. Water source on the property: Not applicable, there will be no water on site. Pasture land, no irrigation. i. Sewage disposal system on the property: Not applicable, there will be no water, waste water or sewage on site. j. If storage or warehousing is proposed, what types of items will be stored: Not applicable, there will be no storage on site other than temporary storage of construction materials during the construction phase. 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal: There will be no landscaping plan submitted and no landscaping will be completed at site. Land is not irrigated; no water is available. Any surrounding area affected will be returned to natural condition and the remaining areas will be left undisturbed. Waiver request included in this package. 7. Explain any proposed reclamation procedures when terminating of the Use by Special Review activity occurs: Whiting will remove the tower, associated building and foundations at their expense once deemed abandoned. The land will be returned to its natural state in order to preserve the natural surrounding landscape and will conduct its construction operations so as to prevent any unnecessary destruction, scarring, or defacing of the natural surroundings in the vicinity of the work. Mitigation practices shall be implemented to minimize impacts to environmental resources. Except where clearing is required for permanent works or excavation operations, all trees, native shrubbery, and vegetation shall be preserved and protected from damage by the construction operations and equipment. Any and all destruction, scarring, damage, or defacing of the landscape resulting from the contractor's operations shall be repaired by the contractor. See Decommissioning Plan. 8. Explain how the storm water drainage will be handled on the site: Storm water will be unaffected except for the drainage from the building roof and the foundation pad from the tower. This project would not create runoff in excess of previous levels and will not adversely affect drainage. There would be no alteration in the pattern or intensity of surface drainage as a result of construction and during normal operation. See Drainage Impact Calculation Sheet. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin: Tower construction and the 8' x 12' building delivery is scheduled to begin immediately after USR application is approved. We anticipate it will take 2 — 4 weeks. Whiting would like to request early release of a building permit to allow construction of the foundation (before it gets too cold to pour the foundation). Construction of the tower and building will wait until the USR application and all applicable permits are approved. 10. Explain where storage and/or stockpile of wastes will occur on this site: Not applicable - there will be no storage and/or stockpile of wastes on this site. 11. List all proposed onsite and off-site improvements associated with the use (example: landscaping, fencing, drainage, turn lanes, etc.) and a timeline of when you will have each one of the improvements completed. Onsite and/or offsite improvements are not planned except: (1) Road access gate at the point of access as stated in the Amended Lease Agreement attached. (2) Gravel of the access road (3) Proposed tower will be located within fence onsite. All improvements will begin when USR application is approved and be completed within a month. 2 2 Parcel #028523000003 Sec. 23-4-810: Preferred order for locating Telecommunication Facilities D. TELECOMMUNICATION ANTENNA TOWER. New TELECOMMUNICATION ANTENNAS must use the most preferred facility type where economically and technically feasible. A lesser preferred facility type is allowed only if the applicant presents substantial evidence to show it will have a lesser visual impact than the use of more preferred facilities and that the applicant's desired geographic area cannot be served by using more preferred facilities. (Weld County Code Ordinance 2010-6) New Telecommunication Tower: Attached is a letter from End 2 End Technologies addressing the co-location opportunities available which do not provide coverage for the desired operating area. In addition, Whiting does not intend to co-locate due to economic, technical and safety reasons. Due to safety concerns, Whiting does not co-locate its transmitters on third party towers. Because the towers are needed to facilitate data transmission from well sites, production batteries and pipelines, Whiting requires that only Whiting personnel be permitted access to its towers and transmitters to prevent unintentional disruption of communication services. COGCC — Colorado Oil and Gas Conservation Commission regulation Sec. 7-11-8 Colocation, 7-11-9 Separation Allowances, 7-11-10 Location Exceptions — (2) a. Moving the location of the tower or antenna to a more appropriate available site; b. Using a different technology that will lessen the impact of the tower antenna; c. Requiring an appropriate alternative tower structure; or d. Other actions which will disguise or otherwise lessen the impact of the tower or antenna. (Ord. 531.S1, 2006). Sec. 23-4-820: General Requirements A. TELECOMMUNICATION FACILITIES on Residential Properties. TELECOMMUNICATION FACILITIES