WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated January 3, 1973, the Board of County Commissioners of Weld County, Colorado expressed an inten- tion to limit the disposal of solid and/or liquid waste to those sites under contract with Weld County Landfill, Inc. , and WHEREAS, by an Assignment dated November, 1976, Weld County Landfill, Inc. assigned to Ralph Rohweder, all its right, title and interest in those leases, contracts and permits giving it the right to operate said sites, and WHEREAS, Ralph Rohweder has requested that Weld County approve an increase of dump rates so that he may operate the dump sites more efficiently, said proposed new rates being more fully set forth in "Exhibit A" , attached hereto and made a part of this Resolution by this reference, and WHEREAS, after taking into consideration all the facts presented to the Board of County Commissioners, said Board deems it advisable and in the best interest of Weld County, Colorado to approve said increase of dump rates for Weld County Landfill, Inc. . NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that an increase of dump rates for Weld County Landfill, Inc. , as more fully set forth in "Exhibit A" , attached hereto, be and hereby are, approved, said rates to be effective July 1, 1978 . Weld County Finance Officer, Tom Dority, and Operator of Weld County Landfill Inc. , Ralph Rohweder, presented the proposed increases. Representatives of some of the private trash hauling companies within Weld County were present and commented on the increases. Recommendations were made that the Board consider an increase of $ . 80 to $. 85 basic rate per yard and also to consider charging a higher fee to persons hauling trash to the dump which is not covered and further to consider including a lesser rate for loose trash verses compacted trash. The private entities also requested that the Board list in its contract with Weld County Landfill Inc. certain conditions covering safety of the dump sites, access to the sites and a general overall condition of the sites. After lengthy discussion, Commissioner Steinmark made a motion to table the decision on the dump rates for Weld County Landfill Inc. until the Board can review the contract and until it can determine if $ . 90 is a proper rate and if different prices for loose yard trash and uncovered and covered trash should be included. Commissioner Carlson seconded the motion. Commissioner Steinmark then amended her motion to state that the hearing would be continued to Wednesday, May 24 at 9: 00 A.M. The vote was taken and the motion, with amendment, carried unanimously. All five commissioners were present for the hearing. �,�.2,� . I have reviewed Ralph Roweder's request for a rate increase for the various landfill sites and for certain changes in operations. Ralph has provided me with financial statements from his accountant for 1977 and with actual volume figures for each site in 1977. I have used this data as a basis for a model to determine the effect of rate increases or other changes. Presently, the combined volume for all six Weld County landfill sites is approximately 435,318 yards per year. At 75¢ per yard, the revenue has been $326,492. The annual expense has been $309,415, leaving a net income of $17,077. This amounts to 5.2% of sales and allows for no capital investment in equipment. It amounts to a profit of approximately 4¢ per yard. -A rate increase to 90¢ per yard would produce revenue of $391 ,784, resulting -in a net income of $62,405. This amounts to an increase of $45,328, all or _part of which could be reinvested in _equipment. With the current rate, the Greeley site is the only one that operates at a profit. This is clearly due to the large volume and to the relatively fixed -costs, as compared to the smaller sites. The Eaton site currently operates at a loss and with a relatively small volume, however the Eaton site would operate at a small profit at 90¢ per yard. The Windsor site has a very small volume and will operate at a small loss even with the 90¢ rate. Prospect Valley has nearly no volume and operates at a considerable loss. The circumstances suggest quite strongly a continued effort to reduce the number of Weld County landfills and channel as much volume as possible into only two sites. We are continuing to look into alternatives such as transfer stations or closing certain of the landfills. Eaton or Windsor, with combined volume, could operate at a profit. Likewise, a single landfill site in the South County, with the combined volumes of Erie, Ft. Lupton, Prospect Valley, could operate at a profit. I have recommended that the Erie site be closed because it appears to serve 'primarily Boulder County, and because it continues to operate at a loss. I tave asked Tom David for some legal opinions regarding the Erie site, after which I can make further recommendations to you. Meanwhile, I believe that we must continue the current operation. Recommendations. 1 . Increase the minimum rate per yard from 75¢ to 90¢. This will allow capital investment in equipment for better operation of the landfills. It will still be lower than the rates charged per ton by Boulder County. 2. Increase the minimum charges on personal autos from 75¢ up to $1 .00 per sedan, and from $1 .25 up to $1 .75 per station wagon. These charges will be equiva- Lent to the typical minimum loads. They will also be equivalent to the typical Dun,, rates for Weld County Landfill Page two monthly expense for the customer to hire a commercial hauler. This implies a policy to encourage the use of commercial haulers, presumably resulting in less trash along the roadside, greater safety at the landfill site, and greater compaction at this site. 3. Do not change the hours of operation at Eaton landfill . There will be no need to reduce the opening days because the 90¢ rate would eliminate the loss at this site. 4. I have suggested to Ralph that he change the basis of the concession agreement that he has at the Erie and Ft. Lupton sites. Currently the operators at those sites retain 90% of the proceeds and remit 10% to Landfill , Inc. However, typically Landfill , Inc. 's expenses are greater than that 10%. With an increase to 90¢ per yard, I have suggested that the landfill operator retain 100% of the proceeds less actual expenses of Landfill , Inc. This results in more money for the operator and no loss for Landfill , Inc. It could be an incentive for the operator to rely less on Landfill , Inc. for the proper equipment and coverage. 5. Although I can find no requirement for a public hearing, I would suggest that a hearing be set for a regular Board Meeting, with notices mailed to each of the commercial hauling companies.
