RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR RESURFACING AND
REALIGNMENT OF COUNTY ROAD 40 AND AUTHORIZE CHAIR PRO-TEM TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding for
resurfacing and realignment of County Road 40, between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, on behalf of the Department
of Public Works, and the Colorado Department of Transportation, commencing upon full execution
of signatures, with further terms and conditions being as stated in said memorandum of
understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding for resurfacing and realignment of
County Road 40 between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Department of Public Works, and the
Colorado Department of Transportation be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair Pro-Tem be, and hereby is,
authorized to sign said Memorandum of Understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 23rd day of September, A.D., 2015.

Memorandum of Understanding
Between the
Colorado Department of Transportation
and Weld County
RE: Resurfacing and Realignment of Weld County Road 40
It is understood that the representatives agreeing and signing this document are authorized to do so by their
respective agencies and enter into this agreement willingly.
I. Purpose:
CDOT and Weld County have been partnering to best serve the needs of both parties. CDOT will realign and
resurface County Road 40 from Hwy 60 to 12755 WCR 40, Platteville, CO. CDOT will follow Weld County's
pavement design recommendation(see Attachment 1). Upon completion of the project,Weld County will assume
all responsibilities, maintenance and repair activities to include snow and ice operations.
II. Roles and Responsibilities:

Weld County's pavement design recommendation (see Attachment 1). Weld County will assume all maintenance

CDOT will be reaglining and paving Weld County Road 40 from Highway 60 to the west entrance
of the Platteville CDOT location.
The realignment will consist of moving the access of county road 40 to the north. It will be
perpendicular to Highway 60 for approximatly 100 feet and then curve back to the current county road
40 between the next set of power poles to the west. This will help improve the safety of the intersection
and make it more feasable for trucks to turn southbound onto highway 60 from eastbound county road 40.
The construction material will be class 6 road base. We will be using a water truck and a vibratory roller
to ensure proper compation.
The paving of county road 40 will be guided by the pavement design provided by Weld County
which is included with the MOU. We will pave at a width of 26 feet for approximatly 1,300 feet to the