may not be placed on properties or buildings used primarily for residential purposes. This does not apply to buildings containing eight (8) or more dwelling units or farms and ranches containing dwelling units. This tower location is in an agricultural, non-residential area. B. 3. TELECOMMUNICATION ANTENNA TOWERS are permitted either as a use by right, accessory use, or Use by Special Review in the following zone districts: C, I, A and PUD (with Commercial or Industrial uses). USR — industrial use, communication tower and communication building. C. Accessory uses to a TELECOMMUNICATION ANTENNA AND ELECOMMUNICATION ANTENNA TOWER shall not include offices, broadcast studios, long-term vehicle storage or other outdoor storage, or other uses not needed to send, receive or relay transmissions. (Weld County Code Ordinance 2010-6). A communications building (8' x 12') is included on site only in order to facilitate communication transmissions. There will be no onsite or long term storage. Sec. 23-4-830: Standards for Telecommunication Antenna Towers A. TELECOMMUNICATION ANTENNA TOWERS are allowed as a use by right, accessory uses, subject to Zoning Permit for TELECOMMUNICATION ANTENNA TOWER requirements, or as a Use by Special Review Permit, per the height guidelines below. The height of a TELECOMMUNICATION ANTENNA TOWER is defined as the distance from the finished grade at the TELECOMMUNICATION ANTENNA TOWER base to the highest point of the TELECOMMUNICATION ANTENNA TOWER. Overall TELECOMMUNICATION ANTENNA TOWER HEIGHT includes the base pad, mounting structures and panel antennas, but excludes lightning rods and whip antennas. 3 Parcel #028523000003 Use by Right or Zoning Permit for Use by Special Review Permit Accessory Use TELECOMMUNICATIONS ANTENNA TOWER approval required Up to 35 feet in height > 35 feet up to 70 feet in height Greater than 70 feet in height Height guidelines for this 100' tower require a USR. B. Radial Spacing. TELECOMMUNICATION ANTENNA TOWERS over thirty-five (35) feet high must be located at least one thousand (1,000) feet from other TELECOMMUNICATION ANTENNA TOWERS over thirty-five (35) feet high that are capable of supporting TELECOMMUNICATION FACILITIES. Closer spacing between TELECOMMUNICATION ANTENNA TOWERS may be granted through the Use by Special Review process. This radial spacing requirement does not apply to facilities located at designated antenna farms. Radial spacing requirements for this 100' tower require 1 ,000 feet minimum distance from other telecommunication towers over 35' high that are capable of supporting telecommunication facilities. Closed spacing requires a USR. This location requires a USR and does not intend to co-locate due to economic, technical and safety reasons. C. In addition to meeting the Use by Special Review standards set forth in Article II, Division 5 of this Chapter, the applicant shall submit documentation addressing the following standards: 1. Existing or approved TELECOMMUNICATION ANTENNA TOWERS cannot accommodate the telecommunications equipment planned for the proposed TELECOMMUNICATION ANTENNA TOWER. Attached is a letter from End 2 End Technologies that details the applicant's results for co-location possibilities. The summary of the letter states that there are no towers that meet the locational and technical requirements of the applicant therefore a new tower in Section 23 is required. In addition, Whiting does not intend to co-locate due to economic, technical and safety reasons. Due to safety concerns, Whiting does not co-locate its transmitters on third party towers. Because the towers are needed to facilitate data transmission from well sites, production batteries and pipelines, Whiting requires that only Whiting personnel be permitted access to its towers and transmitters to prevent unintentional disruption of communication services. COGCC — Colorado Oil and Gas Conservation Commission regulation Sec. 7-11-8 Coloration, 7-11-9 Separation Allowances, 7-11-10 Location Exceptions — (2) a. The TELECOMMUNICATION ANTENNA TOWER shall not constitute a hazard to aircraft. Antenna tower does not constitute a hazard to aircraft due to location and 100' height. 3. The TELECOMMUNICATION ANTENNA TOWER shall be placed on the property to contain on site all ice-fall or debris from TELECOMMUNICATION ANTENNA TOWER failure. The proposed communications tower will be located on site and entire fall zone is included. The lot will be able to contain on-site all ice-fall or debris from the tower. 4. The proposed TELECOMMUNICATION ANTENNA TOWER shall be designed and provide for CO-LOCATION. The Board of County Commissioners may revoke permits or other administrative approvals if conditions for approval of a TELECOMMUNICATION ANTENNA TOWER includes CO-LOCATION, but: Whiting does not intend to co-locate the proposed communications tower as noted above in C. 1 . 4 Parcel #028523000003 5. The TELECOMMUNICATION ANTENNA TOWER shall have the least practicable adverse visual impact on the environment. The proposed communication tower will be located on a remote location; visual impacts on the environment will not be an issue. See attached documentation for intent and technical specifications/requirements for tower. 6. The proposed TELECOMMUNICATION ANTENNA TOWER shall not emit radiation that will adversely affect human health. The proposed tower will not emit radiation that will adversely impact human health. 7. The proposed TELECOMMUNICATION ANTENNA TOWER shall be the minimum height needed to accommodate the TELECOMMUNICATION ANTENNA. The proposed tower will be no taller than the minimum height required in order for designed/intended tower performance. 8. The proposed TELECOMMUNICATION ANTENNA TOWER shall comply with all applicable federal and State regulations. The proposed tower complies with all federal and state regulations. 9. The design of the proposed TELECOMMUNICATION ANTENNA TOWER shall insure structural integrity. The proposed tower will be professionally engineered and constructed to ensure structural integrity. 10. The proposed TELECOMMUNICATION ANTENNA TOWER shall have adequate measures to discourage unauthorized climbing and to insure the security thereof. The proposed tower will be located within fenced-in site and include adequate measures to discourage unauthorized climbing. 11 . All reasonably possible sites for the TELECOMMUNICATION ANTENNA TOWER have been considered, and the proposed site is the most appropriate, available site from a land use perspective. All reasonable sites have been considered and proposed site is in the most appropriate location. 12. The proposed TELECOMMUNICATION ANTENNA TOWER shall not adversely impact wildlife. The proposed tower location shall not impact local wildlife due to minimal footprint and fenced in site. 13. A Decommissioning Plan. Adequate financial assurance to cover the decommissioning of the facility may be required as a condition of approval of the Decommissioning Plan. Whiting will remove the tower, associated building and foundations at their expense once deemed abandoned. The land will be returned to its natural state. See attached Decommissioning Plan. D. TELECOMMUNICATION ANTENNA TOWER and Equipment Setbacks. 1. TELECOMMUNICATION ANTENNAS, ATTACHED and other appurtenances may encroach up to two (2) feet into the minimum building setbacks in the underlying zoning district but must not extend over property lines. Minimum setback will not extend beyond property lines. 2. Minimum setbacks for TELECOMMUNICATION ANTENNAS, CONCEALED are the same as the minimum building setbacks in the underlying zoning district. Minimum setbacks are according to Zone A. 3. Minimum setbacks for TELECOMMUNICATION ANTENNA TOWERS are as follows: a. From property lines of properties in the A, C, I and PUD (with Commercial or Industrial uses) zones: one-hundred percent (100%) of the TELECOMMUNICATION ANTENNA TOWER HEIGHT but not less than minimum building setbacks in the underlying zone district. For property located in Agricultural zone, 100% of tower height will be located within property. 5 Parcel #028523000003 4. Guy wires and equipment buildings and cabinets. No part of the TELECOMMUNICATION ANTENNA TOWER system, including any guy wire anchors, shall extend closer than thirty (30) feet to the property boundary. Guy wires/anchors - if required: Will be located no closer than 30' to property boundary. E. TELECOMMUNICATION ANTENNA TOWER and Equipment Design. 1. A TELECOMMUNICATION ANTENNA, ATTACHED on a roof may extend up to fifteen (15) feet over the height of the building or structure and may exceed the underlying zoning district height limitation. TELECOMMUNICATION ANTENNAS, ATTACHED mounted on a building or structure wall must be as flush to the wall as technically possible, and must not project above the top of the wall, and must be located, painted and/or screened to be architecturally and visually compatible with the building it is attached to — Not applicable. 2. TELECOMMUNICATION ANTENNA TOWERS should be painted or coated in earth-tone colors that blend, to the extent possible, with the surrounding building and natural environment, unless State or Federal regulations require specific colors. The tower will maintain a galvanized finish to best reflect the ambient lighting conditions during daylight hours. 3. TELECOMMUNICATION ANTENNA TOWERS must not be artificially lighted unless required by the FAA or other State or Federal agency. Security lighting on the site may be mounted up to twenty (20) feet high and must be directed toward the ground to reduce light pollution, prevent offsite light spillage and avoid illuminating the TELECOMMUNICATION ANTENNA TOWER. Tri-State received a "Determination of No Hazard" from the FAA (Appendix E). No security lighting will be installed for the tower. Lighting will be provided only for maintenance activities. 4. Equipment buildings must be compatible with the architectural style of the surrounding building environment with consideration given to exterior materials, roof form, scale, mass, color, texture and character. Equipment buildings must be constructed with materials that are equal to or better than the materials of the principal use. Equipment cabinets must be located, painted and/or screened to be architecturally and visually compatible with the surrounding building and natural environment. The communications building will be 8' x 12' and compatible with surrounding building environment. 5. The maximum permissible noise level shall adhere to the maximum permissible noise levels allowed in the underlying zone district as delineated in Section 14-9-30 of this Code. Equipment must not generate noise that can be heard beyond the site. However, this does not apply to generators used in emergency situations where the regular power supply for a facility is temporarily interrupted. It also does not apply to air conditioners or noise made during regular maintenance and upkeep of the facility and site. The Project would be constructed and maintained in accordance with Colorado Revised Statutes 25- 12-101 et seq. (Noise Abatement) and Article IX, Section 14-9-10 et seq. of the Weld County Code. See Section 21 -3-330.B. 15. F. Base or Accessory Site Design. 1. Screening and landscaping appropriate relative to the site and surrounding environment is required when any part of the facility is visible from public rights-of-way or adjacent properties. No screening or landscaping is proposed and the site is not irrigated. 2. Existing vegetation and grades on the site should be improved or preserved to the extent possible. Only a minimum amount of soil and vegetation will be disturbed during construction. During normal operation and maintenance, no soils will be disturbed. 3. Signage at the site is limited to non-illuminated warning and equipment identification signs. No illuminated signage is proposed for the facility. 6 Parcel #028523000003 4. TELECOMMUNICATION ANTENNAA FACILITIES, except those in the C and I zones, most not include manned offices, long-term vehicle storage or other outdoor storage, or other uses not needed to send, receive or relay transmissions. There will be no offices, vehicle storage or other outdoor storage at the site. G. Abandonment. 1. If the Use by Special Review has not commenced within three (3) years from the date of approval, or is discontinued for a period of three (3) consecutive years, it shall be presumed inactive or abandoned. The COUNTY shall initiate an administrative hearing to consider whether to grant an extension of time to commence the use or revoke the use. If the use is revoked, it shall be necessary to follow the procedures and requirements of this Division in order to re-establish any subsequent Use by Right or Use by Special Review. Upon the determination that the use has been abandoned, the facility owner has ninety (90) days to re-use the facility or transfer the facility to another owner who will re- use it. Evidence of such shall be provided, in writing, to the Department of Planning Services. Removal of abandoned TELECOMMUNICATION ANTENNA TOWERS shall be addressed in all lease agreements and shall specifically address the duties and obligations of the lessee and its assigns as well as the property owner regarding the removal of TELECOMMUNICATION ANTENNA TOWERS deemed by the County to be abandoned. Noted by Whiting - Included in our application package is a copy of the Amended Lease Agreement between Timbro Ranch & Cattle Co., LLC. Under the Condition of Property section is language pertaining to plans for removal of improvements and restoration to its original condition. See attached Decommissioning Plan. Whiting will remove the tower, associated building and foundations at their expense once deemed abandoned. The land will be returned to its natural state in order to preserve the natural surrounding landscape and will conduct its construction operations so as to prevent any unnecessary destruction, scarring, or defacing of the natural surroundings in the vicinity of the work. Mitigation practices shall be implemented to minimize impacts to environmental resources. Except where clearing is required for permanent works or excavation operations, all trees, native shrubbery, and vegetation shall be preserved and protected from damage by the construction operations and equipment. Any and all destruction, scarring, damage, or defacing of the landscape resulting from the contractor's operations shall be repaired by the contractor. 2. The applicant or owner shall submit an Improvements Agreement agreeing to remove the improvements as shown in the application, plans, plat and other supporting documents. The agreements shall be made in conformance with the County policy on collateral for improvements. A report describing the TELECOMMUNICATION FACILITY and the technical, economic (if deemed necessary by the Department of Planning Services) and other reasons for its design and location; the need for the TELECOMMUNICATION FACILITY and its role in the network; and the capacity of the structure, including the number and type of antennas it can accommodate. The Razor communications tower and building are needed to facilitate data transmission from well sites, production batteries and pipelines to the SCADA system. See attached Exhibit B — Thermobond building drawings for design specifications. The FAA response to the Notice of Proposed Construction or Alteration (FAA Form 7460-1 or equivalent), if the facility is located near an airport or a flight path. The applicant or owner may also be required to submit an Improvements Agreement agreeing to remove the improvements as shown in the application, plans, plat and other supporting documents.
